Wisconsin Education Superintendent Tony Evers faces re-election amid big GOP wins, union membership losses

John Matthews, former longtime executive director of Madison Teachers Inc., called Evers a “hero” and said he deserves to be re-elected. He said Wisconsin “residents know of his advocacy for their children.”

“That said, I do worry that the far right and the corporations which want to privatize our public schools and make them for-profit private schools will spend millions in an attempt to defeat him,” Matthews said.

A spokeswoman for WEAC did not respond to a request for comment.

Pro-voucher group American Federation for Children’s political arm spent heavily on behalf of Republican candidates in legislative races this year.

An AFC official said the group has not made any decisions about the superintendent’s race, including whom to support and whether to spend money.

Evers declined to comment on the campaign.

“I have been focused on my budget and focused on several other issues that are important to the state and I haven’t paid attention to what any potential opponents are saying,” he said.

California State teachers union has given more than $13 million to extend income taxes on wealthy Californians

California’s largest teachers union has given more than $13 million to the effort to extend income tax hikes on California’s highest earners, according to newly released state campaign finance reports.

The report shows the California Teachers Assn. gave $3 million between April and June this year, in addition to the $10 million the union donated last month.

Before the $10-million contribution, supporters of the Proposition 55 campaign reported having $14 million in the bank. Also supporting the measure are the California Hospital Assn., Service Employees International Union and the California Medical Assn

WikiLeaks reveals DNC holds unions in contempt

Yet the emails that have been released highlight the rather one-way relationship between the Democratic Party and labor unions. DNC staffers see the unions as good soldiers in skirmishes with Republicans, as a pain when it comes to getting things done and, ultimately, as pushovers.

When brainstorming what to do about last week’s Republican National Convention, the DNC’s Rachel Palermo urged her party to “meet with the hotel trades, SEIU, and Fight for 15 about staging a strike.” She said the result could be a “fast food worker strike around the city or just at franchises around the convention.” The aim would not be to improve working conditions, but to bloody Republicans.

Alternately, the DNC could “infiltrate friendly union hotels and properties around the convention that Republicans will be patronizing to distribute ‘care’ packages” — probably not chocolates.

Palermo also noted that “SEIU has space in downtown Cleveland close to convention that can be the base of operations and host the wrapped mobile RV.”

$10.6M MTA spending to defeat charter expansion

An initiative on the November ballot in Massachusetts would lift the state’s cap on charter schools just enough to allow 12 new charters or expansions of existing charters each year. That seems relatively innocuous as political issues go, but the Massachusetts Teachers Association (MTA) has made the referendum its line in the sand. It is devoting $9.2 million of its own budget to defeating the measure, titled Question 2 .

But why limit yourself to spending millions of Massachusetts teacher dues when you can get access to more than a million dollars of dues from teachers in other states? Just prior to the opening of the National Education Association Representative Assembly in Washington DC, the national union’s board of directors approved a $1.4 million grant to MTA from its Ballot Measure/Legislative Crises Fund to support the anti-charter campaign.

MTI – Teachers who worked full-time in the Madison Metropolitan School District for the entire calendar year in 2015 (January through December) paid dues/fair share in the amount of $1,042.10. Of that amount, $260 was for WEAC, $183.60 for NEA, $570.00 for MTI, and $28.50 for MTI VOTERS (MTI’s political action committee). Because of wide variances, teachers employed under part-time contracts should check their last payroll check stub in 2015 for the correct amount to use in calculating their taxes.

Thanks for the opportunity. Many have asked why in the world one would stay in a job for 48 years. My answer is quite simple. My work for MTI was a labor of love, it was working with MTI members – virtually 24/7. It was working for a great group of people in search of social justice. MTI members standing in solidarity and moving forward – willing to take risks when necessary in the mutual interest of all. My days were filled working with individuals who were in search of solutions to work, family, and personal issues – and my effort helped produce solutions and advance rights. Those solutions made careers more enjoyable, more productive, and made member’s personal life, family life and work life better.

MTI has grown into a fantastic union. It is a member-driven union that is among the best in the United States. Whether negotiating to provide better working and living conditions, or engaging in social or political action in search of change which enabled improvements in education or society in general, MTI has been at forefront of such causes. So, in the scheme of things, my 48 year career went by like the blink of an eye.

I can’t imagine working anywhere else where my career could have been more productive, more enjoyable, or more satisfying.

My thanks to each and every MTI member 1968-2016. MTI has a great staff and it will continue moving forward in service to its members.

Keillor Takes the Reins

With John Matthews retiring from MTI, the Cabinet on Personnel, which is made up of the leadership of all five MTI bargaining units, has tapped Doug Keillor to succeed Matthews. Keillor has worked with Matthews for the past 25 years, and is well-known by MTI members. He has worked with Matthews in member service and in negotiations. In recommending that Keillor replace him, Matthews told the Cabinet on Personnel that Keillor has the skill, knowledge, and philosophy to continue the Union’s excellent service to MTI members.

Keillor is eager to continue his work for MTI in his new capacity, working with MTI staff, elected leaders and membership to carry the Union forward.

Rights granted to an employee by the Union’s Contract are among the most important conditions of one’s employment. Those represented by MTI, in each of MTI’s five bargaining units, have a limited number of important SENIORITY protections in critical areas. Contrary to popular opinion, seniority has little relevance in issues such as voluntary transfer where the Union Contract allows the employer to select the most qualified candidate for any vacancy. However, when determining who should be declared “surplus” (above staff requirements in a school or department) or who should be subject to “layoff” (above staff requirements in the District), SENIORITY is the objective factor that limits and controls management’s subjective actions. Because of SENIORITY rights provided by the Union’s Contract, for example, the employer cannot layoff the more senior employee simply because she/he is paid more or may be outspoken.

Workers’ Compensation is a statutory benefit intended to provide compensation for workers who suffer a work-related injury or illness. However, the process does not always work as intended and claims are often delayed and/or denied. Fortunately in such instances, MTI-represented employees can turn to their Union for assistance.

Slips, trips and falls are the some of the most common causes of work-related injuries to District employees. If an employee is injured at work, they need to complete an Injury Report form as soon as possible and, if necessary, visit a doctor to determine what, if any, work restrictions are recommended. If an injury or illness restricts an employee from work, the injured employee needs to submit a Work Status Report form (signed by the medical provider) identifying those restrictions to the District. MTI has produced a Workers’ Compensation Fact Sheet for members advising of the process and of their rights.)

Once approved, Workers’ Compensation is supposed to compensate the employee at two-thirds (2/3) of the employee’s wage rate up to certain maximum during a period of temporary disability. (Union Advantage #2: MTI’s Contracts, and next school year’s Employee Handbook, require that injured employees eligible for workers’ compensation receive 100% of wages for the first 180 days of injury.)

Madison’s Schwerpunkt: Government School District Power Play: The New Handbook Process is worth a look



Wisconsin’s stürm and drang over “Act 10” is somewhat manifested in Madison. Madison’s government schools are the only Wisconsin District, via extensive litigation, to still have a collective bargaining agreement with a teacher union, in this case, Madison Teachers, Inc.

The Madison School Board and Administration are working with the local teachers union on a new “Handbook”. The handbook will replace the collective bargaining agreement. Maneuvering over the terms of this very large document illuminates posturing and power structure(s) in our local government schools.

Madison Superintendent Jennifer Cheatham wrote recently (September 17, 2015 PDF):

The Oversight group was able to come to agreement on all of the handbook language with the exception of one item, job transfer in the support units. Pursuant to the handbook development process, this item was presented to me for review and recommendation to the Board. My preliminary recommendation is as follows:

Superintendent Recommendation
That the language in the Handbook with regard to transfer state as follows: Vacancies shall first be filled by employees in surplus. The District has the right to determine and select the most qualified applicant for any position. The term applicant refers to both internal and external candidates for the position.

The District retains the right to determine the job qualifications needed for any vacant position. Minimum qualifications shall be established by the District and equally applied to all persons.

Rationale/Employee Concern

Rationale:
It is essential that the District has the ability to hire the most qualified candidate for any vacant position—whether an internal candidate or an external candidate. This language is currently used for transfers in the teacher unit. Thus, it creates consistency across employee groups.
By providing the District with the flexibility of considering both internal and external candidates simultaneously the District can ensure that it is hiring the most qualified individual for any vacant position. It also gives the District opportunities to diversify the workforce by expanding the pool of applicants under consideration. This change would come with a commitment to provide stronger development opportunities for internal candidates who seek pathways to promotion.

Employee Concern:
The existing promotional system already grants a high degree of latitude in selecting candidates, including hiring from the outside where there are not qualified or interested internal applicants. It also helps to develop a cadre of dedicated, career-focused employees.

The Operations Work Group met on Monday September 21, 2015. Members of the Oversight Group for development of the Employee Handbook presented the draft Employee Handbook to the Board. There was one item on which the Oversight Group was unable to reach agreement, the hiring process for the support units. Pursuant to the handbook development process, this item was presented to me for review and recommendation to the Board. There was discussion around this item during the meeting and, the Board requested that members of the Oversight Group meet again in an attempt to reach consensus.

Per the Board’s direction, District and employee representatives on the Oversight Group came together to work on coming to consensus on the one remaining item in the Handbook. The group had a productive dialog and concluded that with more time, the group would be able to work together to resolve this issue. Given that the Handbook does not go into effect until July1, 2016, the group agreed to leave the issue regarding the hiring process for the support units unresolved at this point and to include in the Handbook the phrase “To Be Determined” in the applicable sections. As such, there is no longer an open item. When you vote on the Handbook on Monday, the section on the “Selection Process” in the various addenda for the applicable support units will state “To Be Determined” with an agreement on the part of the Oversight Group to continue to meet and develop final language that the Board will approve before the Handbook takes effect in the 2016-17 school year.

1. The Wisconsin Institute for Law and Liberty has filed suit to vacate the Madison government schools collective bargaining agreement with Madison Teachers, Inc.

2. Attorney Lester Pines has spent considerable time litigating Act 10 on behalf of Madison Teachers, Inc. – with some success.

How education lobbyists are schooling D.C. lawmakers

Among the biggest spenders on lobbying are the National Education Association and American Federation of Teachers, the two teachers’ unions.

The NEA spent $1.2 million during the first six months of 2015, second only among public employee unions to the $1.3 million lobbying bill paid by the American Federation of State, County and Municipal Employees, according to the Center for Responsive Politics, a Washington-based research group. AFT ranked fourth with $668,068.

Washington State Supreme Court: Charter schools are unconstitutional…

After nearly a year of deliberation, the state Supreme Court ruled 6-3 late Friday afternoon that charter schools are unconstitutional, creating chaos for hundreds of families whose children have already started classes.

The ruling — believed to be one of the first of its kind in the country — overturns the law voters narrowly approved in 2012 allowing publicly funded, but privately operated, schools.

Eight new charter schools are opening in Washington this fall, in addition to one that opened in Seattle last year.

It was not immediately known what would happen with the schools that are already running. The parties have 20 days to ask the court for reconsideration before the ruling becomes final.

Justices receive political contributions from lead party in charter school lawsuit

New research finds that some justices on the state supreme court have received political contributions from a lead party in a key lawsuit now before the court.

Parties in the case, League of Women Voters, Washington Education Association, et al vs State of Washington, are asking the court to strike down Washington’s charter school law, passed by voters in 2012, and bar children from attending a charter public school.

Charter schools are community-based public schools that operate independently of central district management. They are tuition-free and open to all students. In Washington, charter schools are designed to help poor families and children underserved by traditional schools.

Charter schools are popular with low-income parents who see education as the path to a better future for their children. Demand far exceeds supply. While 10 charter schools are set to open, the Charter School Commission this year rejected applications from 12 community charter school groups, leaving 4,900 children to wait for a future round of approvals.

Either way, membership is down more than 50 percent from the union’s 98,000-member levels before Gov. Scott Walker signed his signature legislation in 2011 that significantly diminished collective bargaining rights for most public employees.

WEAC’s lobbying dollars have dropped dramatically, too.

A decade ago, WEAC spent $1.5 million on lobbying during the 2005-2006 legislative session, state records show. The next session: $1.1 million. During the two sessions leading up to the passage of Act 10, WEAC spent $2.5 million and $2.3 million, respectively.

But during the 2013-14 session, after Walker signed the bill into law, the union spent just $175,540. It was the first time in at least 10 years that the union was not among the state’s top 12 lobbying spenders, according to the Government Accountability Board.

“That has a big effect on the political landscape,” said Mike McCabe, former executive director of the Wisconsin Democracy Campaign, which tracks political spending. “They often were the No. 1 lobbying spender among interest groups and they obviously don’t have the capacity to do that anymore.”

But Brey said it’s part of a strategy that WEAC was working on before Act 10. She said instead of relying on a lobbyist, the local focus is more effective because legislators have to explain their votes in their communities.
“At some point you have to look someone in the eye and explain just what you’re doing to their neighborhood public school and why,” she said.

School unions vital defenders of public education

This fall, 305 local union organizations representing public school teachers, support staff, and custodial workers held recertification elections in school districts across the state. Despite everything that Walker has done to undermine them, more than 90 percent of the local unions were recertified. Indeed, according to the Wisconsin Education Association Council, 97 percent of its units that sought recertification won their elections.

The numbers are even more overwhelming for American Federation of Teachers union locals in Wisconsin.

“Since recertification elections began in 2011, every AFT-Wisconsin local union that has pursued recertification has won convincingly,” notes Kim Kohlhaas, an elementary school teacher in the Superior School District who serves as president of AFT-Wisconsin.

In many school districts, the numbers were overwhelming.

In Madison, where the Madison Teachers Inc. union has played a leading role in opposing Walker’s anti-labor agenda, the pro-recertification votes have been overwhelming.

According to vote totals released by the Wisconsin Employment Relations Commission, Madison teachers gave 88 percent support to recertification, as did 81 percent of security staff, 77 percent of support staff, 76 percent of educational assistants and 74 percent of substitute teachers.

Notably, Walker won just 52 percent of the vote in his recent re-election run. So, if the governor claims any sort of mandate, he ought to accept that MTI has a much bigger mandate.

Commentary on Elections, School Choice & Lobbying Expenditures

School choice proponents, many from out of state, funneled $64,000 directly into candidates’ coffers in 2014, through AFC and another group. (The AFC-affiliated funder, Wisconsin Federation for Children Political Fund, filed its last report Nov. 26, a month late, risking a penalty of up to $500. Its Washington, D.C.-based administrator did not respond to an emailed question about the late filing.)

In addition, AFC made independent expenditures of $866,000 to boost or oppose candidates. This adds to the nearly $10 million in state electoral spending by school choice proponents between 2003 and 2012, as tallied by the nonpartisan Wisconsin Democracy Campaign.

AFC’s spending in the Nov. 4 elections included $148,000 to help narrowly defeat Democrat Rep. Mandy Wright, a former teacher and school choice critic. It spent $123,000 to help Republican Todd Novak score a razor-thin win over Democrat Dick Cates. And it poured $240,000 into GOP choice proponent Howard Marklein’s successful bid for an open Senate seat.

Jensen is proud of these victories, which he says give it “a school choice majority in both houses.” He attributes this success to public support for school choice.

Yet, in its electioneering, AFC commonly doesn’t even mention school choice. It attacked Wright for allegedly using sick leave to attend a protest, which she insists is not true. It went after Cates for his vote on the local school board concerning the Pledge of Allegiance. And it ripped Democratic Rep. Gordon Hintz for threatening a female colleague and being cited in a massage parlor sting operation, both in 2011.

New Jersey Teachers Union Spent $60m over the past 15 years on Campaigns & Lobbying

The political spending by the New Jersey Education Association is no secret anymore, with the latest numbers — in the tens of millions — continuing to astound.

A new report by the state’s election finance commission tallied more than $57 million spent by the teachers union on political campaigns and lobbying in the past decade and a half — more than double its nearest rival.

And a third of that total came last year alone for the election of the governor and the entire Legislature — more than four times the next-highest spender.

But with that money always comes the question as to whether the NJEA is getting the same political bang for its buck anymore, especially under a combative administration led by Gov. Chris Christie.

Election Grist: Madison Teachers Inc. has been a bad corporate citizen for too long

Teachers are some of our most dedicated public servants. Many inspiring educators have changed lives for the better in Madison’s public schools. But their union is a horror.

Madison Teachers Inc. has been a bad corporate citizen for decades. Selfish, arrogant, and bullying, it has fostered an angry, us-versus-them hostility toward parents, taxpayers, and their elected school board.

Instead of a collaborative group of college-educated professionals eager to embrace change and challenge, Madison’s unionized public school teachers comport themselves as exploited Appalachian mine workers stuck in a 1930s time warp. For four decades, their union has been led by well-compensated executive director John A. Matthews, whom Fighting Ed Garvey once described (approvingly!) as a “throwback” to a different time.

From a June 2011 Wisconsin State Journal story:

[Then] School Board member Maya Cole criticized Matthews for harboring an “us against them” mentality at a time when the district needs more cooperation than ever to successfully educate students. “His behavior has become problematic,” Cole said.

For years, Madison’s school board has kowtowed to Matthews and MTI, which — with its dues collected by the taxpayer-financed school district — is the most powerful political force in Dane County. (The county board majority even rehearses at the union’s Willy Street offices.)

Joe Zepecki, Burke’s campaign spokesman, said in an email Wednesday that he couldn’t respond officially because Burke has made clear that her campaign and her duties as a School Board member are to be kept “strictly separate.” However, on the campaign trail, Burke says she opposes Act 10’s limits on collective bargaining but supports requiring public workers to pay more for their benefits, a key aspect of the law.

John Matthews, executive director of Madison Teachers Inc., said the contracts were negotiated legally and called the legal challenge “a waste of money and unnecessary stress on district employees and the community.”

The lawsuit came a day after the national leader of the country’s largest union for public workers labeled Walker its top target this fall.

“We have a score to settle with Scott Walker,” Lee Saunders, the union official, told The Washington Post on Tuesday. Saunders is the president of the American Federation of State, County and Municipal Employees. A spokeswoman for Saunders did not immediately return a call Wednesday.

AFSCME has seen its ranks in Wisconsin whither since Walker approved Act 10. AFSCME and other unions were instrumental in scheduling a 2012 recall election to try to oust Walker, but Walker won that election by a bigger margin than the 2010 race.

“When the union bosses say they ‘have a score to settle with Scott Walker,’ they really mean Wisconsin taxpayers because that’s who Governor Walker is protecting with his reforms,” Walker spokeswoman Alleigh Marré said in a statement.

Kenosha School District over teacher contracts after the board approved a contract with its employees.

In Madison, the School District and School Board “are forcing their teachers to abide by — and taxpayers to pay for — an illegal labor contract with terms violating Act 10 based upon unlawful collective bargaining with Madison Teachers, Inc.,” a statement from WILL said.

Blaska, a former member of the Dane County Board who blogs for InBusiness, said in addition to believing the contracts are illegal, he wanted to sue MTI because of its behavior, which he called coercive and bullyish.

“I truly believe that there’s a better model out there if the school board would grab for it,” Blaska said.

MTI executive director John Matthews said it’s not surprising the suit was filed on behalf of Blaska “given his hostile attacks on MTI over the past several years.”

“WILL certainly has the right to challenge the contracts, but I see (it as) such as a waste of money and unnecessary stress on district employees and the community,” said Matthews, adding that negotiating the contracts “was legal.”

In August, the Wisconsin Supreme Court ruled Act 10 constitutional after MTI and others had challenged its legality. At the time, union and district officials said the contracts that were negotiated before the ruling was issued were solid going forward.

Under Act 10, unions are not allowed to bargain over anything but base wage raises, which are limited to the rate of inflation. Act 10 also prohibits union dues from being automatically deducted from members’ paychecks as well as “fair share” payments from employees who do not want to be union members.

Superintendent Jennifer Cheatham said Wednesday the district has not yet received notification of the suit being filed.

“If and when we do, we’ll review with our team and the Board of Education,” she said.

School Board vice president James Howard said the board “felt we were basically in accordance with the law” when the contracts were negotiated and approved.

A lawsuit targeting the Madison School District and its teachers union is baseless, Madison School Board member and Democratic gubernatorial candidate Mary Burke said Thursday.

The lawsuit filed Wednesday by the conservative nonprofit Wisconsin Institute for Law & Liberty on behalf of well-known blogger David Blaska alleges the school district, School Board and Madison Teachers Inc. are violating Act 10, Republican Gov. “I don’t think there is a lot of substance to it,” Burke said of the lawsuit. “Certainly the board, when it negotiated and approved (the contracts), it was legal then and our legal counsel says nothing has changed.”

At any rate, Esenberg said, he doesn’t consult with Grebe, Walker or anyone else in deciding what cases to take on.

“The notion that we think Act 10 is a good idea because it frees the schools from the restraints of union contracts and gives individual employees the right to decide whether they want to support the activities of the union — that shouldn’t surprise anyone,” Esenberg said.

WILL is not likely to prevail in court, Marquette University Law School professor Paul Secunda told the Wisconsin State Journal. “They negotiated their current contract when the fate of Act 10 was still up in the air,” said Secunda, who also accused Esenberg of “trying to make political points.”

Esenberg contends the contract always was illegal.

The school board, district and union knew they could not negotiate anything more than wage increases based on inflation under the law, the lawsuit alleges. Despite the institute’s warnings, they began negotiations for a new 2014-15 contract in September 2013 and ratified it in October. What’s more, they began negotiating a deal for the 2015-16 school year this past May and ratified it in June, according to the lawsuit.

Both deals go beyond base wage changes to include working conditions, teacher assignments, fringe benefits, tenure and union dues deductions, the lawsuit said.

Taxpayers will be irreparably harmed if the contracts are allowed to stand because they’ll have to pay extra, the lawsuit went on to say. It demands that a Dane County judge invalidate the contracts and issue an injunction blocking them from being enforced.

“The Board and the School District unlawfully spent taxpayer funds in collectively bargaining the (contracts) and will spend substantial addition(al) taxpayer funds in implementing the (contracts),” the lawsuit said. “The (contracts) violate the public policy of Wisconsin.”

“Beware of legacy practices (most of what we do every day is the maintenance of the status quo), @12:40 minutes into the talk – the very public institutions intended for student learning has become focused instead on adult employment. I say that as an employee. Adult practices and attitudes have become embedded in organizational culture governed by strict regulations and union contracts that dictate most of what occurs inside schools today. Any impetus to change direction or structure is met with swift and stiff resistance. It’s as if we are stuck in a time warp keeping a 19th century school model on life support in an attempt to meet 21st century demands.” Zimman went on to discuss the Wisconsin DPI’s vigorous enforcement of teacher licensing practices and provided some unfortunate math & science teacher examples (including the “impossibility” of meeting the demand for such teachers (about 14 minutes)). He further cited exploding teacher salary, benefit and retiree costs eating instructional dollars (“Similar to GM”; “worry” about the children given this situation).

Understanding the current union battles requires a visit to the time machine and the 2002 and the Milwaukee County Pension Scandal. Recall elections, big money, self interest and the Scott Walker’s election in what had long been a Democratic party position.

The 2000-2001 deal granted a 25% pension “bonus” for hundreds of veteran county workers. Another benefit that will be discussed at trial is the controversial “backdrop,” an option to take part of a pension payment as a lump-sum upon retirement.

Testimony should reveal more clues to the mysteries of who pushed both behind the scenes.

So what does it mean to take a “backdrop?”

“Drop” refers to Deferred Retirement Option Program. Employees who stay on after they are eligible to retire can receive both a lump-sum payout and a (somewhat reduced) monthly retirement benefit. Employees, upon leaving, reach “back” to a prior date when they could have retired. They get a lump sum equal to the total of the monthly pension benefits from that date up until their actual quitting date. The concept was not new in 2001, but Milwaukee County’s plan was distinguished because it did not limit the number of years a worker could “drop back.” In fact, retirees are routinely dropping back five years or more, with some reaching back 10 or more years.

That has allowed many workers to get lump-sum payments well into six figures.

Former deputy district attorney Jon Reddin, at age 63, collected the largest to date: $976,000, on top of monthly pension checks of $6,070 each.

The Newsline article by longtime legal writer Stuart Taylor Jr. alleges that Chisholm may have investigated Walker and his associates because Chisholm was upset at the way in which the governor had repealed most collective bargaining for public employees such as his wife, a union steward.

The prosecutor is quoted as saying that he heard Chisholm say that “he felt that it was his personal duty to stop Walker from treating people like this.”

The Milwaukee Journal Sentinel has requested to speak with the former prosecutor through Taylor and has not yet received an answer.

In a brief interview, Chisholm denied making those comments. In a longer statement, an attorney representing Chisholm lashed out at the article.

“The suggestion that all of those measures were taken in furtherance of John Chisholm’s (or his wife’s) personal agenda is scurrilous, desperate and just plain cheap,” attorney Samuel Leib said.




Madison’s Lengthy K-12 Challenges Become Election Grist; Spends 22% more per student than Milwaukee

When all third graders read at grade level or beyond by the end of the year, the achievement gap will be closed…and not before
On November 7, Superintendent Art Rainwater made his annual report to the Board of Education on progress toward meeting the district’s student achievement goal in reading. As he did last fall, the superintendent made some interesting claims about the district’s success in closing the academic achievement gap “based on race”.

According to Mr. Rainwater, the place to look for evidence of a closing achievement gap is the comparison of the percentage of African American third graders who score at the lowest level of performance on statewide tests and the percentage of other racial groups scoring at that level. He says that, after accounting for income differences, there is no gap associated with race at the lowest level of achievement in reading. He made the same claim last year, telling the Wisconsin State Journal on September 24, 2004, “for those kids for whom an ability to read would prevent them from being successful, we’ve reduced that percentage very substantially, and basically, for all practical purposes, closed the gap”. Last Monday, he stated that the gap between percentages scoring at the lowest level “is the original gap” that the board set out to close.

Unfortunately, that is not the achievement gap that the board aimed to close.

In 1998, the Madison School Board adopted an important academic goal: “that all students complete the 3rd grade able to read at or beyond grade level”. We adopted this goal in response to recommendations from a citizen study group that believed that minority students who are not competent as readers by the end of the third grade fall behind in all academic areas after third grade.

As of 2013, the situation has not changed, unfortunately.

Madison, 2014, the view from Milwaukee:

The largest state teachers union, the Wisconsin Education Association Council, gave $1.3 million last month to the Greater Wisconsin Committee, a liberal group that has been running ads critical of Walker. Two of WEAC’s political action committees have given a total of $83,128 to Burke directly.

On the other side, the American Federation for Children said last year in a brochure that in the 2012 elections in Wisconsin, including the recalls that year, it had spent $2.4 million supporting pro-voucher candidates.

Along with family members, Dick and Betsy DeVos have given about $343,000 to Walker since 2009. The Grand Rapids, Mich., couple made their fortune in the marketing firm Amway and now support the voucher school movement.

The elections are critical because in general, each candidate’s stance on the issue of vouchers is largely dictated by their political party affiliation. If Republican candidates maintain control of both houses and the governor’s seat, voucher-friendly legislation is more likely to pass.

Democrats are trying to take control of the state Senate. Republicans hold the chamber 17-15, with one GOP-leaning seat vacant. Republicans have a stronger majority in the Assembly and the election is unlikely to change that.

Senate Democrats would oppose the expansion of voucher schools until standards and requirements are established that put those private schools on the same footing as public schools, Senate Minority Leader Chris Larson (D-Milwaukee) said.

Walker on Wednesday also challenged Burke’s record on the Madison School Board.

He noted that the graduation rate for black students in Madison is lower than the graduation rate for black students in MPS.

Walker said Burke has had a chance to use his Act 10 law to save the taxpayers millions in Madison, and put those dollars toward alleviating the achievement gap.

“She’s failed to do that,” Walker said.

Burke responded that Madison is a fiscally responsible district that is one of the few in the state operating under its levy cap.

Madison still has a contract because the teachers union there challenged the Act 10 law in court, and a circuit court judge ruling initially swung in its favor. The teachers union subsequently bargained a contract this year and next year with the district.

Then this summer, the Wisconsin Supreme Court upheld Walker’s Act 10 law.

Gov. Scott Walker took the campaign against Democratic opponent Mary Burke to her front door Wednesday, accusing the one-term Madison School Board member of not doing enough to improve black students’ graduation rates in Madison.

Walker argued that the Madison School Board could have put more money toward raising graduation rates and academic achievement if it had taken advantage of his controversial 2011 measure known as Act 10, which effectively ended collective bargaining for most public workers, instead of choosing to negotiate a contract with its teachers union for the 2015-16 school year earlier this summer.

“Voters may be shocked to learn that the African-American graduation rate in Madison (where Mary Burke is on the board) is worse than in MKE,” Walker tweeted Wednesday morning.

Burke shot back that Walker’s comments were “short sighted” and showed “a lack of knowledge” of how to improve student academic achievement.

In 2013, 53.7 percent of black students in Madison graduated in four years. In Milwaukee, the rate was 58.3 percent, according to state Department of Public Instruction data. That gap is smaller than it was in 2012, when the 4-year completion rate among black students was 55 percent in Madison and 62 percent in Milwaukee.

Overall, the 2013 graduation rates for the two largest school districts in Wisconsin was 78.3 percent in Madison and 60.6 percent in Milwaukee.

Under Superintendent Jennifer Cheatham, the district has made progress in the last year toward improving overall student achievement, Burke said in a call with reporters. School Board president Arlene Silveira also said Wednesday the district has started to move the needle under Cheatham.

“Is it enough progress? No. We still have a lot of work to go, and whether you’re talking about African-American (graduation rates) in Madison or talking about (rates) in Milwaukee, they are too low,” Burke said. “But the key to improving student learning, that anyone who really looks at education knows, is the quality of the teacher in the classroom.”

2009: The elimination of “revenue limits and economic conditions” from collective bargaining arbitration by Wisconsin’s Democratically controlled Assembly and Senate along with Democratic Governer Jim Doyle:

To make matters more dire, the long-term legislative proposal specifically exempts school district arbitrations from the requirement that arbitrators consider and give the greatest weight to revenue limits and local economic conditions. While arbitrators would continue to give these two factors paramount consideration when deciding cases for all other local governments, the importance of fiscal limits and local economic conditions would be specifically diminished for school district arbitration.

Candidate Burke’s “operating under its levy cap” soundbyte was a shrewd, easily overlooked comment, yet neglects to point out Madison’s property tax base wealth vs. Milwaukee, the District’s spending levels when state revenue limits were put in place and the local referendums that have approved additional expenditures (despite open questions on where the additional funds were spent).

Madison’s challenges, while spending and staffing more than most, will continue to be under the political microscope.

Before contract, New York teachers gave to de Blasio charity

Less than a month before Mayor Bill de Blasio struck a major contract agreement with the United Federation of Teachers, its parent union, the American Federation of Teachers, gave $350,000 to a nonprofit run by de Blasio advisers, which lobbies on behalf of the mayor’s priorities, newly released records show.
 
 The AFT’s donation, on April 9, was the largest donation to the de Blasio-affiliated nonprofit, Campaign For One New York, since it was founded after the mayor was elected last November. Its timing raises questions about the ability of outside interests to advance their agendas before the city by supporting a nonprofit close to the mayor.

Will the Madison School Board Prove Mary Burke Wrong (or Right)?

We should not have been surprised when Democratic candidate for governor Mary Burke voted with the rest of the Madison school board to negotiate a contract extension with the teachers union. After all, it was just a month ago that Burke told the Milwaukee Journal Sentinel in a video recorded interview that she believes she didn’t need Act 10 to get the same concessions from the unions. “I think it was only fair to ask for contributions to health care and to pensions, um, but I think those could have been negotiated, ah certainly firmly but fairly.”

Let’s set aside that negotiating a contract extension with the union is likely a violation of the law, as attorney Rick Esenberg of WILL informed the school board. Okay, that’s a little bit like saying to the dinosaurs, “setting aside that giant meteor head towards Earth…”

But setting the issue with the law aside, we’re about to about to see whether Burke’s claim is correct that she is capable of achieving the benefits of Act 10 without having to rely upon the powers granted by Act 10 to local government bodies. If we’re to use upon history as our guide, Burke is unlikely to prove anything except that the passage of Act 10 by Governor Scott Walker and the legislature was necessary.

After the passage of Act 10, Madison teachers staged a massive “sick out” in order to protest Walker’s reforms. Despite a public statement from then-WEAC President Mary Bell to go back to work and a request by the Madison Metropolitan School District to cancel a scheduled day off, Madison’s teachers continued to stay out of work to continue the protest. In fact, a MacIver investigation discovered that John Matthews of Madison Teachers, Inc. lied about the union’s involvement in planning the protest.

Against that background, and a determination not to be bound by the terms of Act 10, the Madison teachers union and the school district negotiated the first contract extension into 2013. Instead of the 12.6 percent health care contribution called for under Act 10 and even supported by Bell, the district was only able to negotiate a 5 percent health care contribution. The agreement did allow an increase to 10 percent the following year.

“Wisconsin Together” – Merger Details Revealed

Having asked their national affiliates for permission, the Wisconsin Education Association Council and AFT-Wisconsin finalized the founding documents of a new merged state teachers’ union, to be called Wisconsin Together.
The representative bodies of both unions will vote on a new constitution and by-laws in April. If approved, the merger will go into effect on September 1.
AFT-Wisconsin has posted the full text of the documents on its web site, but here are a few of the highlights:
While Wisconsin Together will come into being in September 2014, it will have a two-year transition period during which the current WEAC president and the AFT-Wisconsin president will act as co-presidents.
One of the major differences between NEA affiliates and AFT affiliates is that the former practice term limits for executive officers while the latter do not. The new representative body of Wisconsin Together will decide the issue after September 2016.




Diminished in wake of Act 10, 2 teachers unions explore merger

acing reduced membership, revenue and political power in the wake of 2011 legislation, Wisconsin’s two major state teachers unions appear poised to merge into a new organization called Wisconsin Together.
The merger would combine the Wisconsin Education Association Council, the state’s largest teachers union, and AFT-Wisconsin, a smaller union that includes technical college, higher education and state employees, according to new draft documents.
At the same time, a national educators group that promotes itself as an alternative to unions — and has the backing of some conservative-leaning organizations — is picking up new members in Wisconsin.
The developments underscore the changing landscape for Wisconsin teachers unions since the passage of Act 10, which limits collective bargaining and makes it more difficult for unions to collect dues.
After Act 10, WEAC has lost about a third of its approximately 98,000 members and AFT-Wisconsin is down to about 6,500 members from its peak of approximately 16,000, leaders of both organizations have reported.
According to their most recent federal tax filings, WEAC collected about $19.5 million in dues in 2011, and AFT-Wisconsin collected about $2 million. Both have downsized staff and expenses.
The initial governance documents of Wisconsin Together, which include a transition document, constitution and bylaws, have been posted on AFT-Wisconsin’s website for members of both organizations to peruse. A final vote on whether to merge will be taken at a special joint assembly in Green Bay on April 26.




American Association of Educators Contacts Madison Teachers

Teachers in Madison recently received an email inviting them to join AAE, and for a very inexpensive fee. For only $15 per month, they say, one can be eligible to apply for a scholarship, receive a publication, and information on professional development. Plus, they claim none of their income will be spent on political action, and a member receives protection via liability insurance. The facts are, that none of what AAE offers is needed.

  • MTI negotiates a Collective Bargaining Agreement, and enforces the Collective Bargaining Agreement via grievance and arbitration.
  • MTI represents teachers who are challenged by the District.
  • The District is responsible by Statute to provide liability insurance and MTI members receive additional liability coverage provided through membership as a result of MTI’s
    affiliation with WEAC & NEA.
  • AAE is anti-union. They even tried to stop the Kenosha
    School Board from ratifying the new recently agreed-upon Contracts.
According to the Massachusetts Teachers Association, “The American Association of Educators, is a group backed by some of the deepest pockets in the anti-public education movement (think Koch brothers). The AAE is partnering with the National Right to Work Committee to encourage educators to give up their (Union) membership and join an organization that has affiliates covering just six states. Right-wing foundations provide nearly all of the money to (operate) the AAE Foundation.”
AAE was able to write to each Madison teacher because they obtained teachers’ email addresses via an open records request from the District.




Wisconsin public-sector unions report big drops in revenue

Total revenue for the Wisconsin Education Association Council, the largest union in the state, dropped from $26 million in 2011 to $20 million in 2012. WEAC, which represents 80,000 teachers across the state, has for years been a great force for the Democratic Party, providing millions of dollars on attack ads against Republicans on top of legions of volunteers.
The next largest public sector union, American Federation of State, County and Municipal Employees, has also taken a financial hit. AFSCME Council 40, which represents county and municipal workers outside of Milwaukee County, reported its gross revenue dropping from $6.7 million in 2011 to $4.5 million in 2012. Reports for some of the other large AFSCME Councils, including Council 24, which represents state employees, are not yet available online.
Revenue for the American Federation of Teachers, which in Wisconsin largely represents academic staff at the state’s universities as well as a number of white-collar state employees, dropped from just under $4 million in 2011 to $2.6 million in 2012.
The Service Employees International Union (SEIU) Local 150 — which represents many public sector healthcare professionals — saw its revenue drop from $937,000 to $783,000. Fortunately for that union, many of its members, including nurses at Meriter Hospital, are in the private sector, and are thus unaffected by Act 10.
The decrease in union money could spell serious trouble for Democrats as they try to recapture the governorship and gain seats in the state Legislature next year. Third-party ads in favor of Democrats are largely funded by labor, whether from individual unions or union-funded groups such as the Greater Wisconsin Committee or We Are Wisconsin.
With the largest unions bleeding dues, it will be hard for Democratic forces to compete with corporate-funded players on the right, such as Wisconsin Manufacturers & Commerce, which has already dumped $1 million into an ad buy celebrating Walker’s record as governor.

Act 10: Wisconsin Employment Relations Commissioners in Contempt of Court

Collective bargaining was restored for all city, county and school district employees by a Court ruling last week through application of an earlier (9/14/12) Court decision achieved by MTI. Circuit Court Judge Juan Colas found that Governor Walker’s appointees to the WERC, James Scott and Rodney Pasch, were in contempt of court “for implementing” those parts of Act 10 which he (Colas) previously declared unconstitutional, which made them “a law which does not exist”, as Colas put it.
The Judge told Scott & Pasch to comply with his finding of unconstitutionality or be punished for their contempt. They agreed to comply.
Judge Colas made his ruling on unconstitutionality on September 14, 2012. MTI was represented by its legal counsel, Lester Pines.
In the contempt claim, in addition to MTI, Pines represented the Kenosha Education Association and WEAC. The latter was also represented by Milwaukee attorney Tim Hawks, who also represented AFSCME Council 40, AFT Wisconsin, AFT nurses and SEIU Healthcare, in last week’s case. Also appearing was Nick Padway, who partnered with Pines in representing Milwaukee Public Employees Union Local 61 in the original case.
Judge Colas specifically ordered the WERC to cease proceeding with union recertification elections, which in his earlier ruling were found to be unconstitutional. Act 10 mandated all public sector unions to hold annual elections to determine whether union members wished to continue with representation by the union. Act 10 prescribed that to win a union had to achieve 50% plus one of all eligible voters, not 50% plus one of those voting like all other elections. The elections were to occur November 1.




Comments & Links on Madison’s Latest Teacher Union Agreement

Under the new contracts clerical and technical employees will be able to work 40-hour work weeks compared to the current 38.75, and based on the recommendation of principals, employees who serve on school-based leadership teams will be paid $20 per hour.
Additionally, six joint committees will be created to give employees a say in workplace issues and address topics such as planning time, professional collaboration and the design of parent-teacher conferences.
Kerry Motoviloff, a district instructional resource teacher and MTI member, spoke at the beginning of the meeting thanking School Board members for their collective bargaining and work in creating the committees that are “getting the right people at the right table to do the right work.”
Cheatham described the negotiations with the union as “both respectful and enormously productive,” adding that based on conversations with district employees the contract negotiations “accomplished the goal they set out to accomplish.”

Pat Schneider:

“Madison is in the minority. Very few teachers are still under contract,” said Christina Brey, spokeswoman for the Wisconsin Education Association Council. Fewer than 10 of 424 school districts in the state have labor contracts with teachers for the current school year, she said Wednesday.
And while Brey said WEAC’s significance is not undermined by the slashed number of teacher contracts, at least one state legislator believes the state teacher’s union is much less effective as a resource than it once was.
Many school districts in the state extended teacher contracts through the 2011-2012 school year after Act 10, Gov. Scott Walker’s law gutting collective bargaining powers of most public employees, was implemented in 2011. The Madison Metropolitan School District extended its teacher contract for two years — through the 2013-2014 school year — after Dane County Judge Juan Colas struck down key provisions of Act 10 in September 2012.
The contract ratified by the members Monday will be in effect until June 30, 2015.

On Thursday, the Wisconsin Institute for Law and Liberty emailed a letter to Cheatham and the School Board warning that a contract extension could be in violation of Act 10.
Richard Esenberg, WILL president, said he sent the letter because “we think there are people who believe, in Wisconsin, that there is somehow a window of opportunity to pass collective bargaining agreements in violation of Act 10, and we don’t think that.”
If the Supreme Court rules Act 10 is constitutional all contracts signed will be in violation of the law, according to Esenberg.
Esenberg said he has not read the contract and does not know if the district and union contracts have violated collective bargaining agreements. But, he said, “I suspect this agreement does.”

The contract does not “take back” any benefits, Matthews says. However, it calls for a comprehensive analysis of benefits that could include a provision to require employees to pay some or more toward health insurance premiums if they do not get health care check-ups or participate in a wellness program.
Ed Hughes, president of the Madison School Board, said that entering into labor contracts while the legal issues surrounding Act 10 play out in the courts was “the responsible thing to do. It provides some stability to do the important work we need to do in terms of getting better results for our students.”
Hughes pointed out that the contract establishes a half-dozen joint committees of union and school district representatives that will take up issues including teacher evaluations, planning time and assignments. The contract calls for mediation on several of the issues if the joint committees cannot reach agreement.
“Hopefully this will be a precursor of the way we will work together in years to come, whatever the legal framework is,” Hughes said.
Matthews, too, was positive about the potential of the joint committees.

WILL President and General Counsel Rick Esenberg warns, “The Madison School Board is entering a legally-gray area. Judge Colas’ decision has no effect on anyone outside of the parties involved. The Madison School Board and Superintendent Cheatham – in addition to the many teachers in the district – were not parties to the lawsuit. As we have continued to say, circuit court cases have no precedential value, and Judge Colas never ordered anyone to do anything.”
He continued, “If the Madison School District were to collectively bargain in a way that violates Act 10, it could be exposed to litigation by taxpayers or teachers who do not wish to be bound to an illegal contract or to be forced to contribute to an organization that they do not support.” The risk is not theoretical. Last spring, WILL filed a lawsuit against the Milwaukee Area Technical College alleging such a violation.

The essential question, how does Madison’s non-diverse K-12 governance model perform academically? Presumably, student achievement is job one for our $15k/student district.
Worth a re-read: Then Ripon Superintendent Richard Zimman’s 2009 speech to the Madison Rotary Club:

“Beware of legacy practices (most of what we do every day is the maintenance of the status quo), @12:40 minutes into the talk – the very public institutions intended for student learning has become focused instead on adult employment. I say that as an employee. Adult practices and attitudes have become embedded in organizational culture governed by strict regulations and union contracts that dictate most of what occurs inside schools today. Any impetus to change direction or structure is met with swift and stiff resistance. It’s as if we are stuck in a time warp keeping a 19th century school model on life support in an attempt to meet 21st century demands.” Zimman went on to discuss the Wisconsin DPI’s vigorous enforcement of teacher licensing practices and provided some unfortunate math & science teacher examples (including the “impossibility” of meeting the demand for such teachers (about 14 minutes)). He further cited exploding teacher salary, benefit and retiree costs eating instructional dollars (“Similar to GM”; “worry” about the children given this situation).




K-12 Governance Post Act 10: Kenosha teachers union is decertified; Madison Appears to Continue the Status Quo

The union representing Kenosha teachers has been decertified and may not bargain base wages with the district.
Because unions are limited in what they can do even if they are certified, the new status of Kenosha’s teachers union — just like the decertification of many other teachers unions in the state that did not or could not pursue the steps necessary to maintain certification in the new era of Act 10 — may be a moral blow more than anything else.
Teachers in Milwaukee and Janesville met the state’s Aug. 30 deadline to apply for recertification, a state agency representative says. Peter Davis, general counsel for the Wisconsin Employment Relations Commission, said the Milwaukee and Janesville districts will hold recertification votes in November.
To continue as the recognized bargaining unit in the district, 51% of the union’s eligible membership must vote in favor of recertification, according to the controversial Act 10 legislation passed in 2011.
With contracts that were in place through the end of June, teachers in the three large southeastern Wisconsin districts were protected the longest from the new legislation, which limits collective bargaining, requires unions to hold annual votes to be recognized as official entities, and mandates that teachers and other public employees pay more out-of-pocket for their health care and retirement costs.

“It seems like the majority of our affiliates in the state aren’t seeking recertification, so I don’t think the KEA is an outlier or unique in this,” Brey said.
She added that certification gives the union scant power over a limited number of issues they’d like a voice in.
Sheronda Glass, the director of business services in Kenosha, said it’s a new experience for the district to be under Act 10.

Contrary to some published media reports, however, the union did not vote to decertify.
In fact, no such election was ever held, according to KEA Executive Director Joe Kiriaki, who responded to a report from the Conservative Badger blog, which published an article by Milwaukee radio talk show host Mark Belling, who said he had learned that just 37 percent of the teachers had voted to reauthorize the union.
In a prepared statement, Kiriaki criticized the district for “promoting untrue information” to Belling.
Union chose to focus on other issues
Kiriaki said the union opted not to “jump through the hoops,” such as the recertification requirement, created by Act 10, the state’s relatively new law on collective bargaining.
The law, among other things required the annual re-certification of unions if they want to serve as bargaining representatives for teachers and other public workers. It also prohibits most public employees from negotiating all but base wages, limiting them to the rate of inflation.
Kiriaki cited a ruling by a Dane County Circuit Court judge on the constitutionality of Act 10, saying he believed it would be upheld.

Interestingly, Madison School District & Madison Teachers to Commence Bargaining. Far more important is addressing Madison’s long standing, disastrous reading results.
In my view, the unions that wish to serve their membership effectively going forward would be much better off addressing new opportunities, including charters, virtual, and dual enrollment services. The Minneapolis Teachers Union can authorize charters, for example.

A conversation with retired WEAC executive Director Morris Andrews.
The Frederick Taylor inspired, agrarian K-12 model is changing, albeit at a glacial pace. Madison lags in many areas, from advanced opportunities to governance diversity, dual enrollment and online opportunities. Yet we spend double the national average per student, funded by ongoing property tax increases.
An elected official recently remarked to me that “it’s as if Madison schools have been stuck in a bubble for the past 40 years”.




A Conversation with Morris Andrews

I thought about this conversation during a recent drive through a “de-industrialized” city. I observed beautiful buildings, boarded structures, a well attended park event via a free lunch program, a jobless center across the street, emerging strip malls and a nearby Planned Parenthood facility (with protesters).




Spending by Wisconsin unions on lobbyists plummets, records show

In just two years, spending by the state’s public employee unions on lobbyists has plummeted from the summit of Wisconsin politics, leaving business interests uncontested at the pinnacle of Capitol lobbying, a new report shows.
The figures show the Wisconsin Education Association Council, the state’s largest teacher union, spent nearly $2.1 million in the first six months of 2011 and $1 million in the first half of 2009, but a mere $84,000 in the first six months of this year. The union is spending less than one-tenth of what it once did.
The preliminary lobbying figures from the Government Accountability Board released this week are just the latest sign of the deep impact of Act 10, Gov. Scott Walker’s 2011 law repealing most collective bargaining for most public employees. The new figures on who’s lobbying state lawmakers follow a recent Milwaukee Journal Sentinel report showing that this same law had crushed the membership and finances of government labor unions as well as eliminating most of their former duties.
The Wisconsin Education Association Council was first or second in spending on lobbying in legislative sessions over the past four years and reached the height of its lobbying efforts in the first six months of 2011, as labor leaders tried feverishly but unsuccessfully to block Walker’s legislation.
But for the first six months of 2013, a critical period in which Republicans sharply expanded taxpayer-financed private voucher schools, WEAC’s lobbying spending was nothing special when compared with the other groups that have filed their lobbying reports with state officials. The once heavyweight contender now ranks 40th in the total spending at the Capitol, with its lobbying so far this year almost exactly matching the spending by two other middleweight interests: Marquette University and a conservation group.

New Jersey’s largest teacher’s union has formed a Super PAC

The state’s largest teacher’s union has formed a new political advocacy group that can raise unlimited amounts of money from donors during the upcoming campaign season, according to federal and state filings.
The move by the New Jersey Education Association underscores a growing trend in the state as donors and interest groups turn to the federal tax code to avoid the state limits on campaign contributions.
The New Jersey Education Association formed Garden State Forward in March of this year, according to filings with the Internal Revenue Service. The NJEA already has a state political action committee, but a spokesman said the new group will allow the union to focus more on issues, less on specific elections.
“We established it so, if we wish, we can express issue advocacy with our members,” NJEA spokesman Steve Wollmer said.

The Voucher Lobby: Lobbying for school choice provides big money for Republicans

The word was out last year that Republican Assembly Speaker Jeff Fitzgerald intended to retire and make the big money working as a lobbyist. Two days after his term was up, he signed up as a lobbyist for School Choice Wisconsin.
Fitzgerald’s decision underlined the ironic facts of life in Wisconsin. Choice Schools may be badly underfunded, getting just $6,442 per pupil in public funding (about half of what public schools get), and may often pay lousy salaries to teachers. But those who lobby for school choice are doing just fine, thank you. Indeed, the pay is so good that three former Republican Assembly Speakers now do lobbying and advocacy for school choice.
The first to jump aboard the gravy train was former Speaker (and key figure in the legislative caucus scandal) Scott Jensen, who works for two Washington D.C.-based groups that work to increase School Choice funding: the American Federation for Children and the Alliance for School Choice, two sister organizations located at the same address, 1660 L Street NW, Suite 1000. Both groups have a key consultant, Chartwell Strategic Advisors, the one-man consulting company run by Jensen from his Brookfield home. In 2011, the most recent for which these groups filed federal income tax forms, Jensen earned $202,972, including $102,7346 from the American Federation for Children and $100, 236 from the Alliance for School Choice.
These groups have often worked to influence issues and elections in Wisconsin. A report by the American Federation for Children bragged that “With expenditures of $2,392,000, [AFC] engaged in hard-fought, successful battles to ensure educational choice majorities in both chambers of the Legislature” in Wisconsin, as the the Badger Herald reported.

Madison Teachers, Inc. “Patch Through” Voucher Phone Bank May 9

Thanks to the volunteers who helped make phone calls at MTI on April 23. With few volunteers, 51 callers were “patched through” to leave a message for Senator Sheila Harsdorf that voucher expansion is bad for Wisconsin and that public schools must be fully funded. The Governor’s proposed budget will take $96 million from public schools to fund private and parochial “voucher” schools and private charter schools.
This program was a great success in other Senate Districts as well, generating well over 200 contacts last week. Any member interested in giving this a try, another night of calling is being considered for Thursday, May 9, 4:30 – 7:30 p.m., at MTI. The constituents we are calling are targeted based on their likelihood to respond positively and include WEAC members and voters favorable to public schools. This fight is critical because if we lose, voucher schools will be coming to Madison, whether we want them or not, with slick marketing campaigns designed to lure tax dollars into their pockets by denigrating our public schools. Don’t let this happen! We need seven confirmed volunteers to make this set-up worthwhile.

K-12 Influence Spending in Wisconsin Political Races

Rarely has the political payoff for a special interest group been as quick or blatant.
The American Federation for Children, one of the leading advocates for school choice in the country, brags in a recent brochure that it spent more than $325,000 – far more than the group has previously made public – to help elect state Sen. Rick Gudex in a closely contested Wisconsin race last fall.
Gudex won his seat by less than 600 votes.
Then, last week, the freshman lawmaker joined two other Senate Republicans in saying they were drawing a line in the sand by vowing to oppose a state budget bill if it doesn’t include an expansion of the state’s school voucher program.
“The American Federation of Children got exactly what they wanted,” said Mike McCabe, head of the left-leaning election watchdog group Wisconsin Democracy Campaign. “They want legislators who will go to the mat and make expanding the voucher program the bottom line.”
Just as interesting, McCabe said, is that the school choice organization is saying in its own material that it spent twice as much helping Gudex as it reported to state regulators. McCabe said his group is looking into filing an election complaint.
A source familiar with the American Federation’s political spending in Wisconsin called such a complaint “frivolous.” The organization, the source said, had abided by Wisconsin election laws.

Lobbying and Wisconsin $chools

In 2011-12, GAB numbers show, Wisconsin contract lobbyists (hired guns) were reportedly paid $30.8 million. Meanwhile, in-house lobbyists (lobby group employees) reported their lobbying-related compensation at $24.3 million. Other lobby costs came to $7.8 million.
The session’s highest rollers, spending a total of $6.3 million, were public employee unions — Wisconsin State AFL-CIO, Wisconsin Education Association Council and AFSCME Council 11. Tellingly, 94% of this flowed forth in 2011, when the unions were fighting changes that would weaken their power; just 6% came in 2012, after these changes were made.
Other big spenders in 2011-12 include Wisconsin Manufacturers & Commerce, Wisconsin Hospital Association, AT&T Wisconsin, Wisconsin Medical Society, Wisconsin Property Taxpayers Inc. and Wisconsin Counties Association. All came in between $750,000 and $1 million. They were among more than 50 groups to top the $250,000 mark.
In terms of time spent, Wisconsin Property Taxpayers, a “property tax relief and reform” group, led the pack with 13,267 hours. A quarter of this, the largest share, went toward backing new state rules on metallic mining. Those efforts failed in 2011-12 but sailed through this year.
Other big players, time-wise, were the three aforementioned unions and AFSCME International, Wisconsin Independent Businesses, Wisconsin Association of School Boards, Wisconsin Manufacturers & Commerce, and the Wisconsin Hospital Association. All racked up more than 7,500 lobby hours.
In all, state groups reported 432,255 hours of lobbying — the equivalent of 100 people working full time over these two years.

A remarkable amount of money is spent on education lobbying. In 2010, WEAC spent $1,570,000 in an effort to re-elect four state senators. That is quite a statement and illustrates how things roll in the education world. Richard Zimman’s 2009 Madison Rotary Club speech is well worth reading.




Madison Urban League’s 2013-2014 Strategic Plan

Between January 1, 2011 and December 31, 2012, the Urban League of Greater Madison stood on the firm shoulders of its founders – Leslie Fishel, Jr., Sydney Forbes, Isobel Clark and Frank Morrison – and demonstrated exceptional courage and foresight by launching a well-orchestrated campaign to raise the community’s consciousness about an embarrassing and unconscionable racial achievement gap that is leaving hundreds of Black, Latino and Asian children behind each year. We also informed the community about the acceleration of middle class families moving their children out of Madison’s public schools, either through relocation or utilizing the state’s inter-district public school choice program. Between 1989 and 2012, the student population in Madison schools grew from 24% non-white to 55% non-white. We also began an aggressive campaign to enlist the support of businesses, education institutions, community partners and resource providers to expand workforce development and career training opportunities for unemployed and underemployed adults in Dane County, and address diversity and inclusion opportunities among them.
The public should consider our 2013-14 Strategic Plan to be Phase II of the League’s efforts to provide courageous and transformational leadership to ensure thousands more children, adults and families succeed in our schools, colleges, workplaces, neighborhoods and communities. In 2020, the Urban League of Greater Madison would like local citizens and the national media to report that Madison, Wisconsin has indeed become “Best [place] in the Midwest for Everyone to Live, Learn and Work”. Early returns on the investment made thus far indicate that our vision can become a reality.
This Strategic Plan covers a 24-month period, from January 1, 2013 through December 31, 2014. We believe shorter time-windows enable us to keep the organization focused on achieving a reasonable number of high impact goals, and with the appropriate sense of urgency necessary to produce the results it seeks and the community needs. As our nation has demonstrated extraordinary courage and overcome extraordinary challenges in years past, we will do so again.

The Urban League’s Board of Directors is interesting in its breadth. Mo Andrews, architect of WEAC’s rise is an interesting member.




Is Madison having a truly open dialogue about the schools’ achievement gap?

Can you have a public discussion on closing the achievement gap in Madison without inviting Kaleem Caire, the architect of a would-be charter school plan that pushed the issue of the Madison School District’s persistent race-based gap to the front burner of local civic debate?
Caire, CEO of the Urban League of Greater Madison, is not on the roster for the March 13 installment of Ed Talks Wisconsin, a UW-Madison-sponsored series on current education topics, when a Madison panel will discuss “Closing the Achievement Gap: Toward a Community-Wide K12 Agenda.”
Joel Rogers, director of the Center on Wisconsin Strategy, the equity advocacy group that organized the achievement gap panel discussion, said Monday that the presentation was conceived as a response to Caire’s education forum featuring such lights of the “school reform” movement as Geoffrey Canada, John Legend and Howard Fuller. At that two-day event last December, people heard a lot of talk promoting charter schools and greater teacher accountability as the answer to lagging performance by students of color.
“We wanted voices of people who think that, whatever its defects, public education is important in the 21st century,” Rogers said, adding that Madison Mayor Paul Soglin urged him to organize a program.
For his part, Soglin said that Caire has organized a number of discussions, like December’s “Educate to Elevate,” and “he did not invite anyone with different opinions on charter schools to participate.”

The achievement gap presentation in Ed Talks was in response to the Urban League’s education summit, but other programs in the eight-day series were suggested by a variety of other groups as early as last fall, organizer Sara Goldrick-Rab [SIS], an associate professor in the School of Education, told me.
The final event on March 21 is part of a two-day educational policy conference that the university has hosted for years, she said.
Ed Talks is funded by some $5,000 in donations from a variety of university entities, but some $8,000 in funding for the educational policy conference includes $300 from the local branch of the American Federation of Teachers and $500 from WEAC, Goldrick-Rab said.

Who are You Bargaining For?

The question of the day is: WHY is the SPEA Negotiating Team dragging out negotiations for 2012-13 (Hello! We’re beyond the midway point! Time to start working for 2013-14!!!)
The school board offered a very fair package which addresses what SPEA (and WEAC) have declare o be a primary mission: raising the starting wage for teachers. But that’s not good enough. You see, in order to do that with the pot of money available, a significant portion must be earmarked for those teachers with 1-6 years of experience. That means that a small amount would be available to more tenured teachers, most n the form of a stipend (as opposed to a base salary builder).
It’s called compromise, people! You are getting to do some serious good for starting teachers. But you’re not willing to accept that because this plan calls for either a small token stipend (or perhaps nothing) for those teachers that already earn like…say…$86,000 in base salary. REALLY? Is THAT what unions are all about?

CT: How has the method changed?
Bell: Literally it is member to member. It’s every member of the union talking to other people in those positions, reinforcing to them that collective action and collective advocacy is more than a collective bargaining agreement. Don’t get me wrong — I believe in collective bargaining and believe it’s a right our members ought to have, but shy of restoring it at the state level, collective advocacy is what the union is all about.
CT: And how has the “collective advocacy” changed?
Bell: We’re working more with organizing our members to engage their communities.
CT: Could you give me an example?

MTI Again Overturns Governor Walker’s Legislation

MTI was again successful in challenging legislation forced through the Legislature by Governor Walker. Dane County Circuit Court Judge Amy Smith agreed with MTI’s argument that Act 21, as it pertains to the State Superintendent, is unconstitutional.
Act 21 was created to enable the Governor to control all state agencies’ creation of Administrative Rules. Historically an agency wrote a proposed Administrative Rule, sent it to the Legislature which held a hearing, and if no modifications were made, the Administrative Rule became law. Act 21 mandated that a Agency send a “proposed” Administrative Rule to the Governor, who could change it before it could go to the Legislature. Walker even forced his appointees to the Wisconsin Employment Relations Commission to make the calculation of “base wage” for teachers even more restrictive than WERC had proposed.
MTI’s challenge to Act 21 was based on the fact that the State Superintendent is a Constitutional Officer – has been since 1848. Based on that, and that the Wisconsin Supreme Court previously ruled that the State Superintendent has the authority not only to “advocate, but (is) an officer with the ability to put plans into action”, MTI, joined by WEAC, claimed that as a Constitutional Officer the State Superintendent is equal to, not subordinate to, the Governor. Judge Smith agreed, and voided that part of Act 21, as it applied to the State Superintendent.

Wisconsin Education Rule-Making Battle: Should We Care? Yes; DPI Election Politics



Why should parents, citizens, taxpayers and students pay attention to this type of “rulemaking” case?
WKCE (Wisconsin’s oft-criticized soft academic standards – soon to be replaced) and MTEL-90 (Wisconsin adopts Massachusetts’ teacher content knowledge requirements).
I found Ed Treleven’s article interesting, particularly the special interests funding the rule making legal challenge. I am a big fan of our three part government system: judicial, legislative and executive. That said, the Wisconsin DPI has not exactly distinguished itself over the past decade. The WKCE “tyranny of low expectations” is exhibit one for this writer.

Even before the change in the law, rules ultimately have to be approved by the Legislature.
Democrats had labeled the law a power grab by Walker when it was proposed after Walker was elected and before he took office. He signed it into law in May 2011.
The ruling came in a lawsuit brought by Madison Teachers Inc., the Wisconsin Education Association Council and others. Defendants were Walker, DOA Secretary Mike Huebsch and schools superintendent Tony Evers. Smith’s decision, however, notes that Evers also asked the court to block the law. Evers issued a statement Tuesday saying he was pleased with Smith’s ruling.
Lester Pines, who represented the teachers groups in court, said the law as applied to DPI ran counter to a unanimous state Supreme Court decision in 1996 that said the Legislature cannot give equal or superior authority to any “other officer.”

Finally, it appears that current DPI Superintendent Tony Evers is ready to roll for the spring, 2013 election. I have noticed a number of DPI related inquiries on this site. Perhaps this will be a competitive race!
UPDATE: Gilman Halsted:

The Madison teachers union was one was one of seven plaintiffs that challenged this provision of ACT 21. Union President John Matthews says he’s pleased with the ruling.
“It’s simply because of the way the Constitution defines the role of the state superintendent,” he said. “The governor has equal authority not superior authority to the state superintendent and we think because of the enterprise if you will of public education that should not be a political issue. And Judge Smith saw it our way.”
But a spokesman for the governor’s office says he’s confident that Judge Smith’s ruling will be overturned on appeal and that the governor will retain his rule making veto power. Opponents of this new executive power see it as a power grab. And although this ruling appears to limit the governor’s power over rules that affect education it leaves his authority intact for administrative rules from any other state agency. State Superintendent Tony Evers released a statement hailing the ruling and pointing out that he had proposed language that would have carved out his exemption from the governor’s rule vetoes before the law was passed.

Flyer targets Janesville teachers

School officials are outraged by a flyer that’s calling some of its teachers “radical” and suggesting they’re bringing their politics into the classroom.
“I was flabbergasted. I was outraged that they would have that flyer. I was really surprised,” said Dr. Karen Schulte, the Janesville School District superintendent.
About 2,500 copies of the flyer went out to people in Janesville over the weekend.
It asks how much WEAC teachers make in the Janesville School District, then lists the names of more than 300 teachers and their salaries, ranging from $59,000 to $75,000.
“It does affect teachers’ morale. I think it affects all of our morale when educators are being vilified in this manner,” Dr. Schulte said.

Janesville teachers and their supporters expressed outrage this week after an anonymous group distributed fliers listing their salaries and urging parents to request their child be assigned to a “non-radical teacher” next year.
The fliers, which included the names, titles and salaries of the 321 highest-paid Janesville teachers, also urged readers to go to iverifytherecall.com to determine if the teachers signed the petition to recall Gov. Scott Walker.
Orville Seymer, an open records specialist with the conservative Milwaukee-based activist organization Citizens for Responsible Government, said the group responsible for the flier has asked to remain anonymous “for obvious reasons.”
On behalf of the anonymous group, Citizens for Responsible Government filed an open records request with the Janesville School District seeking teacher names, salaries and titles. Seymer provided the information to the anonymous group, but was not involved in drafting or distributing the fliers, he said. No other requests of a similar nature have been filed with other districts, Seymer added.

But in researching the history of this battle over the surveys, I came across something much more illuminating and – let’s face it – entertaining.
When the governor first began making his claims of improved schools last fall, WEAC reacted in the traditional manner – by drawing up talking points. One memo, dated November 29, is still posted on the web site of the West Allis-West Milwaukee Education Association. It’s not unusual, until you get to the sample statement/press release that locals were supposed to use as a model. I repost it here in its entirety – warts and all:

Wisconsin superintendents survey last fall found state budget cuts prompted school districts to eliminate thousands of staff positions, increase class sizes, raise student fees and reduce extracurricular offerings this school year.
But this week, Gov. Scott Walker’s office said those results don’t tell the full story and that similar surveys from past years show school districts fared better after his education changes went into effect.
Further, the governor’s office contends the organizations that conducted those surveys — the Wisconsin Association of School District Administrators and the Wisconsin Education Association Council — were unhelpful, and in WEAC’s case actually worked against the administration as staff tried to compare recent results to past surveys.
“It’s unfortunate that WEAC stands in the way of survey data that they have released in the past, which shows the governor’s changes are working and are good for their members and the state’s schoolchildren,” said Cullen Werwie, Walker’s spokesman.
The older surveys show more school districts increased class sizes, reduced extracurricular programs, raised student fees and tapped reserves to balance their budgets in each year between 2002 and 2008 than they did in 2011-12.
In past years, about two-thirds to three-quarters of districts reported increasing student fees each year. This year, 22 percent of districts reported doing so.

A Madison Teachers Inc. endorsement hasn’t always guaranteed victory for Madison School Board candidates.
But this year, with union members mobilized by Gov. Scott Walker’s collective bargaining changes, the upcoming recall elections, a divisive debate over a charter school proposal the union opposed and a looming rewrite of employee work rules, the endorsement could be influential.
“It will be very hard for someone not endorsed by the teachers union to win,” said former School Board member Ruth Robarts, who won re-election in 2004 despite MTI labeling her “Public Enemy No. 1.”
Robarts is one of four candidates in 13 contested races over the past decade who defeated MTI-backed candidates.
This year the union endorsed incumbent Arlene Silveira over Nichelle Nichols, an executive at the Urban League of Greater Madison, which proposed the charter school plan.
The union also endorsed Michael Flores, who gained attention during Capitol protests last year, over Mary Burke for an open seat being vacated by Lucy Mathiak.

Teacher union influence can extend far beyond local school board elections. The influence process can be quite sophisticated and encompasses local and state elections along with the legal system. Teachers are certainly not the only groups to pull different levers, but a complete understanding of the K-12 governance model requires an awareness of the players (it is also useful to consider the “schw­er­punkt“, that is “creating a result around a central theme”).     To make matters more dire, the long-term legislative proposal specifically exempts school district arbitrations from the requirement that arbitrators consider and give the greatest weight to revenue limits and local economic conditions. While arbitrators would continue to give these two factors paramount consideration when deciding cases for all other local governments, the importance of fiscal limits and local economic conditions would be specifically diminished for school district arbitration.

    “Beware of legacy practices (most of what we do every day is the maintenance of the status quo), @12:40 minutes into the talk – the very public institutions intended for student learning has become focused instead on adult employment. Adult practices and attitudes have become embedded in organizational culture governed by strict regulations and union contracts that dictate most of what occurs inside schools today. Any impetus to change direction or structure is met with swift and stiff resistance. It’s as if we are stuck in a time warp keeping a 19th century school model on life support in an attempt to meet 21st century demands.” Zimman went on to discuss the Wisconsin DPI’s vigorous enforcement of teacher licensing practices and provided some unfortunate math & science teacher examples (including the “impossibility” of meeting the demand for such teachers (about 14 minutes)). He further cited exploding teacher salary, benefit and retiree costs eating instructional dollars (“Similar to GM”; “worry” about the children given this situation).

THE BAD OLD DAYS OF COLLECTIVE BARGAINING: Why Act 10 Was Necessary for Wisconsin Public Schools

Not so long ago, the Wisconsin Education Association Council (WEAC), the state’s largest teachers union, sported the motto, “Every child deserves a great school.”
The irony of that motto was not lost on school administrators, particularly in more recent years, as they struggled to balance budgets while local WEAC unions refused to accept financial concessions that would have helped maintain quality programming for students.
In school district after school district, layoffs have occurred, class sizes have increased and student programs have been cut, partially because many
unions refused to accept temporary pay freezes, or pay a bit more toward their own health insurance or pension costs.
This was happening all over the state, even before Gov. Scott Walker was elected and his biannual budget slowed the rate of state aid to schools.
The problem is not difficult to understand. Most public school administrators tell us they spend between 75-85 percent of their total budgets on labor costs, mostly for salaries and benefits for union teachers. If a budget crisis hits and spending cuts are needed, school boards will logically look at the biggest part of the budget.
But under the old collective bargaining system, local teachers unions had broad legal power to reject cuts in labor costs, and frequently did so. With 80 percent of the budget often untouchable, school boards had little choice but to cut from the 20 percent that has the most profound effect on students.
Something is definitely wrong with that picture, if you believe that schools exist primarily to benefit children.




More Election Tea Leaves: UW-Madison Ed School Dean on K-12 Tax & Spending: Defunding and privatization threaten public schools

Public education currently stands under twin towers of threat — de-funding and privatization. This is consistent with a conservative agenda to eliminate many public programs — including public education.
In Wisconsin, school districts have been under strict limits on their revenues and spending since 1993. These limits have not kept pace with the natural increases in the costs of everyday things like supplies, energy and fuel. So every year, local school board members and administrators have had to cut their budgets to comply with spending limits. Throughout these years, school boards and administrators have done an admirable job of managing these annual cuts, but taken together, reductions in programs and staff have had a significant and very negative impact on our schools and the education they can provide to children.
Unfortunately this year, these same districts have received the largest single budget cut in Wisconsin history. For example, high poverty aid was cut by 10 percent during a time when poverty in children has increased in Wisconsin. As a result, schools are cutting programs and staff. According to the Wisconsin Department of Public Instruction data, the cuts in 2012 are greater than the two previous years combined. These cuts will be compounded when next year’s cuts come due.

Let me tell you a bit about why I’m running and what issues the Board faces.
Public schools face unprecedented challenges. Republican presidential candidate Rick Santorum recently called public school systems “anachronistic.” Walker’s budget contains the biggest cut to education in Wisconsin history.
Here in Madison, the Board of Education faces many significant issues: an upcoming budget with a multi-million dollar deficit; children of color, often living in poverty, who do less well in school and graduate at lower rates and a difficult transition from collective bargaining agreements, which Walker eliminated, to a personnel “handbook” that will define our relationships with teachers and staff.
When our schools face multiple challenges, board members must have the backbone to focus on what is most effective in helping all children learn and achieve. We must prioritize initiatives that provide the biggest bang for our buck. When there are hard choices to be made, we owe it to the children we serve to engage in respectful debate in order to find solutions.
I approach my work on the board from many perspectives: as a parent, businessperson, taxpayer and advocate for public education. I will continue to fight against assaults on public education, whether they are attempts to privatize public education or ones that demonize teachers.

UW profs shed light on ALEC’s threat to public education

University of Wisconsin-Madison professors Julie Underwood and Julie Mead are expressing concern over the growing corporate influence on public education in an article published Monday.
In particular, they are highly critical of the American Legislative Exchange Council (ALEC), which connects conservative state legislators with like-minded think tanks, corporations and foundations to develop “model legislation” that can be enacted at the state level.
Underwood is the dean of UW-Madison’s School of Education, while Mead chairs the ed school’s department of educational leadership and policy analysis. The two make their opinions known in an article they co-authored for the March issue of Phi Delta Kappan magazine, which serves members of the PDK professional organization for educators.
Underwood says much of the information in the article is an outgrowth of research she conducted while helping get the ALECexposed.org website up and running last summer.

Wisconsin Education Association Council draws flak over its endorsement of Kathleen Falk

he state teachers union is taking criticism from some members around the state for an early endorsement of Kathleen Falk [blekko] in the likely recall election against Gov. Scott Walker but is sticking with the decision.
Since the announcement of the Falk endorsement, the criticism of it has included a website soliciting signatures to have Wisconsin Education Association Council change its mind.
John Matthews, executive director of Madison Teachers Inc., the second-largest member union within WEAC and a union with members in the heart of Falk’s home county, said the endorsement came before it was clear whether there would be other challengers to Walker. He said his union would wait to make its own endorsement.
“We have a lot of our members who wish they would have waited until all the candidates were known. I think they made the wrong decision but I don’t see how they can get out of it,” Matthews said of WEAC.

What is this Voucher Loophole?

Last Friday’s Capital Times included an article by Jessica Van Egeren on the need to close what DPI spokesman John Johnson and others have deemed the voucher loophole. Van Egeren writes:
“The so-called loophole was inserted into the state budget at the final stage of approval in June by members of the budget-writing Joint Finance Committee. The last-minute language allowed voucher schools to expand from their sole location in Milwaukee to Racine.”
It is worth pointing out that the while the language enabling the expansion of school choice to Racine did occur near the end of the budget process, expanding the Milwaukee Parental Choice Program (MPCP) to Racine was hardly a new concept. A proposal to bring vouchers to Racine was included and passed in the original Assembly version of the 2007-2009 budget (it was eventually removed during the budget process).




January 16, 2012 Reaction to WPRI’s Report on Teacher Compensation

Unsurprisingly, the new WPRI report on reforming teacher compensation (authored by yours truly) has some critics. The response from the Wisconsin Education Association Council (WEAC) in today’s Journal Sentinel was disappointing, but totally expected. WEAC calls my proposal a distraction. President Mary Bell states it is unfair to administrators who, among other things, do not have time to “develop a system for distributing funds.”
Opposition from WEAC to $50 million in new funding for teachers on the grounds that administrators will not have the time to find a way to spend it was a surprise. The real threat of the proposal, I imagine, is that it ties additional funding to school performance, and allows principals in successful schools to manage as they see fit.




Union leaders see changed landscape even if Dems prevail in 2012

Public employee union leaders Mary Bell and Marty Beil say the collective bargaining restrictions on their members enacted this year have galvanized the state’s labor movement and paved the way for victory in potential recall elections in 2012.
But even if Dems are swept into the governor’s office and the Senate majority, the union heads say they aren’t necessarily seeking a complete return to the way things were before February.
“There has to be some changes … has to be some tweaking there,” said Beil (left), executive director of the Wisconsin State Employees Union. “But certainly not tweaking in the areas of the unions being able to bargain collectively for wages, hours and working conditions.”
Bell, leader of the Wisconsin Education Association Council — the state’s largest teachers union — added she’s simply hoping for a collective bargaining environment that ensures the voice of workers and “whether that is the law we had or the law that we needed even then, I think, is the question.”
“But the most important piece of this is that if you’re going to make that kind of significant change, you do not do it without a conversation among the people that are affected,” Bell told a WisPolitics.com luncheon. “That’s what’s been so offensive about the last year.”




Who wants to be a teacher?



Leon Young:

America now finds itself at an interesting crossroads. Over the next few years, it is estimated that this country will need one million new teachers, as more and more baby boomers begin to retire. (A baby boomer is a person who was born during the demographic Post-War II baby boom and who grew up during the period between 1946 and 1964.)
This impending shortfall of public educators is further exacerbated by the disturbing national trend that has severely undermined job security for many public-sector employees by restricting, or outright prohibiting workers from engaging in the collective bargaining process.
As we have seen, Wisconsin has become the embarrassing leader of the political attack now being orchestrated against the poor and working-class families in this country. But vilifying teachers is nothing new for the Badger State. Former Governor and now U.S. Senate hopeful, Tommy Thompson used teachers and its union (WEAC) as convenient political scapegoats back in the 1990s. He succeeded in making the case that state property taxes were so out of whack, solely as a result of the exorbitant salaries and benefits being afforded to teachers. Talk about pure political demagoguery!




Minneapolis teacher’s union approved to authorize charter schools

The Minneapolis teachers’ union has become the first in the nation to win the right to authorize charter schools.
State officials have approved the Minneapolis Federation of Teachers as a charter school authorizer.
Authorizers don’t run charters; they oversee the administrators and school boards that handle day-to-day operations of a charter school. Authorizers are also primary decision makers on which schools to sponsor.
During the 20-year history of charter schools there have been examples of teachers starting schools, and some charters have unionized teachers.
MFT will be the first union to serve as a charter sponsor. Formally, it has created an organization called the Minnesota Guild of Charter Schools (informally ‘the Guild’) that will serve as authorizer.

This makes sense. I hope we see much more of this.

Wisconsin needs a new system of school accountability, but implementing effective measures will be difficult because there are so many different ideas about what it takes to make a good school.
The best schools have high standards in the basics – reading, math, science and writing. But they also excel at art, music and gym. They are places with strong leadership, inspired teachers and an organic system of training and mentoring.
To create more such schools and hold all schools accountable in a fair manner, though, requires all those with an interest in that issue to be at the table. Unfortunately, that’s not the case now.
When Gov. Scott Walker and State Superintendent Tony Evers formed a team to improve school accountability, the Wisconsin Education Association Council chose to sit this one out.
We get it: The state’s largest teachers union has plenty of reason to be upset with Walker for stripping it and other public employee unions of their collective bargaining rights – and for cutting funding to schools. But we still think the union’s refusal to take a place at the table was a mistake. The union needs to be involved in such efforts. Now, it’s on the outside looking in.

Anyone following what’s been happening in Wisconsin’s public schools can see what Gov. Scott Walker’s $1.6 billion budget cut and extreme policies have meant for our students and communities.
Across the state, class sizes are on the rise and students have fewer opportunities — including in key areas such as reading, math and science.
Walker has taken an ax to our public schools, while at the same time increasing taxpayer funding of private schools. He’s turned his back on the Wisconsin tradition of valuing public education. As a result, his extreme policies are hurting our students.
The governor says everything is fine, but we can see for ourselves that he’s not telling the whole story. With 97 percent of local school districts receiving less state aid this year, and a promise of more cuts next year, local schools will continue to struggle.

The movie event, including the popcorn, was sponsored by Vos, who co-chairs the Legislature’s Joint Finance Committee — and owns a popcorn company.
Co-sponsors were Education Committee Chairs Sen. Luther Olsen, R-Ripon, and Rep. Steve Kestell, R-Elkhart Lake. Olsen is one of the lead sponsors of the charter authorizing bill, introduced in the Legislature last spring and currently before the Joint Finance Committee.
Panelists for the discussion included Gov. Scott Walker’s policy director, Kimber Liedl; the president of Milwaukee-based St. Anthony School, Zeus Rodriguez; the Urban League of Greater Madison’s charter school development consultant, Laura DeRoche-Perez; and a former president of Madison Teachers Inc., Mike Lipp, who is currently the athletic director at West High School.
There were also a number of panelists who were invited but did not attend, including state Superintendent Tony Evers, Madison Superintendent Daniel Nerad, state Rep. Sondy Pope-Roberts and a representative from WEAC, the state’s largest teachers union.




Wisconsin school districts adjust to canceled teacher convention

The annual state teachers union convention that has traditionally meant a two-day school holiday at the end of October is off this year, leaving public school districts with decisions about how to schedule students and teachers.
The Wisconsin Education Association Council canceled the convention, which would have been Thursday and Friday this week, after changes in state law weakened the union and its local affiliates.
Without the certainty of having input into school calendars through the negotiations process, members could not guarantee that they could all get the days off from school, said WEAC President Mary Bell, who added that the convention was “the flagship piece of professional development that we provided for members.”
Some school districts, with their calendars already set before the convention was called off, are keeping the school holiday for students but bringing teachers in for training or other activities. Others, such as Waukesha, are keeping the holiday and treating it as two unpaid days for teachers.

WEA Trust demands talk show host ‘cease and desist’

WEA Trust doesn’t like what Mark Belling has to say, and the health insurer wants the conservative talk show host to “cease and desist.”
WEA Trust, which bills itself on its website as a not-for-profit insurance group for Wisconsin public school employees and their families, today sent a letter to the afternoon, drive-time, radio host at 1130 WISN in Milwaukee, demanding Belling stop making what WEA Trust describes as “defamatory public accusations.
Belling repeatedly has accused the private health insurance company of “racketeering” by transferring its revenue to the Wisconsin Education Association Council, or WEAC, the state teachers union, an act that would be illegal under state and federal law.




Selling out public schools: Millions of dollars are changing face of education

“School choice” is a broad term that refers to a wide range of alternatives, including themed charter schools that are entirely under the control of their home school districts. Forty states and the District of Columbia have those in place, according to the American Federation for Children, a national school choice advocacy group.
But it is the voucher programs, in which public funds are used to send children to private schools, that are the focus of much of the energy around the choice movement. Seven states and the District of Columbia have those, and Milwaukee’s voucher program is the first and largest of its kind in the country. That makes Wisconsin a key national battleground.
“Wisconsin has a high level of value to the movement as a whole,” says Robert Enlow, president of the Indianapolis-based Friedman Foundation for Educational Choice, a nonprofit group that advocates for school choice. The state, he says, is notable for “the high level of scholarship amounts that families can get.”
Milwaukee’s voucher program had 20,300 full-time equivalent voucher students at 102 private schools in 2010-11, compared to about 80,000 students at Milwaukee’s public K-12 schools. The total cost, at $6,442 per voucher student, was $130.8 million, of which about $90 million came from the state and the rest from the Milwaukee Public Schools.
Critics see the school choice program as part of a larger strategy — driven into high gear in Wisconsin by the fall election of Gov. Scott Walker and other Republicans — to eviscerate, for ideological and religious reasons, public schools and the unions that represent teachers.

    Although there are 15 Democratic candidates running for the state Senate, and 80 Democrats running for the state Assembly, the latest WEAC report shows that the teachers union is placing what amounts to an “all in” bet on saving just four Democratic senators who are finishing their first terms.
    In an Oct. 25 report to the Government Accountability Board, the 98,000-member union reported that it will independently:

    Spending in the summer’s recall elections by special interest groups, candidates and political action committees shattered spending records set in previous elections, with $43.9 million doled out on nine elections, according to a study released Tuesday by the Wisconsin Democracy Campaign.
    Spending by six political action committees or special interest groups topped the $1 million mark. We Are Wisconsin was the top spender.
    The union-backed group spent roughly $10.75 million, followed by the conservative-leaning Club for Growth at $9 million and $4 million in spending from the Greater Wisconsin Committee.

Where GOP stands in war on Wisconsin Education ‘triangle’

The start of the school year isn’t normally the time for issuing report cards. But it’s been an unusual and momentous year, so as the first day of classes approaches for almost every school in the state, here’s a report card on what I’ll call the war against the triangle.
Last winter, before Scott Walker was sworn in as governor, a leading Republican told a group of people (according to a reliable person who was present) that there was a triangle that was blocking the path to educational improvement in Wisconsin and his party was going to take out each leg of the triangle.
What were the legs?
Teachers unions, particularly the Wisconsin Education Association Council. WEAC spent hugely on political campaigns and was pro-Democratic. It also was the largest lobbying force in the Capitol. WEAC represented the unwillingness of teachers organizations to change and the need to get rid of most collective bargaining matters.
The state Department of Public Instruction, which represented the status quo, overregulation of schools and how things couldn’t change if they were in the hands of government bureaucrats.
Milwaukee Public Schools, which represented – well, which represented Milwaukee Public Schools. Or, to put it another way, a money pit where there was never any positive change.




Teacher Union Controlled Health Care Provider WEA Trust: Have to Adapt – and Fast

Less than two months after a new state law took health benefits off the bargaining table for public workers and required them to pay at least 12.6 percent — up from zero, in some school districts — of their health insurance premiums, WEA Trust has lost a fifth of its business.
And that means big changes could be coming for the Madison-based group health insurer of mostly school districts that employs nearly 500.
“We’re going to have to adapt and adjust,” said Mark Moody, president and CEO of WEA Trust. “You can’t absorb a 20 percent loss and not do anything.”
The Trust, a not-for-profit company, provides health insurance to just over 100,000 employees in about 60 percent of the state’s 425 school districts.
It was created in 1970 by the state’s largest teachers’ union, the Wisconsin Education Association Council, or WEAC.
Critics have long accused the two bodies of working together to fleece taxpayers through over-priced contracts they say school boards have effectively been forced to sign under union pressure.

Public schools,” ALEC wrote in its 1985 Education Source Book, “meet all of the needs of all of the people without pleasing anyone.” A better system, the organization argued, would “foster educational freedom and quality” through various forms of privatization: vouchers, tax incentives for sending children to private schools and unregulated private charter schools. Today ALEC calls this “choice”– and vouchers “scholarships”–but it amounts to an ideological mission to defund and redesign public schools.
The first large-scale voucher program, the Milwaukee Parental Choice Program, was enacted in 1990 following the rubric ALEC provided in 1985. It was championed by then-Governor Tommy Thompson, an early ALEC member, who once said he “loved” ALEC meetings, “because I always found new ideas, and then I’d take them back to Wisconsin, disguise them a little bit, and declare [they were] mine.”
ALEC’s most ambitious and strategic push toward privatizing education came in 2007, through a publication called School Choice and State Constitutions, which proposed a list of programs tailored to each state.

“Public schools are under attack. There is a need for national, state, and local action in support of our schools. Wisconsin has been ground zero in this; the Save Our Schools demands from the Guiding Principles provide a great framework to build our state movement and work to expand opportunities to learn” said education activist Thomas J. The Save Our Schools demands are:

  • Equitable funding for all public school communities
  • An end to high stakes testing used for the purpose of student, teacher, and school evaluation
  • Teacher, family and community leadership in forming public education policies
  • Curriculum developed for and by local school communities

Doing more with less doesn’t work. “The time to act is now. While phony debates revolve around debt ceilings, students and teachers across the country are shortchanged. We need real reform, starting with finally fixing the school funding formula, and putting families and communities first. What child and what teacher don’t deserve an excellent school?” said rally organizer Todd Price, former Green Party Candidate for Department of Public Instruction and Professor of Teacher Education National Louis University.
The event will feature speeches from educators, students, parents and officials, as well as opportunities for school advocates from throughout Wisconsin to connect and organize around issues of importance in their communities.

Wisconsin Teachers Union won’t participate in statewide task force on school accountability reform

The state’s largest teachers union will not participate in discussions led by Gov. Scott Walker and State Superintendent Tony Evers to develop a new statewide school accountability system.
Instead, starting in September, the Wisconsin Education Association Council will collect input from teachers and communities around the state about their priorities related to school accountability, WEAC president Mary Bell said in a conference call Friday.
Bell said her organization supports Evers, but doesn’t trust Walker or Republican legislators on the task force.
“How can we trust the governor to be a credible partner on education issues when they just passed laws to make massive cuts to school funding and silence our voices in schools?” Bell said.
Bryan Kennedy, president of AFT-Wisconsin, said he also declined an invitation to participate.




Gov. Walker’s plan: ‘a slew of absurdities’

For generations, Wisconsin has taken pride in the opportunities we offer children through our public schools. When students or schools are struggling, we work together to find solutions.
Wisconsin is at the top when it comes to ACT and Advanced Placement scores and graduation rates, and just last month, significant gains on test scores were reported along with a narrowing of achievement gaps between minority groups. That’s a foundation that should be built upon, not dismantled.
Gov. Scott Walker’s education plan included in his state budget proposal will move our students and state backward. Whether you have children in a public school or not, whether you are Democrat, Republican or somewhere in between, children are counting on the state to do what’s right. Public education must remain a top priority.
For months, Wisconsinites have been telling their legislators that we believe there is a better way – a balanced way – to respond to tough fiscal times without throwing away our tradition of high-quality public education. Linda Copas of Plainfield pointed out to the Joint Finance Committee that in her small school district, the number of students who live in poverty has more than doubled, but the governor’s education plan ignores that. Kim Schroeder, a Milwaukee teacher, said his students are losing opportunities such as gym, art and music.




NEA Affiliates in California and Wisconsin Approach Lean Years Differently.

Falling enrollment, budget cuts and layoff have led to corresponding declines in membership for most National Education Association state affiliates. Without compensatory action, fewer members mean less dues revenue – a situation these unions have not had to face in recent memory.
As the numbers show quite clearly, even lean times do not mean NEA’s affiliates will become destitute. There is an awful lot of cash flowing through union headquarters around the country. But union officers and representatives are quick to find ways to spend it, particularly on their own employees. Adjusting budgets downwards is not their strong suit.
NEA itself had to revise its budget to account for membership loss and a smaller-than-planned increase in dues. It also froze the pay of its executive officers for the 2011-12 school year.
Two NEA state affiliates – California and Wisconsin – have different troubles to face in different political environments, so we shouldn’t be surprised that they are applying different measures to their fiscal problems.
The California Teachers Association sets its dues level by a formula that involves the average teacher salary over the last three years. With layoffs occurring almost exclusively at the bottom of the salary scale, it actually has the effect of driving up the state’s average teacher salary, and thus the dues level. With fewer members, CTA will raise its dues $8 next fall, to $647. This will mitigate the money lost, but not cover it entirely.

WEAC announced the cancellation of its fall convention, citing the uncertainty of whether it will be allowed to bargain the time off for its members. However, holding these events each year is also a budgetary drain, one that other NEA state affiliates have been forced to face.
Despite the serious state of financial affairs, WEAC is allocating up to $2 million for lobbying, legal action and internal communications in order to turn the political tide. It has, and will continue to receive, monetary and manpower assistance from NEA and other affiliates, including California.
These early signs indicate that the likely outcome of the collective bargaining battles in statehouses across the country is financially weaker teachers’ unions – but only relatively. Overall, there may be fewer members and fewer staffers. The unions may require special assessments or higher dues increases just to restore former revenues. But $1.5 billion annually is still an awful lot of money. We may see it applied in concentrated form on the unions’ existential issues, not diffused among feel-good projects.




Teaching reforms get lost in Wisconsin budget tumult

Early in February, leaders of the state’s largest teachers union took what was for them a major step – endorsing a series of reforms they had previously resisted, including performance pay, dividing up Milwaukee Public Schools and tying teacher evaluations to student test scores.
Within a week, however, Gov. Scott Walker released a plan to sharply curb the collective bargaining rights of most public-sector workers, and little more was heard from the Wisconsin Education Association Council about its reform initiatives.
Amid the debate over public workers’ rights in Wisconsin, school reform has gotten lost in recent months, especially changes related to one of the most promising ways to improve academic achievement: focusing on teacher effectiveness.
Walker and his supporters have said that by prohibiting teachers unions from bargaining for anything other than inflation-tied wage increases, school boards are free to implement reforms that WEAC has been unwilling to embrace in the past.




Labor’s last stand? Education reform will come at a cost

The new state law, held up pending a legal challenge, forbids most public worker unions from negotiating salary schedules, benefits and workplace rules with employers. It still allows bargaining over inflationary increases in “total base wages,” but generally makes it harder for unions to operate.
It also means school administrators would be able to make major changes to pay scales, school calendars and work rules without consulting teachers.
Mary Bell, president of the Wisconsin Education Association Council, the state’s largest teachers union, said that while teachers won’t necessarily obstruct changes, they are less likely to offer new ideas themselves if they are not covered by a union contract.
“Innovation takes risk,” Bell said. “Risk in an environment where your protection is gone is a much different proposition.”
Just days before Walker announced his changes to collective bargaining, WEAC had announced support for a statewide teacher evaluation system and performance-based pay. That overture, however, has been largely overshadowed by the union controversy.




Teachers will move forward

Wisconsin’s public school teachers and support staff are reeling after a week in which our state leaders put political ambitions before their constituents.
When the governor signed into law his unprecedented attack on workers’ rights, he did so amidst plummeting approval ratings and an intense and growing base of Wisconsinites who are outraged by the actions he is taking to destroy our great state.
Make no mistake, this disregard for public opinion and workplace rights will have a broad and lasting negative impact on our state’s future. From schools to hospitals to public services – and ultimately, to middle-class families across this state, the damage these actions set into place will be deep and wide.
On behalf of educators across our state, I remind you that weeks ago we accepted the financial concessions the governor asked for to help solve our state’s budget crisis. But we have consistently said that silencing the voices of workers by eliminating their collective bargaining rights goes too far.

Missing Wisconsin senators rely heavily on union campaign dollars

The 14 Wisconsin Democratic senators who fled to Illinois share more than just political sympathy with the public employees and unions targeted by Gov. Scott Walker’s budget-repair bill.
The Senate Democrats count on those in the public sector as a key funding source for their campaigns.
In fact, nearly one out of every five dollars raised by those Democratic senators in the past two election cycles came from public employees, such as teachers and firefighters, and their unions, a Journal Sentinel analysis of campaign records shows.
“It’s very simple,” said Richard Abelson, executive director of District Council 48 of the American Federation of State, County and Municipal Employees. “We have interests, and because of that, we attempt to support candidates who support our interests. It’s pretty hard to find Republicans who support our interests these days.”
Critics of Walker’s budget-repair bill say it would mean less union money for Democrats. That’s because the legislation would end automatic payroll deductions for dues and would allow public employees to opt out of belonging to a union.

Average Milwaukee Public Schools Teacher Salary Plus Benefits Tops $100,000; Ramifications

For the first time in history, the average annual compensation for a teacher in the Milwaukee Public School system will exceed $100,000.
That staggering figure was revealed last night at a meeting of the MPS School Board.
The average salary for an MPS teacher is $56,500. When fringe benefits are factored in, the annual compensation will be $100,005 in 2011.

On The Recent Madison Events

For the last five years Community and Schools Together (CAST) has worked hard to assure that students in Madison and around the state have access to excellent educational opportunities. With you, we have been amazed by the events at the Capitol this week. The massive outcry is justified. The radical changes contained in Governor Walker’s so-called budget repair bill will harm education and the future of our state.
The bill takes several unnecessary steps, such as limiting a union’s ability to collect dues. These steps have no relevance to budget repair, but are instead about damaging union effectiveness.
Making public education work relies on trust and partnership. Despite Wisconsin’s strong record on public education and despite all the benefits our communities receive from public education, Gov. Walker has decided to break trust and partnership with WEAC and other unions. In so doing, he has unnecessarily broken the state’s relationship with teachers. The outcry has been mobilized by the broad assaults to organized labor, but they are marked most visibly by the many teachers, parents, and students who have provided the core and bulk numbers to the strong protests.
We support the protests and are against the bill. The bill damages our ability as a community to improve our schools. The bill takes an existing, deficient educational policy regarding school funding, leaving caps and constraints on school boards to raise revenues locally, but denies collective bargaining – one of the key measures that was needed to form the original policy. We believe the net effect is extremely damaging to education – destroying a climate of trust and good will that has served as a cornerstone of the collective bargaining process. We may pay less in taxes, but teachers, classrooms and students will suffer.
Quality teachers are essential to quality education, removing their right to bargain collectively demonstrates great disrespect for their contributions and will make it more difficult to attract and retain the quality teachers our children need.
CAST, instead, welcomes reasonable and rational debate on educational funding and policy. We believe that policy should allow collective bargaining, equity, and the opportunity for community involvement to answer critical funding needs schools may have – given the likelihood that the state is unable to fund them appropriately.
CAST also calls for the safety of protesters and for those working to protect public safety at the Capitol. We ask Governor Walker and others responsible for state leadership to open debate, to seek to find rational budget policies that best represent the communities they serve. We look forward to our teachers and students returning to the classrooms, where together they create the foundation for Wisconsin’s future.

Minnesota caught up to us in 1967, and now the average Minnesotan makes $4,500 more than the average Wisconsinite.
Lift the math, science and reading scores of all K-12, non-special education students in Wisconsin above world-class standards by 2030. (emphasis added)
Wisconsinites often believe we lose jobs because of lower wages elsewhere. In fact, it is often the abundance of skills (and subsidies and effort) that bring huge Intel research and development labs to Bangalore, Microsoft research centers to Beijing, and Advanced Micro Devices chip factories to Dresden.

Grow the economy (tax base) and significantly improve our schools….




Wisconsin Teachers Union plan too late to help schools

Under its “performance pay” proposal, teachers would get more for staffing hard-to-staff schools and filling hard-to-fill positions. Pay would also be related to regular employee evaluations — if in some as-yet-undefined, possibly very weak way. WEAC president Mary Bell declined to specify how closely student test scores should track with evaluations and thus pay hikes, for instance.
Protecting pay is, of course, the most important of the union’s objectives in its reform plan. But pay is a function of how much money is available, and while WEAC is advocating paying better teachers better salaries, it’s not in favor of cutting pay for teachers who aren’t so good. This is about a bigger education pie, in other words, not about the same pie cut into different-sized pieces.
Pay is also a function of who’s handing out the raises, and WEAC is doing what it can to ensure those partly or mostly responsible for handing out the raises are as sympathetic as possible.
To wit, it would like to see the majority of the members on a teacher’s evaluation panel be teachers themselves — thus paving the way, it seems to me, for a lot of good reviews.
“It’s an extremely difficult task,” Bell said of evaluating one of your peers, but one that can work because “people care so deeply about the quality of the profession.”

Council: Strive for high grade points, not big political points

After Detroit, Milwaukee is the country’s most segregated city. The Milwaukee Public School District (MPS) has an endemic racial achievement gap, in which, in terms of aggregate statistics, African American students perform three to four years below their European American counterparts in both math and reading. Combine this with a general dearth of resources — as is common to virtually all of public education — and you have a recipe for inadequate schooling that is failing its almost 90,000 students.
The crisis in Milwaukee is indicative of the educational crisis roiling the nation. Across the United States, school districts are facing enormous budget deficits, decreasing enrollment and intense pedagogical and ideological debates questioning the very foundations of modern education. The debate is particularly vociferous here in Wisconsin, where the Wisconsin Education Association Council feels threatened by Governor Scott Walker’s educational platform. This past Tuesday, however, WEAC introduced a series of reforms it would endorse, many of which took observers by surprise, and received mixed reactions.
The reform drawing the most ire is the proposal to carve up MPS into multiple smaller districts to make them more manageable, and thus more successful. However, as pointed out by one observer, this separation of districts would probably mirror racial divisions within the city, compounding instead of alleviating racial achievement gaps.




Can Breaking the Milwaukee Public Schools Down Into Smaller Districts Work When Schools are Financially Dysfunctional on a Singular Level?

One of the biggest stories of the past week has been the Wisconsin Education Association Council’s recommendation to fragment Milwaukee Public Schools into smaller districts. According to WEAC, this would create “more manageable components” as well as “drive greater accountability within the system.” However, a look at how Milwaukee’s public schools operate as separate entities suggests that these schools will run into problems regardless of the size of their district.
In 2009, Milwaukee’s schools carried over operating debts of over $8 million into the new school year. Of the 148 schools surveyed in October of 2010, 93 (62.8%) finished the preceding school year in the red. 42 of these schools racked up debts of more than $100,000. 20 more overspent their budgets by $40,000 or more.
As the MacIver Institute has previously noted, schools like Bradley Tech (running a deficit of over $750,000), Vel Phillips (-$475k), Audubon Middle (-$436k), and Wedgewood (-$382k) are some of the city’s biggest offenders. While some schools have been able to create careful surpluses with their funds, the system as a whole has shown to be flawed. In all, the city’s school-by-school deficits added up to over $10.7 million dollars in 2009-2010 alone.




Wisconsin Teachers’ Union Proposed Education Reforms

State officers of the Wisconsin Education Association Council (WEAC) today unveiled three dramatic proposals as part of their quality-improvement platform called “Moving Education Forward: Bold Reforms.” The proposals include the creation of a statewide system to evaluate educators; instituting performance pay to recognize teaching excellence; and breaking up the Milwaukee Public School District into a series of manageable-sized districts within the city.
“In our work with WEAC leaders and members we have debated and discussed many ideas related to modernizing pay systems, better evaluation models, and ways to help turn around struggling schools in Milwaukee,” said WEAC President Mary Bell. “We believe bold actions are needed in these three areas to move education forward. The time for change is now. This is a pivotal time in public education and we’re in an era of tight resources. We must have systems in place to ensure high standards for accountability – that means those working in the system must be held accountable to high standards of excellence.”
TEACHER EVALUATION: In WEAC’s proposed teacher evaluation system, new teachers would be reviewed annually for their first three years by a Peer Assistance and Review (PAR) panel made up of both teachers and administrators. The PAR panels judge performance in four areas:

  • Planning and preparing for student learning
  • Creating a quality learning environment
  • Effective teaching
  • Professional responsibility

The proposed system would utilize the expertise of the UW Value-Added Research Center (Value Added Assessment) and would include the review of various student data to inform evaluation decisions and to develop corrective strategies for struggling teachers. Teachers who do not demonstrate effectiveness to the PAR panels are exited out of the profession and offered career transition programs and services through locally negotiated agreements.
Veteran teachers would be evaluated every three years, using a combination of video and written analysis and administrator observation. Underperforming veteran teachers would be required to go through this process a second year. If they were still deemed unsatisfactory, they would be re-entered into the PAR program and could ultimately face removal.
“The union is accepting our responsibility for improving the quality of the profession, not just for protecting the due process rights of our members,” said Bell. “Our goal is to have the highest-quality teachers at the front of every classroom across the state. And we see a role for classroom teachers to contribute as peer reviewers, much like a process often used in many private sector performance evaluation models.”
“If you want to drive change in Milwaukee’s public schools, connect the educators and the community together into smaller districts within the city, and without a doubt it can happen,” said Bell. “We must put the needs of Milwaukee’s students and families ahead of what’s best for the adults in the system,” said Bell. “That includes our union – we must act differently – we must lead.”

Madison’s “value added assessment” program is based on the oft-criticized WKCE examinations.

Teacher Licensure in Wisconsin – Who is Protected: The Parents or the Education Establishment?

It has been 10 years since Wisconsin overhauled an old set of rules for state teacher licensure (PI 3 and PI 4) and replaced it with a new set called PI 34. At the time of its approval in 2000, PI 34 was warmly welcomed by state leaders and legislators from both sides of the aisle. It was praised as a way to create a new generation of Wisconsin teachers.
The purpose of this report is to assess PI 34 in an effort to learn whether it has made good on these high expectations.
The underlying issue in this assessment has to do with occupational licensure. Why is it widespread in many states including Wisconsin? There are two viewpoints. The first is that consumers don’t have enough information to make judgments regarding the purchase of services from members of certain occupations. Licensure, according to this view, serves as a means to protect consumers from fraud and malpractice.
The second argument is made by economists. It opposes the first. Prominent economists claim that licensure benefits members of various occupations more than it benefits consumers. It does so by limiting access to the occupations in question, thus reducing competition. Those seeking protection from barriers of this sort believe that the various regulations will eventually enhance their incomes. The costs to consumers include reduced competition and restricted consumer choice.

PI 34’s weaknesses far outweigh its strengths. The weaknesses include the following:

  • PI 34 undervalues the importance of subject-matter knowledge in initial training programs for teachers and in teachers’ professional development activity.
  • PI 34 imposes an overwhelming regulatory system–dwarfing, for example, the regulatory system governing licensure for medical doctors.
  • PI 34 rules for licensure renewal fail to ensure that renewal will depend on demonstrated competence and professional growth. These rules create incentives for pro forma compliance, cronyism, and fraud.
  • PI 34 sets up high barriers (a single, proprietary avenue) for entrance into teaching. It makes licensure conditional on completion of approved training programs requiring, normally, at least two years of full-time enrollment in education coursework. Many highly trained professionals contemplating career changes are deterred by these requirements from becoming teachers, despite demand for their services.
  • PI 34 has no built-in measures for linking teacher licensure to teacher competence. Wisconsin has no evidence that any incompetent teacher has ever been denied licensure renewal.
  • PI 34 enables education producers (WEAC and the DPI) to dominate the licensure system. In this system, parents and students are marginalized.
  • PI 34 is particularly onerous for educators in large urban districts like Milwaukee, where producing academic gains is a challenging problem, and school principals, struggling to hire competent teachers, would benefit greatly from a flexible licensure system.

Wisconsin NAEP science results exceed national average

cience scores for Wisconsin students exceeded the national average on the National Assessment of Educational Progress (NAEP) science assessment, administered between January and March of 2009.
The state’s scale scores on the assessments were 157 at both fourth and eighth grades, eight points higher than the national scale scores of 149 for both grades. In state-by-state comparisons, Wisconsin’s results at fourth grade were higher than those in 27 states, not significantly different from those in 12 states, and lower than seven states. At eighth grade, Wisconsin’s results were higher than 27 states, not significantly different than 14 states, and lower than five states.

Today I am releasing the 2009 National Assessment of Educational Progress science results.
Students were assessed at the fourth, eighth, and twelfth grades. Over 156,000 students at grade 4, 151,000 at grade 8, and 11,000 at grade 12 took the assessment. We have national results for public and private school students at all three grades. At grades 4 and 8, we also have results for public school students in 46 states and the Department of Defense schools. The state samples were combined and augmented with sampled students from the four non-participating states plus the District of Columbia, along with a national sample of private school students, to create the full national samples for grades 4 and 8. The twelfth-grade sample is smaller because there are no state-representative samples at that grade.

Teachers unions often resist school reforms

The Obama administration could not have set the stage for a better demonstration of the power and priorities of Wisconsin’s teachers unions.
With its Race to the Top competition, the federal government dangled the prospect of a share of $4.35 billion for those states ready to enact reforms, especially related to improving teacher and principal performance.
Eyes on that prize, states launched plans tying teacher pay and promotions to student achievement, giving state officials more control over local schools and overhauling data tracking and assessment systems.
Then the game got tricky: Teachers unions had to be on board.
In the end, only 11 states and the District of Columbia ended up with money from the program this year. Wisconsin got nothing.
The Wisconsin Education Association Council had helped kill or watered down critical parts of the state’s proposal, with the president of the teachers union attaching a letter to the application that one participant described as “grudging.” In the end, only 12% of the union’s local leaders endorsed a plan that might have brought in more than $250 million in school funding to Wisconsin.

The Wisconsin Education Association Council spent nearly twice as much as any other organization to lobby lawmakers in 2009, according to the Government Accountability Board.
The state’s largest teachers union reported spending more than $1.5 million and 7,239 hours lobbying, almost twice as much as the Wisconsin Insurance Alliance, which spent the second-highest amount on lobbying in the state.
One aspect of the union’s lobbying effort was largely successful, with the state Legislature repealing the 16-year-old qualified economic offer law that restricted teachers’ pay and benefits.




Wisconsin Public schools likely to face cash drain

So let’s think out loud about what might lie ahead:
State aid to schools. It’s hard to see how Republicans are going to keep their campaign promises and fund the same percentage of statewide costs for kindergarten through 12th grade. The state committed itself to paying two-thirds of those costs in the 1990s (under Republican Gov. Tommy G. Thompson). The current rate is a bit below that. But look for Walker to want to do something about this multibillion dollar annual spending. Reductions in state aid would translate into large increases in property taxes (that hardly seems likely, given the state of public opinion) or large cuts in school spending. That leads us to:
Teacher benefits. Look for a lot of action around this. Teachers are deeply defensive of their benefits, especially health insurance plans that are substantially above what almost anybody else has these days. But WEAC, the state teachers union, was among the biggest losers on Tuesday and has few friends in the Capitol now. There’s been talk about trying to bring teachers into the state employees’ health plan, which costs less than most teacher plans. Now is likely to be the time for doing that. Or maybe other ideas will surface.
Teachers contracts are negotiated locally, so the most powerful thing Republicans can do might be just to give local districts less money and let school officials and local unions figure out what to do about it. My guess is that the Milwaukee teachers union agreed recently to a new contract that goes until 2013, two years longer than the normal agreement, in hope of staving off more concessions at least for that long.




Confront Wisconsin teacher lobby on reform

Wisconsin Manufacturers and Commerce is often maligned for throwing its weight around at the state Capitol.
But it was the big state teachers union (WEAC) that spent – by far – more money on lobbying last year than any other special interest group.
It helps explain why the teachers got precisely what they wanted from the Democratic-run Legislature and governor’s office in the last state budget: repeal of state limits on teacher compensation.
It also shows why reforming public education – to require more accountability and innovation – won’t be easy. The teachers union has resisted pay for performance, something commonplace in most professions, and frowned on innovative charter schools. State leaders will need to stand up to the union if public education is to be transformed.




Lift the cap on Wisconsin virtual schools

In Wisconsin, we have always been proud of our strong education system. New demands and technology are changing the way we prepare our children to enter the 21st century workforce. We must ensure that our state’s education system remains a national leader by providing our children with the skills that are needed to compete in a global economy.
It has been proven that not every child learns the same way. In fact, some students learn best outside of the traditional bricks-and-mortar school setting. For these children, virtual schools have come to fill an educational need. Virtual schools involve long-distance learning that use computers and Internet connections. These schools employ vigorous and challenging curricula along with regular interaction with state-certified teachers.
However, virtual schools were nearly wiped out in 2007 due to a court challenge by WEAC, the state’s teachers union.
In response, in the last legislative session I led the charge to ensure that virtual schools remain an option for Wisconsin’s parents and children. A bipartisan compromise was reached to keep the schools open but included a cap of 5,250 students requested by critics until a legislative audit could be conducted.




Wisconsin Education reform package produces odd alliances

To even be eligible for the funds, however, Obama and U.S. Education Secretary Arne Duncan had said that Wisconsin would have to repeal its “firewall” law that banned the use of student scores in teacher evaluations.
In his remarks, Obama acknowledged that eliminating the law was controversial in some places but said it was a necessary first step toward bringing a new accountability to classrooms, especially with struggling students.
Normally, that would be a message the Wisconsin Association of School Boards would be eager to hear. But instead, the so-called firewall reform bill passed by the Legislature is a failure in the group’s eyes because it doesn’t allow school districts to use student test scores to discipline or dismiss a teacher whose performance doesn’t measure up.
“While the wording of the legislation might meet the letter of the law, we don’t think it really addresses its spirit,” says Dan Rossmiller, a spokesman for the school boards association.
And because the new law requires collective bargaining over any teacher evaluation plan that includes student test scores, Rossmiller says the school boards association believes the requirement would make the process too unwieldy. “We think it will make it harder to use test scores to evaluate teacher effectiveness, not easier,” he adds. “For that reason, I don’t think we’ll be recommending that school districts try to develop evaluation plans for teachers that include using test scores.”
But Mary Bell, president of WEAC, says the new firewall reform law’s most important purpose is to improve teacher effectiveness and that a focus on using data in a punitive way misses the point.

School district contracts push up tax levy

At a time when taxpayers are struggling in this destabilizing recession and most are not seeing wage gains, the Appleton Area School District (AASD) has proposed a budget that increases the tax levy by 9.7%.
At a time when the state budget is suffering billion dollar deficits, when the state has cut its support of AASD, when enrollment has declined by 220 students, and when inflation is 0%, still the district’s total budget increased by over $3 million (from $176 million to $179 million)!
The district’s budget increase is primarily fueled by employee compensation increases, including an 8.2% increase in health care benefits – for a benefit plan that is already a Cadillac. Cost reductions could most certainly be achieved via increased efforts to decrease utilization and increased premium participation (school employees pay only 5% of their health insurance premium that for a family is almost $20,000 a year) and/or simply putting the very costly health insurance program out to bid. As it is now, the union dictates that the health insurance must be carried by an arm of WEAC.
In addition, though the budget reflects a wage freeze for administration employees, no such offer has been forthcoming from the teachers union.




Seize opportunity for education reform in Wisconsin

Three factors have conjoined this month to make education reform in Wisconsin a real possibility in the next year and a half:

  • The announcement by Gov. Jim Doyle not to seek re-election but serve out his term.
  • The tragic, but courageous incident involving Milwaukee Mayor Tom Barrett, a promoter of education reform in Wisconsin’s largest city.
  • The potential of qualifying for new federal education dollars.

The logjam created by the state teachers union’s political activities — which contribute millions of dollars per election year almost entirely on behalf of Democrats — has led over the past 15 years to no educational policies put forward by Democrats or Republicans.
Some individual legislators have had proposals, but they have not gone far in the legislative process.
The political ground rules in Madison have been too crassly partisan on both sides of the aisle. It goes like this: If the Democrats control Madison, Wisconsin Education Association Council gets what it wants. If Republicans control Madison, WEAC gets nothing that it wants.
This is disheartening to the many people across the political spectrum who want reform and progress.
The newly aligned stars offer a chance to break the logjam. Doyle lacks the need for WEAC because he is not running again. Barrett’s popularity has surged after he was injured when he came to the aid of a woman threatened by a pipe-wielding attacker. And the federal aid is a carrot.
Reformers have been helped by President Barack Obama’s secretary of education, who called one Wisconsin law on education “ridiculous.” That law currently makes Wisconsin ineligible for its share of $4 billion of federal education money.
Wisconsin now has a chance to take advantage of this alignment to make dramatic fixes to the Milwaukee public school system, change Wisconsin law so teachers can be at least partially evaluated by student test scores, and make long overdue changes in K-12 educational funding formulas.
The funding formulas currently in place will, with no doubt, increase property taxes, increase class sizes, and increase teacher layoffs.
One more entity needs to get its star aligned — the state Legislature. The Democrats do need WEAC in 2010. But I believe there are good people in the Legislature who, I hope, will grab this moment.
The goal of public education is clear and simple: improve student achievement. There are three major items that accomplish this:

  • Better family structure and parental involvement in schools.
  • Adequate funding — without involving students in the unpopular reliance on property taxes, the most unpopular tax of all. Think about it, the funding of our prisons does not involve the property tax wars, but paying to educate our children does.
  • Appreciated teachers who continue to stimulate students to improve and are evaluated and rewarded for outstanding performance.

These times for reform do not come often.

Our View: Teachers’ e-mails at work are public records

Sometime in the spring of 2007, Don Bubolz of Vesper didn’t like what he heard at a meeting of the Wisconsin Rapids School Board.



He filed an open records request on April 16 of that year seeking the release of all e-mail messages sent to and from the accounts of five teachers in the district, for a period of about six weeks. At the time, he told the Wisconsin Rapids Daily Tribune that he wanted to find out — and wanted school administrators to know — whether the teachers were “doing their job the way it’s supposed to be done.”



The district superintendent indicated he would release the e-mails. The Wisconsin Education Association Council, representing the five teachers, filed an injunction to block their release.



The case made its way through trial court, and last month the Appeals Court certified it for consideration by the state Supreme Court. The appeals court said that there is no existing legal guideline in Wisconsin about whether personal e-mails constitute public records. If it chooses to rule on the case, then, the Supreme Court’s decision would have far-reaching implications.




On Wisconsin’s State K-12 Education Budget

Following several hours of impassioned testimony from administrators, parents, and staff from school districts throughout the state, both large and small, at this week’s School Finance Network Assembly Hearing, it ended, unfortunately, on what could be charitably characterized as a flat note. Despite the hard work of disparate leaders of education groups meeting constantly for the past couple of years to come up with a thoroughly conceptualized school finance reform plan to present to the legislature, a committee composed of organizations in the School Finance Network who have often been traditionally at odds with each other in the past (for example WEAC and WASB ), came to the hearing armed with numbers vetted by both economists at the UW-Madison and the state Legislative Fiscal Bureau, including a number of suggestions for how to pay for this reform. However, the Committee on Education made it clear they were not going to take any action on this plan for the upcoming budget legislation hearings for the 2009-2011 budget. And most discouragingly there were, was, as far as I’m aware, no newspaper coverage of this event. I saw only one Madison tv crew present. They covered some of the personal testimony at the beginning but were not around to hear the actual presentation of the plan itself, which came late in the proceedings, too late to make it into the evening broadcast.

Tony Evers questioned opponent Rose Fernandez’s qualifications for the state’s top education spot Friday night, while Fernandez countered by trying to portray him as a crony of Wisconsin’s largest teacher’s union.
The two, vying for the post of superintendent of Public Instruction, laid out competing visions in a We The People debate.
Evers, the deputy superintendent at DPI, touted his 34 years of experience in education while contrasting his resume with the credentials of Fernandez, who is a nurse by trade and has never worked in a public school.
Fernandez, a virtual school advocate, countered by continually trying to lay problems with the state’s educational system at the feet of Evers, who has held the No. 2 post at the agency for eight years.
Given the opportunity to question each other, Evers pointed out Fernandez represented virtual schools and has zero experience in the administration of public schools. He asked how parents with children in public schools can trust her to invest in their education rather than funneling money toward special interests.
“My own special interest is the boys and girls growing up in the state of Wisconsin,” Fernandez shot back.
Fernandez then stressed Evers’ endorsement by the Wisconsin Education Association Council and the “hundreds of thousands of dollars” the union has spent to support his campaign. She asked him to list three reforms he has supported that WEAC opposed.
Evers answered that the union was unhappy with a settlement DPI reached on allowing virtual schools — in which districts allow students to take courses on-line — to continue. He also said he has been a strong advocate of charter schools — which operate without some of the regulations of other public schools — something the union has opposed.
“I started charter schools. I know what charter schools are about,” Evers said. “I don’t need a lecture about charter schools.”
Evers also stressed his support from school boards, child advocates, parents and others.
“That’s why you have to have a broad coalition,” Evers said. “This isn’t about this overwhelming group of people driving policy at the state level. That just isn’t fact.”
Fernandez ripped DPI for not doing enough to help the struggling Milwaukee Public School system address issues like dropout rates and the achievement gap for minority students.
Evers countered that he has worked on the issue with educators in Milwaukee, but there are also socioeconomic factors that are hampering achievement.
“Laying this issue on my lap is irrational,” Evers said.
Fernandez also brought up a piece of Evers’ campaign lit that referred to voucher schools in Milwaukee as “a privatization scheme.”
“Some of the schools have been scheming, and those schools we have drummed out of the program,” Evers replied.
Evers warned that Fernandez would run DPI through the prism of the “special interest” of choice schools.
Both candidates agreed that a merit pay system for educators could have benefit, but they disagreed on the details. Fernandez indicated that she would base her merit pay system more on classroom outcomes, while Evers stressed that rewards for training were equally important.
They differed more prominently on the qualified economic offer, which Gov. Jim Doyle has proposed eliminating in his 2009-11 budget plan. Fernandez wants to retain it, saying that without the control on teacher compensation, property taxes could rise sharply.
“Children may become the enemy of the taxpayer,” she said.
Evers said he has bargained on both sides of the table, and he opposes the QEO because it hurts the state’s ability to stay competitive in teacher pay.
Evers embraced the coming federal stimulus cash, which will pump $800 million into state schools as “a historic event” that acknowledges “educators are the lever that can turn our economy around.” He said he would appoint a trustee to oversee the allocation of the funds in Milwaukee schools to ensure the money is getting to the classrooms.
In contrast, Fernandez said she looked upon the federal stimulus with caution in that it is one-time funding that won’t be there in the future
And while Evers touted the state’s ACT and SAT scores as being among the highest in the nation, Fernandez said those tests are only administered to college-bound students and aren’t indicative of the academic struggles in districts like Milwaukee.

Despite being outspent $96,129 to $10,500 (WisPolitics) by Tony Evers, Rose Fernandez obtained 31% of yesterday’s vote. Tony Evers received 35%. Here’s a roundup of the election and candidates:

    On Tuesday, he finished just ahead of Rose Fernandez, a former pediatric trauma nurse and parent advocate, in a five-person field.
    Although she finished the night in second place, Fernandez, 51, characterized her performance as “a victory for real people over the special interests.”
    In addition to being first to declare his candidacy, Evers also captured endorsements – and contributions – from the Wisconsin Education Association Council as well as other labor and education-based groups. WEAC PAC, the political arm of the state’s largest teachers union, contributed $8,625 to Evers’ campaign, in addition to spending nearly $180,000 on media buys for the candidate, according to campaign filings earlier this month.
    By contrast, the Fernandez campaign spent $20,000. She said that her message of calling for merit pay for teachers and choices for parents had resonated with voters.
    “Tonight, we have all the momentum,” she said. “This is going to be a real choice. It’s going to be a choice between special interests and the status quo, the bureaucracy that is entrenched at the Department of Public Instruction, vs. a focus on the results we are looking for in our investment in education, a push for higher standards instead of higher taxes.”
    Evers, 57, has distanced himself somewhat from the current schools superintendent, Elizabeth Burmaster, saying it’s time to be more aggressive about reforming Milwaukee Public Schools and calling for an increase in the state’s graduation rate.

Evers won the endorsement of the 98,000-member state teachers union, the Wisconsin Education Association Council, which paid for TV ads on his behalf. Evers was the only one of the five to pay for his own ads.
“I believe that my message of experience has played well so far,”
Evers said. “I won the primary and I anticipate that we’ll just work hard to get the message out. I believe that people do believe experience matters.”
Fernandez, who has often been at odds with the state education department over virtual schools, reveled in the fact that she didn’t get the WEAC endorsement, touting it as another sign of her being outside the state education bureaucracy.
Fernandez was the only one of the five candidates without any professional education experience. A former nurse, she recently stepped down as president of the Wisconsin Coalition of Virtual School Families.
“Some people have dismissed me as just a mom on a mission, but that’s a label I’ll be wearing as a badge of honor,” Fernandez said. She pledged to overcome WEAC’s financial backing of Evers with a broad base of support that taps into teachers, parents and students across the state.
“We’re hearing that there’s a great hunger out there for our message that higher standards without higher taxes is what they want,” she said.
Her campaign called for reforming the state education department, enacting changes to allow for teacher merit pay and protecting alternative education options such as virtual schools, home schooling and Milwaukee’s school choice voucher program.
Evers, the deputy under retiring Superintendent Libby Burmaster for the past eight years, emphasized his 34 years of education experience during the campaign. Opponents criticized him as a status-quo insider candidate, while Evers countered he was the best-grounded to initiate reforms, particularly in the Milwaukee schools.




On Eliminating Wisconsin Teacher Salary Growth Caps (QEO)

Spend more with less money.
That’s the impossible demand Democrats who run the state Capitol seem anxious to make on local school boards across Wisconsin.
Democrats who control the governor’s office and the Legislature suggest they’re going to repeal a long-standing law that effectively caps annual pay raises for public school teachers. Democrats have been promising to remove the cap for more than a decade and now have the political power to do so.
But allowing higher annual raises for teachers will require more money from somewhere. And state leaders don’t have any dollars to spare. They’re staring at a record state budget shortfall.
So where will the money come from?
Not from property taxes. Gov. Jim Doyle and other Democrats suggest they’ll keep in place a state cap on local school district revenue. Revenue caps limit how much local property tax levies can increase.
That will leave school boards with higher salary expenses but no easy way to pay for them.

Interestingly, while local property taxes have remained relatively flat, taxpayers have supported a large increase in State of Wisconsin taxes spent on K-12 public school districts. Of course these funds largely come from the same wallets that support property taxes.
