The Wisconsin Institute for Law & Liberty (WILL) has settled a landmark open records lawsuit with the Madison Metropolitan School District (MMSD), securing thousands of dollars in punitive damages and reforms to how the school district processes open records. This is a major victory for government transparency and the equal treatment of all students in Wisconsin. WILL was represented by the Wisconsin Transparency Project.

The Quotes: Dan Lennington, WILL Deputy Counsel, stated, “A whistleblower notifed us in early 2022 that MMSD had a racially discriminatory policy of treating black students more favorably than students of other races. MMSD stonewalled for over a year. Now they’ve paid the price, disavowed the policy, and committed to significant reforms. This is a huge victory for transparency.”

Cory Brewer, WILL Associate Counsel, added, “Institutions funded by taxpayers cannot ignore members of the public who seek answers. WILL is prepared to hold school districts accountable for their actions—our lawsuits reflect that.”

Details of the Agreement: MMSD will pay $18,000, including $7,386 in attorney fees and court costs and the remainder in punitive damages. Because of the litigation, MMSD has agreed to take the following additional steps:

The complaint against Madison Metropolitan School District spokesperson Tim LeMonds that he fought to keep private alleges he bullied and harassed numerous employees under his management as well as members of the local media.

Filed in October 2022 by three employees, one of whom has since left the district, the complaint includes a timeline of examples of poor behavior beginning in March 2021 through early October 2022. It also includes experiences shared by former employees who are not officially part of the complaint.

The district released the complaint in response to an open records request on Friday. On Thursday, a Dane County Circuit Court judge ruled against LeMonds’ lawsuit seeking to stop that release based on concerns about the potential reputational damage it could cause. LeMonds began working in MMSD in 2019.

The Madison Metropolitan School District can release an employee complaint filed against its spokesperson as part of a response to an open records request, a Dane County judge ruled Thursday.

Circuit Court Judge Rhonda Lanford ruled against MMSD’s executive director for communications, Tim LeMonds, who filed a lawsuit against MMSD on March 24 asking the court to stop the release of a few documents that are responsive to an open records request.

“I do not think that the plaintiff, Mr. LeMonds, has come close to showing that the public interest of protecting his reputation outweighs the public’s right to know,” Lanford said. “Especially in a case involving the public schools and how not just investigations are conducted, but how well how they are conducted and the results of that.”

Commentary on the taxpayer funded Madison school district’s non open records practices

Although you might never know it by last week’s meeting of the Madison School Board, school districts are very much included in the law that requires government — which belongs to and is paid for by the public after all — needs to be transparent in all that it does. There is no room for secrets unless specifically exempted under the law.

To me, the meeting to discuss the embarrassing failure of the Madison Metropolitan School District’s response to open records requests was an embarrassment itself. Administrators tried to explain why the district has become a laggard in fulfilling openness requests, often simply denying access or stonewalling for months to release records that “shall be honored as soon as practicable and without delay.”

They revealed that the job that long ago was designated as the records custodian, the person responsible for releasing requested public records, no longer exists. Instead, the district’s legal department has been taxed with the job and apparently is overwhelmed by other tasks.

That’s patently unacceptable, and I’m surprised School Board members didn’t demand an accounting. No governmental body can just ignore the law because it refuses to assign adequate staff to comply with it.

But one of the lawsuits was actually filed by the district’s own spokesman, Tim LeMonds. After the district determined it had to release a complaint against LeMonds by his staff, the tight-lipped LeMonds — whose job is supposed to be communicating with the public — sued his employer to stop disclosure.

You can’t make this stuff up — or justify it.

The public records request came from NBC15 reporter Elizabeth Wadas, who requested all emails from Dec. 19, 2021, through Dec. 19, 2022, that contained her name or references to an NBC15 reporter. The district released hundreds of records related to the request, but per open records law notified LeMonds that the complaint would be part of the release and allowed him time to challenge that.

He did so, with his attorney arguing that the October 2022 complaint and related documents are “technically” responsive to the request, but were “not, themselves, the subject of the request.” The filing further argued that releasing the documents “would almost certainly cause irreparable harm to him, his reputation, the public’s perception of him, his standing in the community, and within MMSD itself.”

The briefing also states that an investigation of the complaint by the district’s legal and human resources department found that the accusations were “without merit.”

A meeting in which the Madison School Board was to discuss its open records policy was effectively held behind closed doors Monday after a problem with its livestream kept the public from being able to see it.

The meeting was scheduled for 5 p.m. Monday and was legally noticed as a virtual meeting, with only school board members attending in person. But when officials couldn’t get the public’s livestream for the meeting to start, they decided to proceed with the meeting anyway and post a recording of it later.

Taxpayer Supported Madison School District PR Employee Sues to Stop Open Records Disclosure

The Madison Metropolitan School District is being sued by one of its own. MMSD Head of Communications Tim LeMonds does not want two documents from an NBC15 Investigates’ open records request released – and he is taking his bosses to court to stop it.

On Friday, LeMonds filed a preliminary injunction motion against MMSD, urging a Dane County judge to conduct an expedited review of the documents in question, two emails he does not want the public to see.

LeMonds’ lawyers argue that what is in those emails would likely be bad for his repution. Their release would lead to “unwarranted, unfair and irreversible public ridicule and gossip, negative public perception, and jeopardize his ability to credibly perform his duties (with MMSD).”

Taxpayer Supported Madison School District parents file open records requests after they say district leaders ignore concerns

Imagine being a parent worried for your child’s safety and not being able to get more information from staff about what’s going on. That’s the reality one Madison mom says she has lived for more than 11 months. And she’s not alone.

“As a parent we entrust the school, these people in leadership positions, to care for our children, to ensure they’re safe to ensure they’re in a good environment,” said Amy Ryan.

That trust for Ryan is now broken. She says the Madison Metropolitan School District gave her the run around when she had concerns for her kids’ safety at school. Ryan says she tried emailing her questions and setting up meetings with staff. Still she says her questions went unanswered.

“It’s frustrating as a parent to not get a response and to feel like my family didn’t matter,” said Ryan.

LeMonds declined to comment on the matter when reached by the Wisconsin State Journal.

Releasing the complaint that staff filed would harm LeMonds and the school district because he is the district’s spokesperson, LeMonds’ complaint says, arguing that the potential harm outweighs the public benefit of the document’s release.

“Releasing the subject documents would almost certainly subject Mr. LeMonds to unwarranted, unfair and irreversible public ridicule and gossip, negative public perception, and jeopardize his ability to credibly perform his duties as (the district’s) chief public spokesperson — especially since all of the accusations in the complaint were found to be without merit by (the district),” the court complaint states.

In May, Wisconsin Transparency Project president and founder Tom Kamenick wrote in an email to the Cap Times that he has “received more complaints about MMSD than any other government agency.”

“I’m frequently seeing lengthy delays, exorbitant fees, and downright illegal denials from the district,” Kamenick wrote. “The district seems to make transparency and accountability a very low priority, and I’m not surprised to see them sued twice in quick succession.”

State statutes outline the requirements for public entities regarding open records. In a 2019 compliance guide, the state’s Office of Open Government called part of the statute on open records “one of the strongest declarations of policy found in the Wisconsin statutes.”

“[I]t is declared to be the public policy of this state that all persons are entitled to the greatest possible information regarding the affairs of government and the official acts of those officers and employees who represent them,” the statute states.

Another open records suit filed against Madison School District

or the second time in less than two weeks, the Madison School District is being sued over its response to a public records request.

The conservative Milwaukee-based Wisconsin Institute for Law and Liberty, or WILL, filed suit Thursday asking a judge to order the district to release staff training materials entitled “LGBTQA+ 101.”

LGBTQA+ typically refers to lesbian, gay, bisexual, transgender, queer or questioning and asexual individuals and groups. The + refers to “the limitless sexual orientations and gender identities used by members of our community,” according to the advocacy group Human Rights Campaign, which has conducted trainings with the school district in the past.

The suit comes after the district’s teachers union, Madison Teachers Inc., filed suit May 9 alleging the district violated Wisconsin’s public records law by failing to fulfill a Nov. 3 records request for information on staff benefits and contracts.

Fourteen districts eventually responded with at least some of the data. The county’s two largest and most racially and socioeconomically diverse, Madison and Sun Prairie, required the newspaper to file public records requests for the data. To date, they remain unfilled.

In Madison, students could be marked present simply by exchanging messages with “the homeroom teacher and any specials teacher they are scheduled to receive instruction from that day.” In Verona, “two-way communication” with a teacher of staff had to occur at some time during the 24-hour day when the class occurred for the student to be marked present.

By contrast, the Marshall School District expected students to show up for each online class just as they had to show up for each in-person class pre-pandemic. It saw its rate of chronic absenteeism rise from 7% to 12% from the first semester of the last school year to the first semester of this one.

Seven school districts in Wisconsin, including three in Dane County — Madison, Sun Prairie and Mount Horeb — dispensed with enforcing state attendance laws altogether. The law identifies actions districts have to take when students are regularly absent without valid excuses.

Madison, the county’s largest district, did not respond to multiple requests for comment on why it sought the waiver.

While positive test results are being processed and their number reported quickly, negative test results are taking days in some cases to be analyzed before they are reported to the state.

The department said it was between eight and 10 days behind in updating that metric on the dashboard, and as a result it appeared to show a higher positive percentage of tests and a lower number of total tests per day.

The department said this delay is due to the fact data analysts must input each of the hundreds of tests per day manually, and in order to continue accurate and timely contact tracing efforts, they prioritized inputting positive tests.

“Positive tests are always immediately verified and processed, and delays in processing negative tests in our data system does not affect notification of test results,” the department said in a news release. “The only effect this backlog has had is on our percent positivity rate and daily test counts.”

Staff have not verified the approximately 17,000 tests, which includes steps such as matching test results to patients to avoid duplicating numbers and verifying the person who was tested resides in Dane County.

Resisting Open Records Requests at the taxpayer supported Madison School District

The Cap Times submitted an open records request the morning of Jan. 17, the deadline for residents to submit feedback through an online form, asking for “any and all public feedback on the Madison Metropolitan School District superintendent finalists, submitted online or via forms at the public forums, as of 8 a.m. Friday, Jan. 17.”

In late February, the district initially denied the request entirely, citing concerns about privacy and limiting people’s willingness to participate in future public input opportunities. The Cap Times said it was going to run a story about the denial and asked for comment, and the decision was reversed. The records took nearly two more months to deliver as staff redacted names and emails from the forms and then the pandemic delayed that work.

I received an email on February 18, 2020 from Barbara Osborn that my “request has been shared with our legal department”.

I received this response from Sherrice M Perry on March 13, 2020:

Dear Mr. James Zellmer,

Please accept this email as the Madison Metropolitan School District’s (the “District”) response to your public records request for “a list of invitees and participants in last week’s ‘community leader and stakeholder’ meetings with the candidates.” Attached below are the records that are most responsive to your request.

With regard to the requested records, the District redacted portions of the attached records consistent with the provisions of the Family Educational Rights and Privacy Act (FERPA; 34 CFR 99.3 et seq.) and Wis. Stat. § 118.125(1)(d). The requested records contain “personally identifiable information.” Pursuant to FERPA, “personally identifiable information” is defined as “information requested by a person who the educational agency or institution reasonably believes knows the identity of the student to whom the record relates” or “information that, alone or in combination, is linked or linkable to a specific student that would allow a reasonable person in the school community, who does not have personal knowledge of the relevant circumstances, to identify the student with reasonable certainty.” (34 CFR 99 3). According to these definitions, the District determined that the redacted documents contain information regarding very small populations (e.g. one or two students) from a distinct group or affiliation and thus, a “reasonable person in the school community” could identify the students who were referenced in the record. Nonetheless, by providing you the record with only limited redactions, the District is in full compliance with Wis. Stat. 19.36(6).

2005: When all third graders read at grade level or beyond by the end of the year, the achievement gap will be closed…and not before:

On November 7, Superintendent Art Rainwater made his annual report to the Board of Education on progress toward meeting the district’s student achievement goal in reading. As he did last fall, the superintendent made some interesting claims about the district’s success in closing the academic achievement gap “based on race”. 

According to Mr. Rainwater, the place to look for evidence of a closing achievement gap is the comparison of the percentage of African American third graders who score at the lowest level of performance on statewide tests and the percentage of other racial groups scoring at that level. He says that, after accounting for income differences, there is no gap associated with race at the lowest level of achievement in reading. He made the same claim last year, telling the Wisconsin State Journal on September 24, 2004, “for those kids for whom an ability to read would prevent them from being successful, we’ve reduced that percentage very substantially, and basically, for all practical purposes, closed the gap”. Last Monday, he stated that the gap between percentages scoring at the lowest level “is the original gap” that the board set out to close.

Unfortunately, that is not the achievement gap that the board aimed to close.

Shortly after the office was proposed, Cheatham said non-district-authorized charter schools have “no consistent record of improving education for children, but they do drain resources from public schools, without any control in our local community or school board.”

Rather than invest in what we know works in education, this proposal puts resources in strategies with mixed results at the expense of our public school students,” she said in May 2015

The John Doe is being represented by attorney Tom Kamenick, the president and founder of the Wisconsin Transparency Project. The lawsuit filed Nov. 14 in Dane County Circuit Court asks the court to mandate the release of the records and award Doe at least $100 for each of the 48 counts it alleges against the district in addition to attorney fees.

According to the lawsuit, between July 10 and Oct. 31 Doe filed requests seeking documents related to administration’s weekly updates with board members, curriculum plans, school improvement plans and the annual seclusion and restraint report, among other topics.

Despite spending far more than most taxpayer supported K-12 school districts, Madison has long tolerated disastrous reading results.

The School District Administration is planning a substantial tax and spending increase referendum for the fall, 2020 election.

The records requested between July and October have included such things as the “weekly update” document provided by the district to School Board members; School Improvement Plans for the 2019-20 school year; the district’s K-12 sequential curriculum plan; the “Inequitable Distribution of Teachers Report,” all reports regarding notification and reporting following use of seclusion or physical restraint; annual licensure certifications; among other documents.

Bill Lueders, president of the Wisconsin Freedom of Information Council, said the state open records law clearly states that no request can be denied because of anonymity, and that the district’s denials “are clearly illegal.”

“It may be that the district is relying on a case decided a few years back in which a court agreed that a custodian could deny a request from a known harasser,” Lueders said. But that does not give MSD the right to reject anonymous requests.”

He said the district should admit it was wrong and settle the lawsuit, “otherwise taxpayers will be on the hook for legal costs that should never have been incurred.”




Open Records vs the taxpayer funded Madison school board

Nicki Vander Meulen, who was elected to the board in 2017 and serves as the board’s clerk, said that in response to the union’s push, district administrators in a private “board briefing” Monday with her and another board member said acceding to the union’s demand would set a “bad precedent.”

“That’s virtually telling you how to vote,” she said.

Vander Meulen is not the first board member to question the legality of board briefings, which were instituted in 2013 by just-departed former superintendent Jennifer Cheatham and are held separately between one or two board members and administrators to go over items on upcoming agendas.

Former board member TJ Mertz stopped attending the meetings out of fear they could amount to the creation of “walking quorums,” which occur when members of a public body coordinate privately to take a certain action, thus rendering “the publicly held meeting a mere formality,” according to the state Department of Justice.

Madison has for decades spent far more than most taxpayer supported K-12 school districts. Yet, we’ve long tolerated disastrous reading results.




The University of Wisconsin Madison Loses an Open Records Lawsuit

A Dane County circuit judge recently ruled that UW-Madison broke the state’s public records and open meetings laws — violations that may cost the university more than $40,000.

UW-Madison’s School of Medicine and Public Health failed to turn over records relating to how a committee awarded millions of dollars from an endowment for public health projects, according to the ruling. The committee also failed to properly inform the public why it went behind closed doors in a 2016 meeting.

The judge also noted that “in this grant cycle alone” the committee funded two projects that were not as highly rated as others, and those two projects were associated with committee members.

The June 13 court order requires UW-Madison to pay back the plaintiff’s legal fees or to appeal. University officials said they had not received information on the fees and are still considering whether to appeal.

An attorney for the plaintiff, Christa Westerberg, said legal fees in the more than two years spent litigating the suit will be “north of $40,000.”

Westerberg, of the Madison law firm Pines Bach and co-vice president of the state’s Freedom of Information Council, said UW-Madison “aggressively litigated” the lawsuit in a way she had not seen before.

For UW-Madison, the stakes in the suit are high.

“This is a case about whether or not the university can protect the integrity of research and programs at UW-Madison by maintaining the confidentiality of reviewer comments,” UW-Madison spokesman John Lucas said.

Pines Bach attorneys say the university has until July 29 to file a notice to appeal.

In 1999, Blue Cross Blue Shield United of Wisconsin, Inc. (BCBS) petitioned the Office of Commissioner of Insurance (OCI) to permit it to convert from a non-profit corporation to a for-profit corporation. In order to convert to a for-profit corporation, BCBS had to compensate the state for the decades of tax-exempt status it enjoyed, and proposed to do so by giving stock to a foundation, which in tum would sell it and distribute the proceeds to the state’s two medical schools: the University of Wisconsin Medical School and the Medical College of Wisconsin. The funds would be used to promote public health initiatives. The OCI required modifications to establish accountability mechanisms for, and public participation in the governance of, the conversion funds. Among the accountability requirements was that each medical school must create a public and community health oversight and advisory committee to oversee the distribution of the public health-allocated percentage of conversion funds. The OCI required the committees to conduct themselves in accordance with standards consistent with the Wisconsin public meeting and public record laws.

The Oversight and Advisory Committee (OAC) is the University of Wisconsin School of Medicine and Public Health’s designated committee to distribute the 35% public health funds associated with the BCBS conversion. The OAC is one of two governance committees that administer the Wisconsin Partnership Program’s (WPP) five grant programs that seek to improve the health and well-being of Wisconsin residents. A different committee, the Partnership Education Research Committee (PERC), administers and oversees the research grants. Andrea Dearlove is the Senior Program Officer for WPP. With her staff and the OAC’s director Eileen Smith, she designed an awards program, known as the Community Impact Grant, to incorporate experience from previous WPP community academic grant programs as well as nationwide best practices to address complex public health issues.

Madison School District Response To Open Records Requests Called “Ugly”

Open records watchdogs and clean government advocates call responses by Madison school officials to open records inquires “ugly.”

A recent report distributed by the Wisconsin Freedom of Information Council and published in the Wisconsin State Journal says the Madison Metropolitan School District (MMSD) would not fulfill a request for information about public records without payment. Responding to a specific request, filed by the Wisconsin Institute for Law and Liberty (WILL), the Madison district required a payment of more than $1,000 to provide the requested information.

WILL attorneys Tom Kamenick and Libby Sobic say large school districts like Madison and Milwaukee “need to devote more resources to complying with open records law.”

According to an attorney representing MMSD, the Madison district does not have a system in place for tracking open records requests, hence its extremely high price in this case.

Writing in the Wisconsin State Journal, Kamenick says that while records custodians are allowed to charge fees for locating records, schools districts that need so much time to locate records are apparently not doing a good job of tracking requests.

“It should not be so hard to find out how well any government entity complies with the law,” Kamenick said.

Even so, “I don’t think they followed the law,” Wisconsin Freedom of Information Council president Bill Lueders said after reviewing minutes from the meetings.

“I think they interpreted the (open meetings law) exemption overbroadly. The idea of an open meetings law is that exemptions are supposed to be for extraordinary circumstances and narrowly applied.”

Lueders said minutes from other closed School Board meetings obtained by the State Journal also raise questions about whether the discussions should have been held before the public.

April Barker, a Waukesha-based attorney and council member who specializes in open records issues, said some of the topics discussed were “bottom-line budget impact discussions and policy and procedure discussions,” which are not exempt from the state’s open meetings law.

“It looks like there are some troubling and overreaching exercises of closed session represented,” Barker said.

Wisconsin law requires boards to release the identities of at least five candidates to the public upon request when there are at least five applicants, according to a 2004 opinion by then-Attorney General Peg Lautenschlager.
The opinion doesn’t specify when the names must be disclosed.
School district officials said Friday they were still reviewing the newspaper’s request. On Tuesday district lawyer Dylan Pauly told the newspaper the district would respond to the request within 10 business days.
Bill Lueders, president of the Wisconsin Freedom of Information Council, said the School Board “is clearly violating the spirit of the law” by not making the names public before the board made a decision. The law calls for records to be provided as soon as possible.
“For the district to pick a superintendent candidate without first meeting its statutory obligation to identify (at least) five candidates considered most qualified delegitimizes the selection that is made,” Lueders said.

It’s also illegal. Government entities cannot require a requester to come into the office to get a copy of a record except in the rare circumstance where it is not possible to copy the record. Wisconsin law provides plainly that “any requester has a right to inspect a record and to make or receive a copyof a record that permits photocopying.” Wis. Stat. 19.35(1)(b) (emphasis added). Decades ago, the law actually permitted the government to choose whether to provide a copy or require the requester to come in and copy it. In 1991, however, the legislature amended the law to remove that choice when a request is not made in person. State ex rel. Borzych v. Paluszcyk, 201 Wis. 2d 523, 527, 549 N.W.2d 25 (Ct. App. 1996) (describing the legislative history and noting that “[b]y statute, [the custodian] was required to photocopy and send the material requested”).
Be aware, though, that the government entity can charge you the actual postage cost to mail the copies. Wis. Stat. 19.35(3)(d).

Newly released records provide details in recently Police concluded disciplinary cases

Like other such reports that the MPD’s office of Professional Standards and Internal Affairs has been producing on a quarterly basis since 2016 and archiving online, it was short on specifics. It simply listed the allegations and outcome of the four instances during this period in which officers were either disciplined or resigned after being accused of misconduct. The names of the officers were not included, even though three of the four have previously been named in news accounts.

In the remaining case, an officer “sent an inappropriate video to another member of MPD [and] did not follow proper procedures with handling an ECD and duty firearm.” (ECD stands for electronic control device, or what is commonly referred to as a Taser.) The officer was found to have violated department rules regarding the use of force, police weaponry and professional conduct. The action taken was listed as “resigned.”

On April 5, the day after the summary was released, Isthmus asked the MPD for its disciplinary records in these four instances. The request was part of a long-term effort to secure the prompt release of records regarding police discipline. 




Madison police: School staff objected to arrests of students for gun possession in school



Chris Rickert:

Staff at Madison’s La Follette High School have on at least two occasions objected to police arresting at least one La Follette student who brought a gun to school, including one case in which two staffers lied about being two students’ legal guardians, according to police reports.

Kyshawn M. Bankston, 18, was charged May 9 with possession of a firearm on school grounds and carrying a concealed weapon after being arrested at the school two days earlier. Police had been called to the school about an unrelated robbery, but while there they were informed by staff that Bankston might have a gun and were asked for help searching his backpack.

Police found a handgun, two magazines with rounds in them, a scale and an empty plastic bag that had contained marijuana, and as they moved to arrest Bankston, he lunged for the gun and had to be restrained, according to police.

Madison police denied a State Journal request under the state’s public records law for the full report of the May 7 incident, saying the investigation into the incident was still open, but did release two other reports regarding Bankston in response to the records request.

Civics: Journalist sues UW-Madison for rejecting request for name, image, likeness consulting contract

A journalist sued the University of Wisconsin-Madison and its fundraising arm after the university denied his request for an athletic department consulting agreement that could shed more light on the name, image and likeness era of college athletics.

The lawsuit could also potentially answer a larger question about whether public university foundations are subject to Wisconsin’s public records law.

“There’s no good reason why UW-Madison should be using its foundation to effectively offshore public records,” journalist Daniel Libit told the Milwaukee Journal Sentinel.

Spokespeople for both UW-Madison and the UW Foundation said they hadn’t received the complaint and wouldn’t comment on pending litigation.

UW-Madison, UW Foundation deny records request for Altius contract

Libit, a UW-Madison alumnus who writes for Sportico, filed the lawsuit Wednesday after UW-Madison rejected his records request last fall. He asked for a copy of the contract UW-Madison had with Altius Sports Partners, a firm other large universities have hired to support student-athletes who can now profit from endorsement deals they strike.

UW-Madison told Libit it had no records because the UW Foundation had the contract. The foundation also didn’t provide the contract, saying it was a private entity exempt from Wisconsin’s public records law.




Ex-Madison schools spokesman retaliated against employees, report says

The complaint was made public in May following a public records request by NBC15 reporter Elizabeth Wadas, whom LeMonds allegedly said was “quickly becoming the sleaziest journalist in Madison” and whom he called “a pig of a journalist.” LeMonds tried to fight the release of the complaint, which was responsive to Wadas’ records request, in court, arguing it did not meet the balancing test for what the public needed to know compared with the damage it would cause.

A judge ruled against him, however, and the documents related to the initial investigation were released in late May.

He remained working in his role until mid-June, when he was placed on paid leave. The letter placing him on leave, dated June 12, was also provided as part of Tuesday’s released records.

The staff also told district investigators that LeMonds frequently expressed his disdain toward certain reporters, all of them women.

On Oct. 6, 2022, he allegedly told members of the district’s communications department that there was “no way” he would respond to three interview requests from an unnamed reporter, described as a woman of color, because he “didn’t like her.” In that same meeting, he asked staff to share any negative experiences they had with former Wisconsin State Journal reporter Elizabeth Beyer, whom he called “a horrible human being.”

He also reportedly called WMTV (Ch. 15) reporter Elizabeth Wadas “a pig of a journalist,” who was “quickly becoming the sleaziest journalist in Madison.”

LeMonds in June pointed to the district’s initial investigation findings as proof absolving him of the claims. Two months earlier he’d sued his employer to prevent the release of the records including those claims. That bid was denied in late May.

UW-Madison Blacked Out Admissions Criteria in Response to GOP Legislator’s Concerns

UW-Madison blacked out lengthy sections of its admissions criteria in response to an open records request from a Republican legislator who is now trying to change state law to mandate that the flagship university admit Wisconsin students in the top 5% of their classes.

UW-Madison’s freshman class was 8,628 students back in September of last year. The UW’s own numbers show that about 45% of that class is from Wisconsin; the rest are from other states or other countries. Sixty percent of Wisconsin freshman applicants who applied to UW-Madison last fall were accepted.

On Thursday, in the wake of the United States Supreme Court decision striking down affirmative action in university admissions at two prominent schools, Wisconsin Right Now obtained the blacked out documents that were sent to state Rep. David Murphy in September 2021. In the wake of the Court decision, UW-Madison admitted, “We have considered the race of applicants as one factor in a holistic admissions process that focuses first and foremost on candidates’ academic strength.”

UW-Madison told Murphy it redacted the documents to protect “trade secrets” and because “release of such information would harm the public’s interest.” The university was also concerned that employees could face “reprisal” if their names were released.




Non communication and the taxpayer supported Madison School District



Elizabeth Wadas:

The Madison Metropolitan School District’s head of communications, Tim LeMonds, is on leave amidst an ongoing investigation. NBC15 Investigates confirmed LeMonds’ employment status with the district’s human resources team Thursday afternoon.

Earlier this month, MMSD broke its silence after a complaint alleging harassment and bullying against its head of communications was made public after NBC15 Investigates went to court to make the complaint public.

After a Dane County judge ruled MMSD had to release the complaint to the public, the district sent a public statement. It was sent byf Communications Manager Ian Folger who confirms the statement was drafted by MMSD’s legal team. The statement addressed a complaint against LeMonds that alleges instances of “emotional abuse, bullying, unequal pay, and harassment on the basis of gender, and race or ethnicity” against current and former district employees.

The complaint details how LeMonds allegedly interacted with and spoke about female journalists, including NBC15′s Elizabeth Wadas. According to the complaint, LeMonds allegedly described Wadas in a Zoom meeting as “Quickly becoming the sleaziest journalist in Madison…What a pig of a journalist” in response to a story Wadas was working on that wascritical of a high school football coach. The school did an initial investigation into the complaint months ago and found most of the claims were found “without merit.” And no action was taken against LeMonds at that time.

Taxpayer funded Madison School District‘s “communications” department review

The Madison Metropolitan School District is “committed to doing the hard work and restoring the integrity” of its communications team following the release of an employee complaint against spokesperson Tim LeMonds last Friday.

In an unsigned statement posted to its website Thursday and sent via email to reporters by Communications Manager Ian Folger, the district said it “will conduct a full review of the department operations, structure and human interaction in the coming months,” with no more specific timeline.

“At the same time, the District will have significant leadership changes this summer, and through those transitions we will work to reorganize and restore relationships that are essential to our success,” according to the statement. “We will work to build a positive workplace culture for employees.”

Those leadership changes include Superintendent Carlton Jenkins retiring and longtime administrator Lisa Kvistad taking over as interim superintendent during a search for the next permanent leader. Chief Financial Officer Ross MacPherson and General Legal Counsel Sherry Terrell-Webb are among other top leaders leaving this summer.

In fact, in a story last week in Isthmus by Deborah Kades, she reports that when WMTV reporter Elizabeth Wadas approached Jenkins at a public meeting last winter LeMonds prevented her from reaching him. He told her that the meeting was for the public. Wadas informed him that being a reporter did not make her an alien, but apparently to no avail.

LeMonds also leads a communications department for a district that, beyond just LeMonds, seems intent on not communicating. In 2019 a Madison East educator and trip chaperon was found to have placed hidden cameras in the hotel bathrooms of students. The district conducted an investigation to determine if staff followed policy regarding the reporting and follow up on these incidents. The investigation concluded they had, but the district refused to release the report. Parents and students were, understandably, upset. Even school board members were not allowed to read it. Then, inexplicably and in response to another open records request on yet another camera incident, the district released the full report to Isthmus in August of 2021. LeMonds refused to answer Isthmus reporter Dylan Brogan’s questions about it at the time. 

And over a long period, the MMSD holds the dubious distinction of being the least transparent public agency in the state. In March, the Wisconsin Freedom of Information Council “awarded” the district with its No Friend of Openness (Nopee) award. The council wrote: “It’s rare for a public institution that depends on taxpayer support to be as awful as this one when it comes to public records and accountability. The district, through spokesperson Tim LeMonds, has become notorious for outrageous delays and excuses, prompting multiple lawsuits alleging violations of the records law. Tom Kamenick of the Wisconsin Transparency Project has said he has “received more complaints about MMSD than any other government agency.” It is time for the district’s casual contempt for the public’s right to know to come to a screeching halt.”

Tim LeMonds had good reason to fight the release of a complaint against him. Now he should tell his side of the story.

In a statement released Thursday by district officer of internal communication Ian Folger, the district says “the information shared publicly last week was difficult for all individuals mentioned in the documents, as well as for those who interact with them. It is abundantly clear that there are relational problems within the District’s communications department that need to be addressed.”

Folger said LeMonds remains a full-time district employee and that his role with the district has not changed. He said he could not comment on whether LeMonds is under further investigation by the district, but LeMonds said in a Thursday interview that as far as he knew, he is not.

LeMonds — who in the interview said he was speaking only on behalf of himself — said he has not been subject to any disciplinary action in the wake of the documents’ release and “categorically” denied that he called Stephanie Fryer, the spokesperson for the Madison Police Department, an “idiot,” as was alleged in the court documents.

How diverse are Madison’s standalone honors classrooms?

One of the key arguments during the debate over standalone honors courses for ninth- and 10th-graders earlier this school year was the lack of diversity in those classrooms.

What did those classrooms look like in the first semester of the 2022-23 school year? Similar to how they’ve looked in each of the preceding four years, according to new data from the Madison Metropolitan School District.

Standalone honors classes are designated “honors” and require students to sign up when selecting courses. Earned honors, on the other hand, allows students to achieve an honors designation in a regular education course through specific grade benchmarks or additional projects.

The district provided demographic data for standalone and earned honors classes for the first semester in response to a public records request from the Cap Times. How diverse are Madison’s standalone honors classrooms?



Scott Girard:

One of the key arguments during the debate over standalone honors courses for ninth- and 10th-graders earlier this school year was the lack of diversity in those classrooms.

What did those classrooms look like in the first semester of the 2022-23 school year? Similar to how they’ve looked in each of the preceding four years, according to new data from the Madison Metropolitan School District.

Standalone honors classes are designated “honors” and require students to sign up when selecting courses. Earned honors, on the other hand, allows students to achieve an honors designation in a regular education course through specific grade benchmarks or additional projects.

The district provided demographic data for standalone and earned honors classes for the first semester in response to a public records request from the Cap Times. King County Prosecutor Dan Satterberg has asked Sheriff Patti Cole-Tindall to put together an investigation into the deletion of text messages from the phones of then-Seattle Mayor Jenny Durkan and other city leaders in 2020.

“It wasn’t clear to me that anyone was going to start this investigation without prompting,” Satterberg said Thursday in an emailed statement. “Just like the public’s right to an open courtroom, people have a right to know what is in public documents — including text messages.”

Satterberg’s office requested the investigation July 28, spokesperson Casey McNerthney said.

“We are in the early stages of reviewing the matter,” said Cole-Tindall spokesperson Cynthia Sampson, giving no other information.

Last year, a whistleblower in Durkan’s office revealed that the mayor’s texts from a 10-month period — including tumultuous weeks in early summer 2020 when police deployed tear gas against Black Lives Matter protest crowds and vacated the East Precinct — were missing.

Civics: open records transparency takes a hit in Wisconsin

Bill Lueders, president of the Wisconsin Freedom of Information Council, described the court’s ruling as “a body blow to the state’s traditions of open government.”

“It undermines the provision in the open records law that allows litigants to recover actual costs and attorney’s fees in cases in which access to records is wrongfully denied,” Lueders said in a statement. “The court’s conservative majority has created new opportunities for authorities to deprive the public of access to public information.”

Both Kamenick and Lueders called on state lawmakers to pass legislation clarifying state records laws in light of Wednesday’s ruling.

The new policy in Burlington was developed in consultation with the Racine County District Attorney’s Office. Other police departments in the county say they, too, have been advised by the DA to withhold public disclosures on any case headed to court.

That means that the public will not be allowed any information about criminal cases until trial, unless law enforcement officials choose to release information.




Parents sue Madison School District over East cameras, allege district violated its own policy on cameras

The civil rights lawsuit, filed in U.S. District Court, also alleges that a school security official failed to point out the cameras to a state criminal investigator who was searching for hidden cameras at East while investigating an unrelated criminal case that also involved hidden cameras.

The parents, Patanne Coffey and Anna Hauser, also filed an open records lawsuit against the district last year alleging the district was dragging its feet in turning over records about the discovery last year of two cameras that were placed in rooms at East where they would have captured students with disabilities having their clothing changed.




Notes on Madison area K – 12 taxpayer supported school attendance

MMSD spokesman Tim LeMonds told the Cap Times in an email Tuesday the district’s attendance rate Monday was 80.6%. That’s below the average of more than 90% throughout the 2020-21 school year, according to attendance data received through an open records request.

Other area school districts, which all returned from winter break as scheduled in the first week of January, reported slightly higher attendance rates during the first week of 2022.

In the Verona Area School District, attendance ranged from 85.37% to 89.58%, according to data provided by superintendent Tremayne Clardy.

Waunakee Community School District’s attendance rate was between 87.86% and 89.81% throughout last week, district communications and engagement specialist Anne Blackburn wrote in an email.

Similarly, the Oregon School District saw attendance rates from 82.2% to 87.5% last week, according to an email from district communications director Erika Mundinger.

The Middleton-Cross Plains Area School District saw attendance rates stay between 88.5% and 90.2% the week of Jan. 3, director of information and public relations Shannon Valladolid wrote in an email.

Online Systems and the Madison School District’s Remote Capabilities/Results (infinite Campus)



The lengthy 2020-2021 remote experience that Madison’s K-12 students endured made me wonder how the taxpayer funded school district is performing with online services.

I was part of a group that reviewed the District’s acquisition of “Infinite Campus” software in the 2000’s. Having been through many software implementations, I asked the District’s then IT/Chief Information Officer if teachers and staff would be required to use this system, as part of their day to day jobs?

“No”.

I asked how they planned to successfully implement the system?

“with great care”.

I then suggested that they forego the purchase and not spend the money (million$ over time) if the system was not made part of everyone’s job.

I remain interested in this topic for several reasons:

  • I was part of the original review group, and had implementation experience.
  • I was and am very concerned about the lack of (consistent) pervasive online learning experiences in our very well taxpayer funded K-12 system, amidst long term, disastrous reading results.
  • The inability to do this, effectively, while spending millions reflects much larger organizational challenges.
  • The imposition of remote learning on our student population – while many other districts managed to stay in person – has long term consequences for all of us.
  • A “successful” implementation of a system such as Infinite Campus would have placed everyone in a much better position for the events of 2020-2021.
  • ** I do not mean to suggest that Infinite Campus is the be all/end all. Rather, it is the system we have spent millions on….
  • ***** I spoke recently with someone familiar with large scale healthcare software implementations. One of the largest vendors conducts a review with clients on the tools they use, sort of use and don’t use along with the costs thereof (and any 3rd party services that may or may not be useful). With respect to Madison, perhaps it is time to rethink many things….

One-third of students stay home following Monday fights at Madison East High School

More than 600 students did not show up for classes on Tuesday, the district said, more than one-third of the total 1,717 students enrolled at East. As of noon, 277 were excused and 325 had not shown up and were not excused, though secretaries were still updating records at that time.

During Monday’s lunch hour, more than 15 police responded to break up a set of fights that broke out near school grounds. Eight students were pepper-sprayed as police tried to break up the fights.

District spokesperson Tim LeMonds told News 3 Now that an estimated 90% of behavioral issues at the high school have happened during the school’s open lunch period when students can leave campus. Just over two weeks ago, fights involving more than 100 students and parents broke out in a crowd around lunchtime.

The Madison School Board’s decision to remove school resource officers, or SROs, from the high schools came amid the racial reckoning following the murder by Minneapolis police of George Floyd, sometimes-destructive social justice protests in Downtown Madison, and a years-long campaign to get rid of SROs that included shouting down School Board meetings and demonstrating outside the School Board president’s home by the local group Freedom Inc. and its allies.

“Even with SROs we still had people bring weapons and threaten to bring weapons to school and we still had fights,” said Allen, the student body president. “It wasn’t like their presence prevented any of that. The East student body in general still does not want SROs in our school.”

Madison Metropolitan School District high school students got a higher percentage of A grades in the 2020-21 pandemic school year than they did during the 2018-19 school year, new data show.

The data provide another measure of academic progress during one of the most challenging years in education in recent memory. It’s a valuable piece of a complex puzzle that also includes statewide student assessments.

Those, however, were difficult to evaluate for last school year, with 13% of eligible students statewide not participating, including 50.3% on English Language Arts in MMSD. State officials stressed during a media call following the public release of the assessment results that they should be considered with the necessary caveats.

MMSD provided its response to a June 15records request Monday, Nov. 1. The district charged $427.92 to locate and compile the records, which also included attendance and suspension data.

The percentage of A grades received rose from 42.9% in 2018-19 to 44.7% in 2020-21. In 2019-20 the percentage had dipped to 21.7% of grades received, but that was mostly a result of the change in systems at the end of the school year.

But there were significant differences among the schools.

At West, for example, 49.6% of grades given in 2018-19 were As. That rose to 51.3% in 2020-21.

At East, the percentage went from 39.4% of grades given as As in 2018-19 to 40.6% in 2020-21. Similarly, at La Follette, 38.2% of grades given in 2018-19 were As, with a jump to 40.3% in 2020-21.

Memorial fell in the middle, with 42.2% of grades given in 2018-19 being As and 44.5% of grades given in 2020-21 being As.

Students, parents file lawsuit in federal court against Madison School District, David Kruchten

Seven former East High School students and parents of two current students filed a federal civil lawsuit Friday against the Madison School District and a former teacher recently sentenced to 12 years in prison, for injuries sustained after the teacher planted hidden cameras in their hotel bathrooms.

“The high school girls felt tremendously violated and are still dealing with those emotions,” attorney Jeff Scott Olson said. “What you would expect a responsible school district to do is to be relatively transparent when addressing the situation.”

Instead, Olson said, the school district has structured its internal investigations surrounding the incident to avoid releasing the details to families based on attorney-client privilege.

The district has looked for ways to share as little as possible with them rather than looking for ways to help them heal, Olson said. The lawsuit seeks unspecified monetary damages.

The Wisconsin State Journal filed an open records request for reports from the district’s third-party investigation into two camera incidents, one involving former teacher David Kruchten and a separate discovery that hidden cameras were once installed in an East High School coach’s office, but both requests were denied due to attorney-client privilege. The district spent roughly $38,000 to conduct both internal investigations.

Civics: Elections, Open Records and Special Interest Spending Commentary

Recently released emails reveal that last May, Racine Mayor Cory Mason emailed his fellow Democrat mayors in Milwaukee, Madison, Green Bay, and Kenosha to set up a virtual meeting during which “the Elections Planning Grant will be discussed.”

That grant—from CTCL—was ultimately awarded to the five cities, which were dubbed “The Wisconsin Five.” In both Green Bay and Milwaukee, CTCL deployed a partner organization, the National Vote at Home Institute, to essentially take over the administration of the presidential election.

The National Vote at Home Institute’s Wisconsin director, Michael Spitzer-Rubenstein, was given unprecedented access to ballot data and even ballots themselves and so thoroughly (and almost certainly unlawfully) took over Green Bay’s election planning that the city’s municipal clerk quit in disgust.

In Milwaukee, he demanded a daily email from the director of the city’s election commission with detailed statistics on which ballots had been returned and which were still outstanding. He was so brazen that he even asked for access to the city’s absentee ballot database.




Nearly 28% of Waukesha School District high school students are failing at least one class, records show

Data from the Waukesha School District shows students have been struggling in the district’s hybrid learning model, with about 30% of high school students failing at least one class during the first quarter last fall.

The data, which came from an open records request submitted by parent Rebecca Flaherty, was sent to a reporter by the Wisconsin Achievement Partnership, a group of parents pushing for five-days-a-week in-person instruction. 

It showed 27.73% of district’s high school students in the current school year had a failing grade in at least one class and GPAs had dipped significantly at the district’s five high schools (West, North, South, Engineering Prep and Health Academy). 

Broken down by school, almost 49% of students failing at least one class are juniors at Waukesha South High School. The data also showed that, for example, average GPA at Waukesha North High School dropped about a half a point — from 3.003 to 2.641 — from the first quarter of the 2019-20 school year to the first quarter of 2020-21.

In the first quarter of the 2019-20 school year, 269 high school students failed at least one class. That number ballooned to 982 during the first quarter of the 2020-21 school year, a 265.1% increase.  

“We have been aware of the data and collaborating together as adults in the system to help kids succeed in multiple learning models,” Waukesha School District Superintendent James Sebert said. “We believe that getting back into school five days a week will be helpful in increasing engagement levels and academic performance.” 

The district’s middle and high school students will begin in-person learning, five days a week beginning Jan. 26.

While positive test results are being processed and their number reported quickly, negative test results are taking days in some cases to be analyzed before they are reported to the state. 

Channel3000:

The department said it was between eight and 10 days behind in updating that metric on the dashboard, and as a result it appeared to show a higher positive percentage of tests and a lower number of total tests per day.

The department said this delay is due to the fact data analysts must input each of the hundreds of tests per day manually, and in order to continue accurate and timely contact tracing efforts, they prioritized inputting positive tests.

“Positive tests are always immediately verified and processed, and delays in processing negative tests in our data system does not affect notification of test results,” the department said in a news release. “The only effect this backlog has had is on our percent positivity rate and daily test counts.”

Staff have not verified the approximately 17,000 tests, which includes steps such as matching test results to patients to avoid duplicating numbers and verifying the person who was tested resides in Dane County.

Dane County Madison Public Health issues hundreds of warnings for alleged COVID-19 order violations

Since the beginning of the pandemic, there have been 5,568 cases of COVID-19 in Dane County, including 41 new cases reported Wednesday and 40 documented deaths. Statewide there have been 77,129 cases and 1,142 deaths.

SSM Health, which owns St. Mary’s Hospital, was sent warning letters on Aug. 7, 13 and 19 for alleged face covering, cleaning and social distancing violations at clinics in Madison, including its cancer care center on John Q. Hammons Drive, according to Public Health.

In a statement, SSM Health outlined the precautions it’s been taking at its facilities and said it used the warnings from Public Health “as another opportunity to talk with our employees and remind them of our policies.”

The village of Mount Horeb Recreation Department was sent a warning letter on Aug. 10 for reportedly not abiding by social distancing guidelines during a sports program, according to the Public Health records. Village officials did not respond to requests for comment.

One school and three parishes within the Madison Catholic Diocese saw complaints. Diocese spokesman Brent King said a complaint about a mass gathering at St. Dennis School was likely related to a meet-and-greet picnic for which the school had received Public Health’s approval.

Public health received mask-related complaints about Blessed Sacrament and St. Maria Goretti in Madison and St. Mary of Pine Bluff in Cross Plains.

Two public school districts also show up on the health department’s list, including Marshall, for alleged violations of the mask and mass gatherings rules.

Marshall district administrator Dan Grady said the district hasn’t received the letter sent Aug. 27 and wasn’t sure what it could pertain to.

He said the cross-country team began practicing Aug. 17, staff gathered Aug. 24 and teachers have been meeting with parents of some students, but all such activities have been carried out in compliance with the county rules and no one has come to him with concerns directly.

While positive test results are being processed and their number reported quickly, negative test results are taking days in some cases to be analyzed before they are reported to the state.

The department said it was between eight and 10 days behind in updating that metric on the dashboard, and as a result it appeared to show a higher positive percentage of tests and a lower number of total tests per day.

The department said this delay is due to the fact data analysts must input each of the hundreds of tests per day manually, and in order to continue accurate and timely contact tracing efforts, they prioritized inputting positive tests.

“Positive tests are always immediately verified and processed, and delays in processing negative tests in our data system does not affect notification of test results,” the department said in a news release. “The only effect this backlog has had is on our percent positivity rate and daily test counts.”

Staff have not verified the approximately 17,000 tests, which includes steps such as matching test results to patients to avoid duplicating numbers and verifying the person who was tested resides in Dane County.

Records released by the Madison Metropolitan School District show feedback from staff and community members included plenty of praise and criticism for the two finalists for the district’s superintendent position this summer.

Both Carlton Jenkins and Carol Kelley received positive feedback from many who filled out the forms, which asked respondents to answer two questions for each: strengths and areas of growth.

“I was not expecting much from a candidate that would be applying at this point in the year — but I really do feel as if Madison has found our next superintendent,” one person wrote about Jenkins.

That respondent was correct, as Jenkins, at the time the superintendent of Robbinsdale Area Schools in Minnesota, was ultimately chosen and began Aug. 4. Kelley remains the superintendent of the Oak Park Elementary School District 97 outside Chicago.

An open records lawsuit filed anonymously against the Madison Metropolitan School District last fall was settled in May after the district released the records sought.

A “John Doe” filed the lawsuit against the district last November represented by attorney Tom Kamenick, the president and founder of the Wisconsin Transparency Project.

“My client and I are glad the District finally turned them over, but hope the District abides by its legal responsibilities promptly in the future,” Kamenick wrote in an email Friday.

The district paid for $11,607.45 in legal fees as part of the settlement, but did not admit any wrongdoing.

District spokesman Tim LeMonds wrote in an email last week the district would have no comment on the outcome.

The records sought mostly related to “weekly updates” from the superintendent to School Board members, with the anonymous requester seeking any and all records presented in such meetings. Doe had also filed requests for curriculum plans, school improvement plans and the annual seclusion and restraint report, among other topics.

Madison’s daily newspaper reports juvenile car thefts have increased threefold-plus in three years, from 53 in 2016 to 185 last year. Car thefts this year are on pace to blow well past that, projecting to 227!

The State Journal’s poster child is one Treveon D. Thurman. Now age 18, Thurman’s record of home invasions and 11 car thefts is impressive. We count 29 criminal charges listed on the State circuit court access site! All since last June! The only reason we know about them is because they’re now in adult court. Juvenile records are confidential, a big secret. Which is part of the problem. We learned of:

Madison School Officials Consider Controversial Student Newspaper Policies



Leila Fletcher, Kadjata Bah, and Leilani McNeal:

Madison school officials will consider hiring an Ohio-based company known for policies that some say hinder the free speech rights of student journalists.

Two school board members and Interim Superintendent Jane Belmore met last month with representatives of Ohio-based NEOLA. NEOLA is a policy-writing firm often hired by school districts to write and implement policies for local boards and local administrators. 

NEOLA policies were scrutinized recently in Wisconsin during a controversial case in Oshkosh. In that case a student reporter was prevented from publishing a story about abrupt staff changes at Oshkosh North High School.

The Milwaukee Journal-Sentinel reported that Brock Doemel, a senior at Oshkosh North, eventually filed open records requests to learn more about an absent school staff member and to learn more about why the student-written story was removed from the school’s newspaper.

But policies written by NEOLA refer to student newspapers as “nonpublic forums” and therefore controlled by school district administrators. In the Oshkosh case, policies written by NEOLA were cited as reasons for denying open records requests, requiring student journalists to pay for public records, and asking student journalists to share their reporter’s notes, according the Milwaukee Journal Sentinel. 

“The rule is that in what should be an open forum, the students have the right to publish unfettered and then they deal with the backlash that comes or the kudos that come,” said Vince Filak, a journalism professor at the University of Wisconsin—Oshkosh who criticized NEOLA media policies.

Oshkosh students contacted the Student Press Law Center seeking advice in the case. Mike Hiestand, senior legal counsel at the center, called NEOLA a “policy mill.” He said NEOLA’s “student media policies, in particular, has been something we’ve been battling here at the Student Press Law Center for 15-20 years.”

MMSD spokesperson Tim LeMonds spoke to The Capital Times and confirmed the district is “strongly considering” a partnership with NEOLA. The company’s website shows NEOLA offers services on bylaws and policies, administrative guidelines and procedures, and a district policy website.




Madison’s long term, disastrous reading results: middle school governance edition

In at least two cases, principals left under a cloud.

In 2017, district officials decided not to pursue legal action against former Black Hawk Middle School Principal Kenya Walker, who abandoned her position and oversaw more than $10,000 in spending on the school’s credit card that could not be accounted for. In 2018, Sherman Middle School Principal Kristin Foreman decided to leave after a teacher alleged in a blog post that the school was “in crisis” due to deteriorating student behavior and disrespect for staff.

Tense hallways

Former Jefferson math teacher Mauricio Escobedo said Kurth had “lost control of the school” and described an environment there in which he felt threatened and had “all kinds of racial epithets and insults hurled at me” by students.

According to confidential student records obtained by WISC-TV (Ch. 3), the student in the Dec. 3 incident had been involved in 25 disciplinary incidents this school year prior to his suspension in the BB gun case.

Escobedo was fired on Dec. 20, he said, after pointing out to school leaders that the student who fired the BB gun had previously threatened to “shoot up the school.” Officially, he was let go for failing to earn a state teaching license, he said.

Kurth did not respond to email and Facebook messages seeking comment. Escobedo is one of five teachers who have left Jefferson during the current school year.

While declining to comment on specific employees, district spokesman Tim LeMonds said one of the teachers left for personal family reasons, two for another job in the district, one for “dissatisfaction” with her job and one for not meeting state licensing requirements.

Escobedo, who said he has more than 20 years of teaching experience, said he was properly licensed. But Department of Public Instruction spokesman Benson Gardner said that unless Escobedo “has used another name, he has never held a license to work in a school in Wisconsin.”

Just Wednesday afternoon (01-15-2020) a Jefferson middle school student hospitalized with a concussion after being punched by a classmate. The victim told police he had been bullied for some time by the boy who hit him.

A school staff member said the victim fell to the floor after the initial blow, and was then punched a couple of more times. The employee said the suspect was screaming and knocking over chairs.

Mauricio Escobedo told Blaska’s Policy Werkes:

“I was fired and ushered out the back door because I would not allow Tequila Kurth to cover up her dangerous lack of sound disciplinary policies. On Wednesday, yet another child was nearly killed at Jefferson. YOU helped to divulge the fact [earlier this week] that the Jefferson Administration was no longer in control of the school to a wider audience than I could ever reach.  For that, I thank you.

And now that Tequila Kurth is gone, the job is remains unfinished. …

The idea that race should be considered before meting out disciplinary consequences (or disciplinary data) is inimical to the foundational principle that Justice is blind.  This aberration of America’s justice System must be changed inside of the MMSD from which it was removed by verbal artifice and deception.”

Because of the leadership change, the parent/citizen meeting is rescheduled for 6 p.m. February 6 at the school.

2020 Madison School District Referendum Climate: city tax and spending increases

It was what we thought it was. Madison is 10 to 1 opposed to the city’s $40 wheel tax, judging from the 2,000 pages [CORRECTED] of e-mails that flooded city hall from 250 individuals. Kudos to Chris Rickert of the WI State Journal for filing the open records request to get that info. Many of the supporting messages came from insiders like the public employees union.

Texas Education AGency (DPI) investigative report cites (open Meetings) misconduct, recommends replacement of HISD board

Texas Education Agency officials have recommended that a state-appointed governing team replace Houston ISD’s locally elected school board after a six-month investigation found several instances of alleged misconduct by some trustees, including violations of the Texas Open Meetings Act, inappropriate influencing of vendor contracts and making false statements to investigators.

The recommendation and findings, issued by TEA Special Investigations Unit Director Jason Hewitt, will not become final until HISD officials have had an opportunity to respond. Texas Education Commissioner Mike Morath, who leads the agency, ultimately will decide whether to oust HISD’s school board. HISD officials have until Aug. 15 to respond, and Morath likely would issue a final decision in the following weeks.

In his recommendation, Hewitt wrote that HISD trustees should be replaced by a state-appointed board due to their “demonstrated inability to appropriately govern, inability to operate within the scope of their authority, circumventing the authority of the superintendent, and inability to ensure proper contract procurement laws are followed.”

The Chronicle reviewed a copy of the report Wednesday. It is not a public document.

Questions have been raised regarding the taxpayer supported Madison School Board’s compliance with open records and meeting laws.

Through interviews and a review of text messages, state investigators determined the five trustees — Board President Diana Dávila, Holly Maria Flynn Vilaseca, Sergio Lira, Elizabeth Santos and Anne Sung — secretly met with former HISD superintendent Abelardo Saavedra in two separate groups to coordinate ousting Lathan and installing him as interim superintendent. The meetings took place at a Houston restaurant on the same day in October 2018, the report said. Investigators determined that arrangement constituted a “walking quorum,” in violation of state law that requires trustees to conduct district business in public.

Three days later, the five trustees voted to replace Lathan with Saavedra, offering no advance warning to the public or the other four board members about the move. Trustees reinstated Lathan within a week of the vote following intense public backlash. Lathan remains the district’s indefinite leader.

TEA officials interviewed trustees as part of their investigation, ultimately determining that Dávila and Lira falsely claimed in interviews with investigators that they only met one-on-one with Saavedra. In separate interviews, Saavedra and Flynn Vilaseca placed Dávila and Lira at the restaurant meetings, the report states.

In an interview Wednesday, Dávila said she provided her best recollection of meeting Saavedra to TEA investigators, and denied that she attempted to mislead state officials.




Mckenna Kohlenberg: Why transparency is needed in Madison’s superintendent hiring process, and how to do it



Mckenna Kohlenberg:

My concern stems from recent Board actions that I find concerning enough to warrant this stern message. As local press has noted (here too), the Board’s recent activities suggest a troublesome pattern of skirting, if not outright violating, open meetings and public records laws.

Wisconsin law requires school boards, like other local public bodies, to: a) hold their meetings publicly, hold them in reasonably accessible places, and open them to all citizens; b) have a quorum of members (usually a majority or more) before taking official actions; and c) precede each meeting with public notice, which includes to news outlets that have filed a written request for such notice.

There are narrow exemptions to the state’s open meetings laws. For example, if a school board is to vote on a motion related to considering an employee’s employment, they may be exempt and may move to convene in a closed session instead. Motions to convene in closed session can be adopted only if the body’s authority announces to those in attendance the nature of the business to be considered at such closed session (i.e. the reason the meeting should be exempt from the open meetings law); further, this information, in addition to the vote of each member of the body, must be recorded in the meeting’s records.

Two recent official actions by the Board leave me particularly wary. First, the hiring of an interim superintendent. Following Dr. Cheatham’s resignation announcement to the Board during a closed session meeting on May 6, the Board held five additional closed session meetings at which the hiring of her replacement was on the agenda.

Only after The Cap Times reported that the Board was seriously considering Nancy Hanks for the interim position did the Board hold two open “workshop” sessions, though no votes were officially taken during these sessions. And when local reporters submitted multiple open records requests related to the Board’s hiring process, including for its list of top choices and its list of all possible choices, MMSD legal counsel stated that no such records existed.

Further, in response to the reporters’ additional open records request for meeting minutes from five of the Board’s closed sessions spanning May 30 to June 17, the Board’s secretary stated that the minutes hadn’t been transcribed yet.

Second, and similarly unsettling, was the Board’s official action on July 22 — a vote — to fill the seat left vacant by Mary Burke with Savion Castro. The vote occurred during an open session workshop during which no public comment was permitted. The open session workshop immediately followed a closed session meeting (the posted agenda for the closed meeting stated its purpose was to address a teacher discipline matter).

I’ve heard local education experts, attorneys, and parents call the open workshop “choreographed” and “a performance.”

Did the Board really narrow the pool of applicants from 29 to 1 — unanimously — in a matter of 75 minutes? Or was the decision made ahead of time, during closed session meetings for which no records exist — or at least for which no records are publicly accessible, in violation of the closed session requirement that votes be kept as part of meeting records? Alternatively, and perhaps even more troublesome, was the decision the result of conversations tantamount to walking quorums?

So why hold open sessions at all? What purpose can they possibly serve you in making decisions, Board, if they’re not actually a forum for decision-making?

Thus, I actively participated when MMSD crafted the Behavior Education Plan (BEP). Indeed, I was the person who suggested that it should carry that name instead of simply MMSD’s Discipline policy, because moving away from zero tolerance also requires MMSD to actively engage in teaching children with challenging behaviors how to behave properly. When the BEP was adopted, I advised the school board that in order to succeed, it would need: 1) adequate training for staff; 2) adequate staff support; and 3) and an ombudsman program to assist students and their parents caught up in the disciplinary process. Unfortunately, to date MMSD has not provided these three critical elements of support, which is why the implementation of the BEP continues to be challenging. I was heartened to see the recommendation for an ombudsman program from the Black Excellence Coalition. Improving the BEPby implementing these recommendations is another issue that I bring special expertise if chosen to fill the empty seat on the board.

Systems change requires analyzing data to quantify the problems I encounter while representing my clients. My data analysis reveals that MMSD has failed to make significant improvements in eliminating the racial disparities our students of color and those with disabilities experience academically, in discipline, and from seclusion and restraint. To eliminate these disparities, MMSD must establish achievable short and long-term goals to improve graduation rates, academic performance and reduce negative disciplinary encounters. It must analyze the data district-wide and on a school-by-school basis in order to learn how to replicate school building success throughout the district and to hold those accountable who are unable or unwilling to make improvements in these critical areas.

Finally, my experience as Chair of the Goose Lake Watershed District has made me fully aware of Open Records and Open Meetings laws, Robert’s Rules of Order and the importance of public input to governmental bodies. This experience will serve me well if I am chosen to serve on the MMSD school board.

Wisconsin appeals court: Officials have to provide requested electronic records

Wisconsin public officials can’t charge exorbitant fees for hard copies of records that can be easily and cheaply produced in more user-friendly electronic form, a state appeals court ruled Wednesday.

“The ruling rejects the excuses conjured up by the custodians in this case to deny access to records in electronic form and clearly establishes that electronic records contain additional information beyond what is provided with printed paper copies,” reads a statement from Bill Lueders, president of the Wisconsin Freedom of Information Council and editor of The Progressive.

The decision from the 2nd District Court of Appeals hands Lueders a victory in a lawsuit he filed in 2016 against state Rep. Scott Krug, R-Nekoosa, who responded to an open records request for constituent contacts by producing 1,500 paper copies of emails and charging a per-page fee.




Commentary on madison high school “resource officers”

Under a newly proposed contract between the city and the Madison Metropolitan School District, MMSD has the ability to move away from having an officer in each of the city’s four high schools starting in the 2020-21 school year.

Under the new language in the contract, MMSD would have until Sept. 15 to tell the city if it would like to reduce the number of SROs assigned to Madison schools from four to three. The district would have to select which school should have a reduction. The reduction would then take place the following school year.

The new contract language follows a negotiation strategy the Madison School Board broadly supported last month to move towards removing an SRO from at least one of Madison’s high schools.

The new contract will be discussed at the board’s June 10 meeting and likely be up for a vote later in the month. The contract would run until June 2022.

“The Board is considering a proposal from the City that is based upon prior negotiations,” School Board President Gloria Reyes said in an email Friday afternoon. “It would not be appropriate to comment at this time before the Board has fully considered the proposal.”

In December, the Madison School Board approved an amended contract to keep police officers in the high schools after the current contract expires June 30. The added language would have given school officials the ability to remove an officer from a school if they found cause. Madison Police Chief Mike Koval and the city had argued that the added language was illegal, because personnel decisions on officers are under the authority of the police chief.

Logan Wroge:

The proposal follows months of negotiations between the Madison School District and Madison Police Department after a previously proposed contract, which passed the board in December, included an amendment police called a nonstarter.

“I am relieved and grateful that the pleas of parents, students, teachers and staff have been acknowledged, and we can continue to demonstrate that the SROs are a valuable, complementary piece in making our schools safer,” Police Chief Mike Koval said in a statement.

But Koval expressed opposition to the option to drop one officer.

He used a metaphor about a road trip with four children in the car but seat belts for only three, resulting in one child riding without a seat belt and risking injury.

“I love all my kids equally, and I don’t want to have to make a choice as to which kid should be less protected against potential harm(s),” Koval said.

He also questioned how police response time to an incident at a high school without an SRO would be affected, and called choosing what high school would not have an officer “problematic.”

“I have never been silent when I object to things that could impact public safety, and I am against the clause that would provide the district the option of reducing our presence in all of the four high schools,” Koval said.

He acknowledged, though, that the decision to continue the contract is up to elected school and city representatives.

One of those lucky schools — more particularly, their students, parents, and faculty — will be freed of those troublesome school resource officers under a contract the school board is proposing with the Madison Police Department.

Madison School Board members expressed “broad support” for at least one of Madison’s four high schools to go without a police officer stationed at the school as part of a new contract between the city and district, according to meeting minutes obtained by the Cap Times in an open records request.

In a closed session meeting on May 6, the Madison School Board discussed its negotiation strategies with the city over the renewal of a contract that has a school resource officer based at East, West, La Follette and Memorial high schools.

“There was broad support for working towards at least one school with no ERO/SRO,” Barbara Osborn, the recording secretary, wrote in the meeting minutes, which the Cap Times obtained Thursday.

Mark Seidenberg, a UW-Madison professor and cognitive neuroscientist, has spent decades researching the way humans acquire language. He is blunt about Wisconsin’s schools’ ability to teach children to read: “If you want your kid to learn to read you can’t assume that the school’s going to take care of it. You have to take care of it outside of the school, if there’s someone in the home who can do it or if you have enough money to pay for a tutor or learning center.”

Theresa Morateck, literacy coordinator for the district, says the word “balanced” is one that’s been wrestled with for many years in the reading world.

Wisconsin Watch:

Wisconsin’s largest newspaper and a small Madison paper produced mostly by teens are among the honorees of the 2019 Openness Awards, or Opees, bestowed annually by the Wisconsin Freedom of Information Council, along with awards to a Wausau-based citizens environmental group and a state senator who is seeking to end his colleagues’ ability to destroy records at will.

Meanwhile, the Opees recognized both Racine Alderwoman Sandra Weidner and the city of Racine, for being on opposite sides of the same issue. Weidner was honored for blowing the whistle on her city’s extraordinary effort to suppress public records, for which it received negative recognition from the Council in the form of another award.

Madison Teacher who said n-word says she was correcting student’s use of another slur

The teacher and the State Journal have both asked for the district’s report of its investigation of the event, but the district has refused to release it, citing student privacy. The state open records law permits the district to black out information that would identify students.

Emails that were sent to Hamilton staff regarding the teacher — and released to the State Journal under the state’s public records law — refer to her initial suspension, recount the event and otherwise support the teacher’s version of what happened on Oct. 31 and in the days after. Several, along with two letters in her personnel file, also laud the teacher’s work and interaction with students.

The teacher’s personnel file, also accessed through a public records request, includes no prior incidents of disciplinary action against her. She said she had never before been subject to such action.

“I’ve never even been called to the principal’s office and said, like, ‘That lesson plan wasn’t a great idea’ or ‘You probably shouldn’t have done that,’” she said.

Curiously, this document is NOT shared as part of the Madison School Board public documents. Chan Stroman obtained the April 4, 2019 70 page package via an open records request (!).

The April 4, 2019 document contains a number of interesting links and shares, including a summary of Governor Ever’s (Former long time Wisconsin DPI leader) proposed budget. I found no mention of DPI’s elementary reading teacher mulligan practice, yet noted this on page 16:

Teacher Shortage and Teacher Licensure Provisions
• Authorizes school districts to rehire a retired annuitant teacher if:

– at least 30 days have passed since the teacher left employment with a district;

– at the time of retirement, the teacher does not have an agreement with any school district to return to employment; and

– upon returning to work the teacher elects to not become a participating employee and continue receiving their annuity.

• Repeals the alternative education preparation licensure pathway through which teachers can become licensed without in-classroom teaching time.

• Provides $571,200 in 2019-20 and $652,900 in fiscal year 2020-21 to help recruit and retain high quality master educator and national board-certified teachers in high poverty schools. (This funding would triple the size of continuing grants to qualified teachers in high poverty urban schools and double the size of the continuing grant for teachers at high poverty schools elsewhere in (i.e., throughout) the state, and would incentivize an estimated 130 or more highly qualified teachers to continue teaching in schools with high levels of poverty.)

Resisting taxpayer oversight and the open records law at the Wisconsin Department of Public Instruction

A WILL spokesman said on Tuesday that the organization had received the documents and its attorneys are currently reviewing them.

“It is deeply disappointing it has taken DPI months to comply with our request,” said WILL deputy counsel Tom Kamenick in a statement. “The public has a right to know how DPI is spending their money and whether any laws are being violated. Hopefully next time, DPI will do a better job at promptly responding to open records requests to avoid litigation.”

In response to the lawsuit and the judge’s ruling, DPI spokesman Tom McCarthy said earlier this month that the records WILL had requested required redaction and staff time to prepare. McCarthy said the agency was following the open records law and would continue to do so.

According to the lawsuit, WILL first requested three sets of ESSA-related records in August 2018, then sent a follow-up email the following month. A DPI employee said the request was in progress on Sept. 21, 2018.

Kamenick followed up again on Nov. 12, and the request was partially fulfilled the following day. Portions of the request were denied for being “insufficiently specific” and “unreasonably burdensome,” and WILL send a narrowed request the following month, which DPI acknowledged on Dec. 13.

Yet: “The data clearly indicate that being able to read is not a requirement for graduation at (Madison) East, especially if you are black or Hispanic”.




UW rejects application for independent Madison charter school

According to emails released to the State Journal under the state’s open records law, Superintendent Jennifer Cheatham on Sept. 10 asked her chief of staff, Ricardo Jara, and other front-office officials whether Arbor was “worth trying to stop? Or change somehow? If so, how?”

Cheatham expressed the district’s opposition to the school in a letter to Cross on Sept. 24 that points to alleged deficiencies in Arbor’s application, and accuses OEO of not sharing information with the district about the school.

“I am writing you to formally request that the OEO immediately terminate contract negotiations with (Arbor Community School) or, at the very least, require that this school not be located in the City of Madison,” she wrote.

That same day, former Madison School Board member Ed Hughes took Cheatham’s letter to a board of directors meeting of the Goodman Community Center, where Arbor was then trying to secure space.

Children who are not proficient readers by fourth grade are four times more likely to drop out of school. Additionally, two-thirds of them will end up in prison or on welfare.

Though these dismal trajectories are well known, Madison School District’s reading scores for minority students remain unconscionably low and flat. According to the most recent data from 2017-18, fewer than 9 percent of black and fewer than 20 percent of Hispanic fourth graders were reading proficiently. Year after year, we fail these students in the most basic of our responsibilities to them: teaching them how to read.

Much is known about the process of learning to read, but a huge gap is between that knowledge and what is practiced in our schools. The Madison School District needs a science-based literacy curriculum overseen by licensed reading professionals who understand the cognitive processes that underlie learning how to read.

In March 2016, Cheatham said that it was her intent to make OEO “obsolete — that our schools will be serving students so well that there isn’t a need.”

Since then, the district has tried to keep tabs on any new charter proposals for Madison, going so far as to send former School Board member Ed Hughes to a September meeting of the Goodman Community Center board of directors to express the district’s opposition to another proposed charter school, Arbor Community School, which was looking to partner with the Goodman center.

Hughes gave the board a letter from Cheatham to UW System President Ray Cross that expressed the district’s dismay at allegedly being kept out of the loop on Arbor’s plans, pointed to alleged deficiencies in Arbor’s charter proposal, and asked that Arbor either be rejected or at least kept out of Madison.

Hughes also told the board that as a Goodman donor, he did not think other donors would look kindly on a Goodman partnership with Arbor.

Becky Steinhoff, Goodman executive director, later told the Wisconsin State Journal that Goodman was “experiencing a period of enormous change,” including the recent opening of a new building, and chose not to work with Arbor.

“I understand the climate and the polarizing topic of charters” in Madison, McCabe said, but he wasn’t concerned the district would attempt to thwart Milestone and he said it would “be a dream come true” if Milestone were one day folded into the district.

He said Community—Learning—Design has an application due to the state Feb. 22 for a federal planning grant.

2005: When all third graders read at grade level or beyond by the end of the year, the achievement gap will be closed…and not before:

On November 7, Superintendent Art Rainwater made his annual report to the Board of Education on progress toward meeting the district’s student achievement goal in reading. As he did last fall, the superintendent made some interesting claims about the district’s success in closing the academic achievement gap “based on race”.

According to Mr. Rainwater, the place to look for evidence of a closing achievement gap is the comparison of the percentage of African American third graders who score at the lowest level of performance on statewide tests and the percentage of other racial groups scoring at that level. He says that, after accounting for income differences, there is no gap associated with race at the lowest level of achievement in reading. He made the same claim last year, telling the Wisconsin State Journal on September 24, 2004, “for those kids for whom an ability to read would prevent them from being successful, we’ve reduced that percentage very substantially, and basically, for all practical purposes, closed the gap”. Last Monday, he stated that the gap between percentages scoring at the lowest level “is the original gap” that the board set out to close.

Unfortunately, that is not the achievement gap that the board aimed to close.

2006: “They’re all Rich White Kids, and they’ll do just fine, NOT!”

2013: What will be different, this time?

City of Madison Initiative Demonstrates Lack of Transparency: MOST fails to provide public with information and access to meetings and records

In the five years since the group’s inception, MOST has not given the public notice of its meetings times, dates, locations, and agendas, allowing little to no oversight.

According to an internal document from a 2014 meeting, MOST formalized an “Action Team” that began meeting twice a month starting July 2013. But, the group did not make meeting notices publicly available. The same handout said the City’s Education Committee adopted MOST as one of its “key initiatives” in November 2013.

According to MOST meeting notes sent only to MOST participants by the former coordinator, Jennifer Lord, on Nov. 3, 2013, concerns about the committee’s need to comply with open records laws were discussed. In response, city employees cited a desire to want to remain an “independent coalition.”

But, a desire to remain an “independent coalition” is not sufficient to grant MOST immunity from open meetings laws. Nor does this desire grant MOST immunity from open records laws.

Tom Kamenick is a deputy counsel and litigation manager at the Wisconsin Institute for Law & Liberty (WILL), a non-profit organization that advocates for open government and civil liberties. WILL successfully litigated the 2017 Supreme Court case.

Kamenick said in an email to Simpson Street Free Press that after briefly reviewing MOST, he was unable to definitively determine if the group qualifies as a public body. But, he also said the Attorney General has stipulated open records and meetings laws should be “applied expansively.”

According to Kamenick, there is a five-factor test for determining if groups must comply with open records and open meetings laws; whether the group is funded government money, whether the group serves a government function, whether the group appears to be a government entity, whether the group is subject to some level of government control, and whether a governmental body can access to group’s records.

MOST is a publically funded city initiative staffed by government officials on the city payroll.

State Attorney General Brad Schimel is calling on local and state government agencies to more accurately reflect the actual costs of fulfilling open records requests, saying they cannot make a profit when charging requesters for print or digital documents.

The fees suggested by Schimel for printed pages are 1.35 cents for black and white and 6.32 cents for color pages, down from the 15 to 25 cents per page open records advocate Bill Lueders said is a common charge for requested records.

“It reminds custodians that the public is entitled to these records and they should be provided at cost,” Lueders said.




Records runaround: In Wisconsin, long delays are common for those requesting documents

Last month the Wisconsin Freedom of Information Council did something unexpected. Members voted to award one of its Openness Awards — or Opees — to Gov. Scott Walker.

That’s the same guy who has fought the disclosure of political donors, whose administration directed cabinet secretaries to avoid creating publicly accessible records while conducting official business and two years ago tried to gut the state’s open records law.

But in 2016, Walker issued directives ordering state agencies to step up their responses to public records requests. As a result, said FOIC president Bill Lueders, state agencies have responded to records requests more promptly.




Civics: City apologizes, settles public records lawsuit with Isthmus

Madison assistant city attorney Roger Allen has apologized for the police department taking more than a year to fulfill an open records request from Isthmus, saying the request accidentally “fell through the cracks.” He says the city is working to make sure that delays like this won’t happen again.

“This [delay] was an outlier and, quite frankly, was embarrassing both to the records section in MPD and to my office,” Allen tells Isthmus.

The request for police records was made in December 2016 but not filled until after Isthmus and the Wisconsin Institute for Law and Liberty filed a lawsuit on Feb. 1, 2018. The city then turned over the records, which resulted in the March 8 article “Shielded.” The piece examined how the police department handled an internal investigation of Officer Stephen Heimsness.

Many Wisconsin school districts fail test on open records

The ugly: Of the 20 largest school districts, eight (Eau Claire, Elmbrook, Janesville, Kenosha, Madison, Sheboygan, Wausau and Wauwatosa) would not fulfill our requests without payment. The fees ranged from $15 to, in Madison’s case, more than $1,000.

According to the Madison School District’s attorney, the district does not have a system for tracking open records requests, hence its extremely high fee in this case. While records custodians are allowed to charge for locating records, school districts that need so much time to locate records are apparently not doing a good job of tracking requests. It should not be so hard to find out how well any government entity complies with the law.

The takeaway: Walker’s executive order led to measurable improvements in the response time of state agencies. School districts and other local governments can use the same processes, including better training and tracking systems, to achieve similar improvements.

Appleton’s budget is $201,399,239 for 15,169 students, about $13,277 per student.

Green Bay plans to spend roughly $272,000,000 during the 2017-2018 school year for 21,000 students, about $12,952 per student.

Madison spends far more, nearly $20,000 per student.




Reviewing Madison School District Financial Practices

Fralin said the financial review stemmed from a district initiative in November or December that started as a general attempt to get “better clarity on our financial protocols at the school level” but was soon narrowed to just Black Hawk and the district’s central office because officials “wanted to go deeper at Black Hawk.”

Fralin declined to identify specific red flags at Black Hawk that prompted the deeper review, only noting, “We had some questions about how some of the financial vehicles were being used.”

Fralin said the review should be finished “very shortly” and promised to report the results to Black Hawk parents and staff soon after. The Wisconsin State Journal has also requested the results of the review under the state’s open records law.

Fralin also confirmed that after hearing the parents’ concerns about money missing from the T-shirt fund, he authorized sending Black Hawk $1,000 from the district “since (the T-shirt fund) is still part of the review and we don’t want students to go without” in the meantime.

Madison Teachers Union Seeks Names Of Members Who Voted In Recent Recertification Election

The union Madison Teachers Inc. on Nov. 10 sought documents under the open records law that would show who had voted so far in the election that ran from Nov. 4 to Nov. 24.

On June 16, the commission’s chairman, James Scott, denied the request, saying the ballots were in the hands of a contractor who runs the elections for the commission and arguing the interests of “avoiding the potential for voter coercion while balloting is ongoing outweigh the interests favoring disclosure.” Scott also contended releasing the records would undermine the secrecy of the ballot because non-votes are considered “no” votes.

Madison loath to admit that vouchers have an ‘educational purpose’

From the way some of the more enthusiastic public school supporters talk, you’d think alternative forms of public education, such as voucher schools, were making millions on the backs of ill-treated kindergartners.
The vast majority of Wisconsin’s voucher schools are not-for-profit, though, and it seems unlikely that any of them is, say, forcing 8-year-olds into sweatshops or flogging them for chewing gum in class.

But you’d never know that from the Madison School District’s denial of an open records request from a pro-voucher organization on grounds that the request wasn’t education-related.

School Choice Wisconsin president Jim Bender says the “vast majority” of about 30 larger districts complied with the organization’s request for student directory data. It is considering plans to use the information to send out postcards reminding parents of the enrollment period for the statewide voucher program.




American Association of Educators Contacts Madison Teachers

Teachers in Madison recently received an email inviting them to join AAE, and for a very inexpensive fee. For only $15 per month, they say, one can be eligible to apply for a scholarship, receive a publication, and information on professional development. Plus, they claim none of their income will be spent on political action, and a member receives protection via liability insurance. The facts are, that none of what AAE offers is needed.

  • MTI negotiates a Collective Bargaining Agreement, and enforces the Collective Bargaining Agreement via grievance and arbitration.
  • MTI represents teachers who are challenged by the District.
  • The District is responsible by Statute to provide liability insurance and MTI members receive additional liability coverage provided through membership as a result of MTI’s
    affiliation with WEAC & NEA.
  • AAE is anti-union. They even tried to stop the Kenosha
    School Board from ratifying the new recently agreed-upon Contracts.
According to the Massachusetts Teachers Association, “The American Association of Educators, is a group backed by some of the deepest pockets in the anti-public education movement (think Koch brothers). The AAE is partnering with the National Right to Work Committee to encourage educators to give up their (Union) membership and join an organization that has affiliates covering just six states. Right-wing foundations provide nearly all of the money to (operate) the AAE Foundation.”
AAE was able to write to each Madison teacher because they obtained teachers’ email addresses via an open records request from the District.




Why aren’t voucher schools subject to open records law?

Last week, Sarah Karon of the American Civil Liberties Union argued in a Cap Times column that voucher schools should be held to the same standard of public scrutiny to which public schools are currently subjected.
She noted that many private schools that participate in the Milwaukee School Choice Program receive the great majority of their money from taxpayer-financed vouchers.
Open records advocates, such as the Wisconsin Newspaper Association and the Wisconsin Freedom of Information Council, agree. If voucher schools are receiving taxpayer dollars, then shouldn’t the fourth estate be allowed to shine a light on them?
“We feel that because there’s a significant amount of money from taxpayers and because there is intense public interest in the metrics (for evaluating schools), they should provide a comparable level of transparency that public schools provide,” says Bill Lueders, president of the WFIC.
Among Republicans, there appears to be a divide over just how much accountability taxpayers can demand from vouchers. Whereas the GOP leadership and Gov. Scott Walker are pushing measures that will subject vouchers to the Common Core academic standards and include voucher student test scores in the statewide Student Information System, conservative stalwart Sen. Glenn Grothman, R-West Bend, one of the loudest advocates of voucher schools, believes those measures pervert the entire idea behind school choice.




Voucher schools should be more open

Back in 1990, when Milwaukee launched the nation’s first publicly funded voucher program, participating schools could enroll no more than 49 percent voucher students. These schools were considered private, because the majority of their students paid private tuition.
Fast-forward to 2013.
Now, more than half of Milwaukee’s 110 voucher schools have at least 95 percent of students on publicly funded vouchers. In one-fifth of these schools, every student receives a voucher.
Yet because voucher schools are still classified as “private,” they can — and do — ignore Wisconsin’s open records and meetings laws. It’s a double standard that undermines transparency and shields information from parents and the public.

NCTQ Wins Minnesota Court Battle over Open Records Access to Ed School Curriculum

Yesterday, a court in Minnesota delivered a summary judgment ordering the Minnesota State Colleges and University system to deliver the documents for which we asked in our open records (“sunshine”) request for our Teacher Prep Review.
At the heart of our Teacher Prep Review is a simple idea: the more information that aspiring teachers, district and school leaders, teacher educators and the public at large have about the programs producing classroom-ready teachers, the better all teacher training programs will be.
In our effort to produce the first comprehensive review of U.S. teacher prep, we’ve faced a number of challenges — perhaps the most serious of which has been the argument made by some universities that federal copyright law makes it illegal for public institutions publicly approved to prepare public school teachers to make public documents that describe the training they provide.
We want to make sure that everyone understands what this ruling does and does not mean. The Minnesota State colleges and universities system agreed with us that the syllabi we seek are indeed public record documents. Their case came down to the claim that because the course syllabi are also the intellectual property of professors, they should not have to deliver copies of their syllabi to us.
Minnesota’s open records law, the court ruled, is clear: public institutions must make documents accessible to individuals seeking them — which includes delivering copies to them. Delivering copies of these documents to us in no way, shape or form deprives the professors who created them of their intellectual property rights. NCTQ is conducting a research study, which means that our use of these syllabi falls under the fair use provision of the copyright law. This is the exactly the same provision that enables all researchers, including teacher educators, to make copies of key documents they need to analyze to make advances in our collective knowledge.

The school board is comprised of a superintendent and “such other officers as the legislature shall direct.” The superintendent is appointed by the state legislature in the same manner as members of the Wisconsin Supreme Court. The superintendent can hold office for 4 years.[9] According to the state constitution the board of education may not prevent a non−union teacher from speaking of a bargaining issue at an open meeting, as was ruled in the U.S. Supreme Court case Madison School District v. Wisconsin Employment Commission.[10]

I support the Sunshine review initiative. However, the last paragraph, regarding the Superintendent, is of course incorrect.

This case is not about a direct denial of public access to records, but the issue in the present case directly implicates the accessibility of government records. The greater the fee imposed on a requester of a public record, the less likely the requester will be willing and able to successfully make a record request. Thus, the imposition of fees limits and may even serve to deny access to government records. In interpreting the Public Records Law, we must be cognizant that the legislature’s preference is for “complete public access” and that the imposition of costs, as a practical matter, inhibits access.

Madison Superintendent Dan Nerad to Leave when Contract Expires in 2013

Madison Metropolitan School District Superintendent Dan Nerad announced on Monday that he will retire and not seek a contract extension.
Nerad made the announcement at a press conference on Monday afternoon. Nerad’s contract runs through June 2013 and he said he will remain through then.
He said calling this announcement a “resignation” would be accurate.
Nerad said that decision came to a culmination in the last 10 days and that he has been in the process of deciding on retirement for several months.
He cited his reason for retiring for a variety of factors.He said that controversy over achievement gap was “a factor.”
“I wish I could’ve done more to develop a consensus on how to move forward on issues, including (the) achievement gap,” he said.
Nerad said that a new leader could provide a spark on the achievement gap that he could no longer provide.

This view isn’t universally shared, but Steve Goldberg, executive director of the CUNA Mutual Foundation who has worked closely with the Madison Metropolitan School District, its teachers union and community leaders, says Nerad’s announcement could put him in a position to have a greater influence over acceptance of a plan he recently put forward to close the race-based achievement gap.
With any inkling that Nerad is working to preserve his job removed from the equation, the likely efficacy of his proposals might become a tighter focus of discussion, Goldberg said.
“This might change the way he is perceived,” Goldberg told me. “Since he no longer has ‘an axe to grind,’ he may be viewed as more objective.”

He launched 4-year-old kindergarten, developed a five-year strategic plan, expanded the dual-language immersion and summer school programs, reorganized central office staff, introduced curricular alignment among all schools and restored the district’s AAA bond rating.
Don Severson, president of a conservative watchdog group, said he wasn’t surprised by the announcement given the lack of overwhelming support for Nerad’s leadership.
“You can’t behave as a social worker and run a massive complex organization,” Severson said. “He had to be much more proactive and take some risks, make some decisions, go in some direction where he knows he won’t have unanimity.”

I’m glad Matt DeFour and the Wisconsin State Journal obtained the most recent Superintendent Review via open records. We, as a community have come a long way in just a few short years. The lack of Board oversight was a big issue in mid-2000’s competitive school board races. Former Superintendent Art Rainwater had not been reviewed for some time. These links are well worth reading and considering in light of the recent Superintendent review articles, including Chris Rickert’s latest. Rickert mentions a number of local statistics. However, he fails to mention:

  1. Despite spending nearly $15,000 per student annually, our Reading Results, the District’s job number one, need reform. 60% to 42%: Madison School District’s Reading Recovery Effectiveness Lags “National Average”: Administration seeks to continue its use. This is not a new topic.
  2. The District’s math program has been an issue for some time, as well (Math Forum).
  3. How does Madison compare to the World, or other US cities? We can and should do much better.
  4. What is happening with Madison’s multi-million dollar investment (waste?) in Infinite Campus? Other Districts have been far more successful implementing this important tool.
  5. Are the District’s tax expenditures well managed?

With respect to the current Superintendent Review, the job pays quite well (IRS income distribution data: table 7), so I believe the position should be fully accountable to parents and taxpayers. Matthew DeFour:

In 2014, Madison superintendent Dan Nerad qualifies for a $37,500 payment for six years of service, which like Gorrell’s would be paid into a retirement account. Nerad already receives an annual $10,000 payment into his retirement account, which is separate from his state pension and in addition to a $201,000 yearly salary.

The current rhetoric is quite a change in just 8 years. (Why did things change? A number of citizens care, decided to run for school board – won – and made a difference…) I certainly hope that the Board and community do not revert to past practice where “we know best” – the status quo – prevailed, as the Obama Administration recently asserted in a vital constitutional matter:

Holder made clear that decisions about which citizens the government can kill are the exclusive province of the executive branch, because only the executive branch possess the “expertise and immediate access to information” to make these life-and-death judgments.
Holder argues that “robust oversight” is provided by Congress, but that “oversight” actually amounts to members of the relevant congressional committees being briefed. Press reports suggest this can simply amount to a curt fax to intelligence committees notifying them after the fact that an American has been added to a “kill list.” It also seems like it would be difficult for Congress to provide “robust oversight” of the targeted killing program when intelligence committee members like Sen. Ron Wyden (D-Ore.) are still demanding to see the actual legal memo justifying the policy.

Madison School Board rates Superintendent Nerad barely ‘proficient’;

If Madison Superintendent Dan Nerad’s job performance were judged like a student taking the state achievement test, he would score barely proficient, according to the Madison School Board’s most recent evaluation.
The evaluation, completed last month and released to the State Journal under the state’s Open Records Law, reveals the School Board’s divided view of Nerad’s performance.
School Board President James Howard said he expects the board to vote later this month on whether to extend Nerad’s contract beyond June 2013. The decision has been delayed as Nerad’s achievement gap plan is reviewed by the public, Howard said.
Soon after that plan was proposed last month, Howard said he would support extending Nerad’s contract. Now, Howard says he is uncertain how he’ll vote.
“It’s probably a toss-up,” he said. “There’s a lot of issues on the table in Madison. It’s time to resolve them. All this kicking-the-can-down-the-road stuff has to stop.”
Nerad said he has always welcomed feedback on how he can improve as a leader.

Madison Superintendent Art Rainwater’s recent public announcement that he plans to retire in 2008 presents an opportunity to look back at previous searches as well as the K-12 climate during those events. Fortunately, thanks to Tim Berners-Lee’s World Wide Web, we can quickly lookup information from the recent past.
The Madison School District’s two most recent Superintendent hires were Cheryl Wilhoyte [Clusty] and Art Rainwater [Clusty]. Art came to Madison from Kansas City, a district which, under court order, dramatically increased spending by “throwing money at their schools”, according to Paul Ciotti:

The Madison Superintendent position’s success is subject to a number of factors, including: the 182 page Madison Teachers, Inc. contract, which may become the District’s handbook (Seniority notes and links)…, state and federal laws, hiring practices, teacher content knowledge, the School Board, lobbying and community economic conditions (tax increase environment) among others.
Superintendent Nerad’s reign has certainly been far more open about critical issues such as reading, math and open enrollment than his predecessor (some board members have certainly been active with respect to improvement and accountability). The strings program has also not been under an annual assault, lately. That said, changing anything in a large organization, not to mention a school district spending nearly $15,000 per student is difficult, as Ripon Superintendent Richard Zimman pointed out in 2009.
Would things improve if a new Superintendent enters the scene? Well, in this case, it is useful to take a look at the District’s recent history. In my view, diffused governance in the form of more independent charter schools and perhaps a series of smaller Districts, possibly organized around the high schools might make a difference. I also think the District must focus on just a few things, namely reading/writing, math and science. Change is coming to our agrarian era school model (or, perhaps the Frederick Taylor manufacturing model is more appropriate). Ideally, Madison, given its unparalleled tax and intellectual base should lead the way.
Perhaps we might even see the local Teachers union authorize charters as they are doing in Minneapolis.




Madison School District agrees to release teachers’ sick notes

The Madison School District has agreed to terms for releasing more than 1,000 sick notes submitted by teachers who missed work in February during mass protests over collective bargaining.
The district will remove the teachers’ names and other identifying information from the notes, under an agreement reached Monday with the Wisconsin State Journal, which requested the records under the state’s Open Records Law.
“It’s essentially what we asked for in May,” State Journal Editor John Smalley said Tuesday. “It was never our intention to publish any names or individual situations, but to look at the collective situation of all of these sick notes and how the district as an institution handled it.”
School Board President James Howard said the agreement protects teachers while complying with the newspaper’s needs and a Nov. 21 court ruling ordering the district to turn over the notes. The newspaper sued the district for the records after the district denied requests for them.

Many friends of mine are upset with the legal battle the Wisconsin State Journal waged to obtain the 1,000 sick notes Madison teachers used to get off work during the union protests in February. My own radio host and boss, Kurt Baron, referred to the paper as the “Wisconsin State Urinal” in describing his decision to no longer have the paper as his home page online. Some called into the show and promised to cancel their subscriptions.
Teachers should have a right to individual privacy over their medical records. We shouldn’t know whether John Q. cited herpes or hemorrhoids on his doctor’s note.
I am less sympathetic, however, to the teachers’ right to collective privacy. As long as their names are redacted, the public has the right to know if 273 teachers cited malaria and 345 claimed to suffer from ebola.
Unfortunately the recent ruling will violate individual privacy by allowing the State Journal to see the names of the teachers on the sick notes.




Madison School District ordered to turn over sick notes

A Dane County judge on Monday ordered the Madison School District to turn over more than 1,000 sick notes submitted by teachers who didn’t come to work in February during mass protests over collective bargaining.
Dane County Circuit Judge Juan Colas said the district violated the state’s Open Records Law by issuing a blanket denial to a request for the notes from the Wisconsin State Journal rather than reviewing each note individually.
Under the records law, government agencies must make public the records they maintain in most circumstances.
State Journal editor John Smalley said the court ruling was a victory for open records and government accountability. He said the newspaper was not planning to publish individual teacher names but rather report on the general nature of the sick notes the district received from employees.

A new controversy related to the Madison protests has emerged. This one involves the taxpayer-funded email account of American Federation of Teachers-Wisconsin leader and Department of Workforce Development employee William Franks.
For reasons explained below, the Education Action Group submitted an open records request for communications from Frank’s taxpayer-funded email account that contained specific, strike-related key words.
Upon receipt of the records, EAG discovered that a state attorney allowed Franks to fill the open records request himself. That means he might have been free to turn over the entries he cared to include and delete other entries. Not only that, but the state attorney told Franks that “if you have personal email that contains those specified words in the request, please send copies of those to me, so we can discuss this further.” That sounds like one bureaucrat helping another skirt the law and avoid a potentially embarrassing situation.




Newspaper’s lawsuit seeks sick notes for Madison school teachers during protest

The Madison School District failed to follow state law when it denied the Wisconsin State Journal access to more than 1,000 sick notes submitted by teachers who didn’t show up for work in February, according to a lawsuit filed by the newspaper Thursday.
The lawsuit, filed in Dane County District Court, asks the court to force the district to release the notes under the state’s open records law, which requires government agencies to release public documents in most circumstances.
The lawsuit says the sick notes are public records because the public has a special interest in knowing how governments discipline employees, who are ultimately responsible to the public.
“We can’t know if things were dealt with appropriately if we can’t see the underlying documents on which decisions were made,” said April Rockstead Barker, the newspaper’s lawyer.
Dylan Pauly, a School District lawyer, declined comment until she had a chance to review the lawsuit.




Union’s Ties to Madison Schools’ Work Stoppage Become More Clear

A misdialed union voicemail message, emails obtained through an open records request and official court documents reveal new details about the Madison teachers’ work stoppage [Google Cached Link] that closed the district’s public schools for four days.
The Madison Metropolitan School District called the “sickouts” a “strike” and accused the union of organizing it. The union, Madison Teachers Inc., however, maintained that teachers were calling in sick on their own initiative. New evidence suggests the union’s claim is not true.
The MacIver News Service obtained dozens of emails in response to an open records request filed with the school district.
On Tuesday, February 15th, the day before the four day sick out began, Dan Nerad, Madison Schools Superintendent, sent out a mass email to teachers stating “Throughout the day we have received significant information indicating that staff members will call in ill tomorrow, Thursday and/or Friday to protest the Governor’s actions. While I believe his actions warrant protest, I am asking that this course of action not be taken,”
John Matthews, Madison Teachers Inc. Executive Director, replied to that email with one of his own, “What teachers are doing is based on their own conscience, for education, the children in our schools, for their own families,” he wrote.

Emails Reveal Madison Teachers’ Union Behind the Scenes Strategy

Wednesday, March 9th.
Nerad was floored when he found out Matthews was telling the union MMSD was not willing to meet that past weekend. He said Matthews never confirmed a meeting with them.
Howard Bellman, the arbitrator, responded that he had suggested to Nerad they meet sometime over the weekend. Nerad said he wasn’t available until Tuesday, and Bellman relayed that to the union.
Matthews then sent Nerad an email stating “Dan: I know that you are dealing with your Mother’s illness at this time, and I respect that. However, for MMSD to not be prepared to deal with the issues facing both MMSD and MTI (your employees) today is reprehensible.”
Later that day the Senate passed an amended version of the budget repair bill, and Nerad wondered if he could expect his staff to report to work on Thursday.
Matthews responded the union asked all teachers to go to work in the morning. He also pushed for a contract agreement for MTI’s support staff groups.
“You have to know that our negotiations are at a very serious juncture. We simply must reach an agreement on Friday or the volcano may just erupt. It is not fair to those in the support unites to be treated differently than those in the professional unit. Because AFSCME took an inferior contract is no reason for MTI to do so. This matter is clearly in your hands to resolve, so be fair, creative and decisive. We have no time left to wring our hands. It is very difficult to hold people back from taking further action,” said Matthews.




‘Silent majority’ raps union response to Madison’s Glendale Elementary School report

Fallout continues from the investigation of a Madison elementary school principal, accused of workplace harassment of his staff.
I wrote about the original report following an investigation into complaints against Glendale Elementary Principal Mickey Buhl, which was released as part of an open records report filed by The Capital Times. I also wrote about staff members who were disappointed by the report, which exonerated Buhl, and their response through Madison Teachers Inc.
This week, teachers and a parent came forward, defending Buhl and reacting to MTI claims that Buhl had created a climate of fear at Glendale, located at 1201 Tompkins Drive.
Ben Ketterer, a Glendale teacher for fourth and fifth grade students, wrote that most of his colleagues were more than content with the workplace environment at the school. “There is a multitude of staff (a likely 80-90 percent) who view their working environment positively, or at the very least, not negatively,” Ketterer wrote.

I requested the messages via an open records request out of concerns expressed to me that public communications to this email address were not always making their way to our elected representatives on the Madison Board of Education. Another email address has since been created for direct public communication to the Board of education: board@madison.k12.wi.us
There has been extensive back and forth on the scope of the District’s response along with the time, effort and expense required to comply with this request. I am thankful for the extensive assistance I received with this request.
I finally am appreciative of Attorney Dan Mallin’s fulfillment (a few items remain to be vetted) and response, included below:

As we last discussed, attached are several hundreds of pages of e-mails (with non-MMSD emails shortened for privacy purposes) that:
(1) Are not SPAM / commercial solicitations / organizational messages directed to “school districts” generally
(2) Are not Pupil Records
(3) Are not auto-generated system messages (out of office; undeliverable, etc.)
(4) Are not inquiries from MMSD employees about how to access their work email via the web when the web site changed (which e-mails typically contained their home email address)
(5) Are not technical web-site related inquiries (e.g., this link is broken, etc.)
(6) Are not random employment inquiries / applications from people who didn’t know to contact the Human Resources department and instead used the comments address (e.g., I’m a teacher and will be moving to Madison, what job’s are open?).
(7) Are not geneology-related inquiries about relatives and/or long-lost friends/teachers/etc.
(8) Are not messages that seek basic and routine information that would be handled clerically(e.g., please tell me where I can find this form; how do I get a flyer approved for distribution; what school is ____ address assigned to; when is summer school enrollment, etc.)
Some of the above may have still slipped in, but the goal was to keep copying costs as low as possible. Once all of the e-mails within your original request were read to determine content, it took over 2 hours to isolate the attached messages electronically from the larger pool that also included obvious pupil records, but you’ve been more than patient with this process and you have made reasonable concessions that saved time for the District in other ways, and there will be no additional copying charge assessed.

It would be good public policy to post all communications sent to the District. Such a simple effort may answer many questions and provide a useful look at our K-12 environment.

While grandma flips through photo albums on her sleek iPad, government agencies (and most corporations) process mission-critical transactions on cumbersome web-based front ends that function by tricking mainframes into thinking that they are connected to CRT terminals. These systems are written in computer languages like Assembler and COBOL, and cost a fortune to maintain. I’ve written about California’s legacy systems and the billions of dollars that are wasted on maintaining these. Given the short tenure of government officials, lobbying by entrenched government contractors, and slow pace of change in the enterprise-computing world, I’m not optimistic that much will change – even in the next decade. But there is hope on another front: the Open Government Initiative. This provides entrepreneurs with the data and with the APIs they need to solve problems themselves. They don’t need to wait for the government to modernize its legacy systems; they can simply build their own apps.




Proposed Madison School District Talented & Gifted Plan

Background
Wisconsin Administrative Rule 8.01 (2)(t)2 states that each school district shall establish a plan and designate a person to coordinate the gifted and talented program. The previous Talented and Gifted (TAG) Plan approved by the Madison Metropolitan School District (MMSD) Board was in 1991. 2008-09 highlighted several independent yet related events which served to underscore both the urgency of and District-wide benefit for an updated Plan. Among the events that converged to result in the need to update the Talented and Gifted Plan were:

  • Superintendent Dr. Daniel Nerad was hired in July 2008. Dr. Nerad recognized the need for addressing the issues related to Talented and Gifted programming;
  • The last TAG Plan (1991) approved by the District was found by the DPI to be out of compliance;
  • An increase in open enrollment leaving the District spurred conversation regarding strategies to attract and retain students;
  • Families leaving the District were surveyed to gather information regarding their reasons for leaving MMSD. A desire for improved Talented and Gifted programming was one of several emerging themes; and
  • A new Strategic Plan was developed through extensive community involvement. The Strategic Plan clearly demands a rigorous and challenging education for all students.

Process In response to the events described above, the Superintendent charged the Teaching & Learning TAG Division to develop a process to create an updated Plan. The TAG Division met on a regular basis to define major areas for improvement in alignment with the National Association for Gifted Children standards. A Talented and Gifted Advisory Committee comprised of 30 members was convened in early spring. This group met five times between February and June to provide input and critique the evolving draft. The Superintendent and TAG Coordinator hosted a community input session on March 26. Senior Management, Instructional Council and Principals reviewed drafts and provided input. In order to ensure a timely and high quality Plan, a subcommittee of the Talented and Gifted Advisory Committee was invited to continue to work with TAG staff to complete the Plan during June and July.
There have been significant challenges in the process leading to the development of the enclosed plan. These challenges include communication, changes in leadership and an evolving level of District and community trust in MMSD’s commitment to providing high quality education for all stUdents. Overcoming these challenges is an on-going process, one captured in the language of the plan with respect to continual improvement. Although there are aspects of current MMSD talented and gifted programming that are sound and valued, the need for overall structural improvements and re-vitalization is recognized byal!.
In addition to the TAG Division staff, we sincerely appreciate the members of the TAG Advisory Committee for their extraordinary gift of time and dedication toward creating this plan. Special recognition goes to TAG Advisory Subcommittee members Kerry Berns, Bettine Lipman, Laurie Frost, Chris Gomez Schmidt and Carole Trone for their continuing support and input through the final draft of this plan.
MMSD Strategic Planning The enclosed TAG Plan aligns, supports and strengthens important aspects of the Strategic Plan. Madison School District Facing Class-Action Lawsuit Over Open Enrollment

he Madison Metropolitan School District is facing a federal class-action lawsuit.
An East High School parent claims a request to transfer her daughter out of the district was been denied based on race.
The class-action lawsuit, filed in federal court on Wednesday, claims the Madison school district discriminated against a white, female student who wanted to transfer from East High School using open enrollment.
At the time, in the 2006-2007 school year, the transfer request was denied because it would increase the racial imbalance in the district. It was the district’s policy at the time, but that policy was changed earlier this year after a Supreme Court ruling involving school districts in Seattle and Louisville, WISC-TV reported.
“I believe this district had a policy that was absolutely consistent with state law,” Madison Schools Superintendent Daniel Nerad said. “When there was a legal decision by the highest court of the land… that was no longer a factor. I believe the district responded very responsibly in making a change in the policy.”

“Big picture perspective:
Our community really has changed a lot within the past five years. I sense a great deal of stress within the police department.
Citywide issues
Increasing violence involving girls. He has looked at a lot of data with the District Attorney’s office. Girls are extremely angry.
Angry parents are coming into the schools.
Increasing issues in the neighborhood that end up in the schools. Mentioned South Transfer Point beating and that Principal Ed Holmes mediated the situation at an early stage.
Growing gang violence issue particularly in the east side schools. We do have gang activity at Memorial and West but most of the issues are at Lafollete and East. Dealing with this via training and building relationships
What the school are experiencing is a reflection of what is going on in the community.”

Madison Police Chief Noble Wray, via Bill Lueders @ Isthmus (7/30/2008):

He (Wray) began by talking about perceptions of crime, and especially the notion that it’s getting worse in Madison. He stressed that it wasn’t just the media and public who felt this way: “If I would ask the average beat cop, I think they would say it’s gotten worse.” But, he added, “Worse compared to what?”

The absence of local safety data spurred several SIS contributors to obtain and publish the police call data displayed below. Attorney and parent Chan Stroman provided pro bono public records assistance. Chan’s work on this matter extended to the Wisconsin Attorney General’s office.
A few important notes on this data:

  • 13% of the records could not be geocoded and therefore are not included in the summary information. The downloadable 1996-2006 police call data .zip file is comprehensive, however.
  • Clicking on the numbers below takes the reader to a detail page. This page includes all matching police calls and a downloadable .csv file of same. The csv file can be opened in Excel, Numbers and many data management tools.

By Friday, the system, known as Infinite Campus, will be available to all parents of Madison School District middle and high school students. Those students, and parents of elementary students, will be able to tap in sometime after the first of the year.
Parents and students receive individual passwords. Parents can e-mail teachers and see whether their children owe any fees. They also can view, on a single calendar, a summary of important upcoming assignment deadlines and school events for all of their children.
With the arrival of Infinite Campus, Madison becomes the 13th of Dane County’s 16 school districts to offer around-the-clock electronic access to student information.
Officials at the three remaining districts — Marshall, Deerfield and Stoughton — plan to install similar systems soon and Stoughton already permits parents to receive frequent e-mail summaries of their children’s grades. More than 80 percent of Stoughton parents have signed up for the e-mail updates.

The Madison School District should be quite pleased with this effort. Initiatives on this scale are never easy. Certainly, much remains to be done, but lifting off, getting a great deal of staff buy in and opening it up to parents is a significant win.




Open records request re: private school busing



I want to know who knew what when about missing the August 4 deadline to notify parents of the MMSD decision on busing private school students, so I sent the following to Steve Hartley:

I am sending this message to you because I was told that you are now the legal custodian of district records.
This is an open records request under sec. 19.35 of the Wisconsin Statutes for all records, prepared between August 22, 2006 and August 22, 2007, that relate to or mention in any way the busing of private school students by the Madison Metropolitan School District.
As I hope that you know, Wisconsin statues define records rather broadly. It is my understanding that the definition would include any e-mail between staff on their personal computers or MMSD computers and all e-mail that might have a format such as b710146.admin.admin1@madison.k12.wi.us and b717934.mailpo1.maildomi@madison.k12.wi.us.
I look forward to your prompt response to this request.

Sunshine Week: Open Records in Schools

  • Meg Jones: School District loses 2 suits over lack of transparency

    Barry Hoerz was kicked out of a meeting of the Weyauwega-Fremont School Board in July.
    What’s unusual is that Hoerz was a member of the School Board, and he was told to leave because he was writing notes during closed session.
    A Waupaca County circuit judge agreed with Hoerz after a four-hour trial in January and ordered the district to pay a $300 fine as well as attorney expenses and other fees totaling $9,133, according to court records.
    While squabbles among school board members and superintendents are not rare, it is unusual for a school board member to sue the board for violating the state’s open meetings law.

  • Madison Parents School Safety Site:

    This week is national “Sunshine Week” (Sunshine Week web site; Sunshine Week blog), promoting open government and the public’s right to know. For last year’s Sunshine Week, the Rochester (N.Y.) Democrat and Chronicle conducted a freedom of information audit to obtain copies of its school district’s reports of violent and disruptive incidents in school buildings.

Concessions Made in Advance of MTI Negotiations by a Majority of the Madison School Board



It will be interesting to see how voters on February 20 and April 3 view this decision by a majority of the Madison School Board: Should the Board and Administration continue to give away their ability to negotiate health care benefits ($43.5M of the 2006/2007 budge) before MTI union bargaining begins? Read the 2005 MMSD/MTI Voluntary Impasse Agreement [1.1MB PDF; see paragraph’s 2, 10 and 11]. The 2007 version, alluded to in Andy Hall’s article below, will be posted when it sees the light of day.
This is an important issue for all of us, given the MMSD’s challenge of balancing their growing $331M+ budget, while expenses – mostly salaries and benefits – continue to increase at a faster rate. Mix in the recent public disclosure of the district’s $5.9M 7 year structural deficit and I doubt that this is the best approach for our children.
Recently, the Sun Prairie School District and its teachers’ union successfully bargained with DeanCare to bring down future costs for employee health insurance.

Andy Hall, writing in the Wisconsin State Journal asks some useful questions:

But with the Madison School Board facing a $10.5 million budget shortfall, is the board giving away too much with its promises to retain teachers’ increasingly pricey health insurance and to discard its legal mechanism for limiting teachers’ total compensation increase to 3.8 percent?

Yes, School Board Vice President Lawrie Kobza said Saturday, “I feel very strongly that this was a mistake,” said Kobza, who acknowledged that most board members endorse the agreement with Madison Teachers Inc., the teachers union.

State law allows districts to avoid arbitration by making a so-called qualified economic offer, or QEO, by boosting salaries and benefits a combined 3.8 percenter a year.

“To agree before a negotiation starts that we’re not going to impose the QEO and negotiate health care weakens the district’s position,” Kobza said. She contended the district’s rising health-care costs are harming its ability to raise starting teachers’ salaries enough to remain competitive.

The “voluntary impasse resolution” agreements, which are public records, are used in only a handful of Wisconsin’s 425 school districts, according to the Wisconsin Employment Relations Commission.

Four of the 7 current Madison School Board Members were backed by MTI during their campaigns (Arlene Silveira, Carol Carstensen, Shwaw Vang and Johnny Winston, Jr.). Those four votes can continue this practice. Independent School Board members Lawrie Kobza and Ruth Robarts have spoken publicly against the concessions made in advance of negotiations.     In 2006-07 the Madison School district will spend $43.5M on health insurance for its employees, the majority of the money paying for insurance for teachers represented by Madison Teachers, Inc. (MTI) That is 17% of the operating budget under the revenue limits.
    In June of 2007, the two-year contract between the district and MTI ends. The parties are now beginning negotiations for the 2007-09 contract.
    The Sun Prairie School district and its teachers union recently saved substantial dollars on health insurance. They used the savings to improve teacher wages.     Last week, Madison Teachers Inc. announced it would not reopen contract negotiations following a hollow attempt to study health insurance alternatives.
    Not to put too fine a point on it, but anyone who suggests the Joint Committee on Health Insurance Issues conducted a fair or comprehensive review needs to get checked out by a doctor.
    The task force’s inaction is a victory for John Matthews, MTI’s executive director and board member Wisconsin Physicians Service.
    Losers include open government, school officials, taxpayers and young teachers in need of a raise.
    From its start, the task force, comprised of three members each from MTI and the district, seemed to dodge not only its mission but scrutiny.

Madison School Board Seat 3 Primary Overview

At first glance, the three primary candidates seeking the seat that Shwaw Vang is leaving open on the Madison School Board appear far more similar than different.

Beth Moss, Rick Thomas and Pam Cross-Leone are all married, white, middle class parents of students who attend Madison public schools. Their ages range from 37 to 47, and all bring impressive records of school volunteer work and community involvement to the table.

The Capital Times recently asked the three Madison School Board candidates running in next week’s primary election for Seat 3 to come to our office to discuss their priorities for the Madison district and to participate in a couple of exercises that might offer an unusual glimpse into how they view city schools.
We marked 10 cards with issues that the district has dealt with over the last year and asked the candidates to place them in order, based on what they would most like to protect from cuts. We also gave them a couple of wild cards they could use for items we had not included on the list. Then we asked them to take paper and a packet of crayons and use them to present their ideal classroom. Finally, we asked them to talk about each of these exercises, for which they were given 10 minutes to complete.
Both Pam Cross-Leone and Beth Moss listed class size and competitive salaries as among their top three priorities. Rick Thomas listed his top priority as school safety, and he placed competitive salaries last. Cross-Leone used multiple colors to write about her ideal classroom, while Moss drew a diagram using only a green crayon. Thomas drew a simple picture, with stick figures.

Public’s Right To Know: Madison School District Land Purchases



Two weeks ago, I emailed this Open Records request to Madison School District Attorney Clarence Sherrod:

Good Afternoon, Clarence:
I hope this note finds you well.
I am writing to make an open records request under sec. 19.35 of the Wisconsin Statutes. I would like copies of any agreements signed this year by the Madison Metropolitan School District or its representatives to purchase land for a school site. I believe the issue of purchasing land for a school site was discussed by the Madison Board of Education on 10/10/2005.
I believe that these sort of land/facilities discussions should be public knowledge, particularly in light of the East / West task force activity.

I received a response today from Bob Nadler, the District’s Custodian of Records. Essentially, this response means that the public has no right to know about the District’s purchase of land for a new school site until after the Board agrees to purchase. Read Bob’s letter here. I will post the document he referenced upon receipt.

School employees harassed police as they arrested an 18-year-old student criminal for carrying a loaded weapon inside La Follette high school, according to the most excellent report from Chris Rickert of the WI State Journal, made after an open records request. 

One Kyshawn M. Bankston had a Glock 9 mm handgun, two magazines with rounds in them, a scale and an empty plastic bag that had contained marijuana, police say. The young scholar lunged for that gun as police moved to arrest him. (Their police report)

Madison taxpayers have long supported far above average K – 12 spending. Per student spending ranges from $22,633 to $29,827 depending on the spending number used (!)

Notes on downsizing Universities (!) of Wisconsin Campuses

The UW System hopes to downsize its remaining branch campuses amid declining student interest in associate degrees and ongoing enrollment struggles, according to an October briefing by UW System President Jay Rothman Isthmusobtained via records request. 

Five campuses have already been targeted for closure or a transition from in-person learning — UW-Platteville Richland will be completely vacated by July 1, while UW-Oshkosh Fond du Lac, UW-Milwaukee Washington County, UW-Green Bay Marinette and UW-Milwaukee Waukesha are all slated for closure or a transition to online-only classes. But the briefing, first sent to branch campus chancellors on Sept. 19, recommends that the UW System reduce the physical footprints of the remaining eight campuses and negotiate contractual exits where appropriate. 

The UW System comprises three levels of universities: two flagship research universities, UW-Madison and UW-Milwaukee, 11 comprehensive universities offering bachelor’s and graduate degrees and 13 branch campuses, offering associate and bachelor’s degrees. The branch campuses, though located elsewhere, are embedded in a nearby four-year university and operate under the jurisdiction of that university’s chancellor. 

The branch campuses are funded through a hybrid model: the counties hosting the campuses pay for the land and facilities, while the UW System covers operational costs. 

“Negotiate New Agreements with All Other Counties,” reads the title of one slide included in the briefing. “Will seek to reduce space allocations/footprints, repurpose facilities, negotiate exits where appropriate, and address any other concerns.” 




New documents strengthen—perhaps conclusively—the lab-leak hypothesis of Covid-19’s origins.



Nicholas Wade:

The day is growing ever closer when Washington may have to add to its agenda with Beijing a nettlesome item it has long sought to avoid: the increasingly likely fact that China let the SARS2 virus escape from the Wuhan lab where it was concocted, setting off the Covid-19 pandemic that killed some 7 million people globally and wrought untold economic havoc.

New documents may explain why no one has been able to find the SARS2 virus (aka SARS-CoV-2) infesting a colony of bats, from which it might have jumped to people. The reason would be that the virus has never existed in the natural world. Documents obtained by U.S. Right to Know, a health advocacy group, provide a recipe for assembling SARS-type viruses from six synthetic pieces of DNA designed to be a consensus sequence—the genetically most infectious form—of viruses related to SARS1, the bat virus that caused the minor epidemic of 2002. The probative weight of the recipe is that prior independent evidence already pointed to SARS2 having just such a six-section structure.

The documents unearthed by U.S. Right to Know, and analyzed by its reporter Emily Kopp, include drafts and planning materials for the already-known DEFUSE proposal, an application to DARPA, a Pentagon research agency, for a $14 million grant to enhance SARS-like bat viruses.

The new recipe is in striking accord with a theoretical paper published in 2022 that predicted the SARS2 virus had been generated in exactly this way. Three researchers—Valentin Bruttel, Alex Washburne, and Antonius VanDongen—noted that the virus could be cut into six sections if treated with a pair of agents known as restriction enzymes and so had probably been synthesized and assembled in this way.
