Taxpayer funded Open Records Resistance at the Madison School District

The complaint against Madison Metropolitan School District spokesperson Tim LeMonds that he fought to keep private alleges he bullied and harassed numerous employees under his management as well as members of the local media.

Filed in October 2022 by three employees, one of whom has since left the district, the complaint includes a timeline of examples of poor behavior beginning in March 2021 through early October 2022. It also includes experiences shared by former employees who are not officially part of the complaint.

The district released the complaint in response to an open records request on Friday. On Thursday, a Dane County Circuit Court judge ruled against LeMonds’ lawsuit seeking to stop that release based on concerns about the potential reputational damage it could cause. LeMonds began working in MMSD in 2019.

The Madison Metropolitan School District can release an employee complaint filed against its spokesperson as part of a response to an open records request, a Dane County judge ruled Thursday.

Circuit Court Judge Rhonda Lanford ruled against MMSD’s executive director for communications, Tim LeMonds, who filed a lawsuit against MMSD on March 24 asking the court to stop the release of a few documents that are responsive to an open records request.

“I do not think that the plaintiff, Mr. LeMonds, has come close to showing that the public interest of protecting his reputation outweighs the public’s right to know,” Lanford said. “Especially in a case involving the public schools and how not just investigations are conducted, but how well how they are conducted and the results of that.”

The public records request came from NBC15 reporter Elizabeth Wadas, who requested all emails from Dec. 19, 2021, through Dec. 19, 2022, that contained her name or references to an NBC15 reporter. The district released hundreds of pages of records related to the request, but per open records law notified LeMonds that the complaint would be part of the release and allowed him time to challenge that.

Preliminary Injunction Against “Disparag[ing]” or “Frivolous” Claims About School Board or Employees …

From Livingston Parish School Bd. v. Kellett, decided Thursday by the Louisiana Court of Appeal (Judge Allison Penzato, joined by Judges Duke Welch & Walter Lanier):

[T]he School Board discovered that Ms. Kellett, the mother of a child attending Live Oak Elementary School, “repeatedly concealed” electronic devices in her child’s clothing or personal belongings in November 2019. Ms. Kellett purportedly used these devices to “intercept communications by and between faculty, students, and others in the school and/or classroom during school hours and while on school property.” One such device, an AngelSense, had GPS capability to track the child’s whereabouts and also allowed verbal communications between Ms. Kellett and her child. The School Board obtained a temporary restraining order (TRO) on January 27, 2020, then a preliminary injunction on April 8, 2020, prohibiting Ms. Kellett’s use of these devices on school property.

The School Board also accused Ms. Kellett of being critical of the School Board and publicly discussing “her child’s special needs” and individual education plan with the media. Ms. Kellett allegedly maintained a “live web blog and other ongoing social media posts” that involved discussion and disclosure of information related to the School Board, the special education program, and other identified individuals. According to the School Board, these posts have “caused concern for parents of other [Livingston Parish School System] students and have defamed and slandered the reputations of [the School Board] and Live Oak Elementary staff.” The January 27, 2020 TRO and April 8, 2020 preliminary injunction addressed this additional complaint by the School Board. Pertinently, the April 8, 2020 preliminary injunction enjoined, restrained, and prohibited Ms. Kellett from:

… d) … engaging in any form of written, verbal, or physical displays of hostility, anger, or disparagement, and/or from making threats of any physical assault, and/or any disorderly conduct that results in fear or disruption of activities through hostile and inappropriate behavior toward any LPSB [Livingston Parish School Board] member, administrator, faculty or staff at Live Oak Elementary School and/or on any LPSS [Livingston Parish School System] public school bus or other school property, and/or while participating in any educational or other school related business or function, including but in no way limited to any Individual Education Plan (IEP) or Individual Health Plan (IHP) meetings or evaluations required to facilitate the minor child’s special education and health care needs;

f) … making or publishing and/or from engaging in any activity to make, disseminate, publish or broadcast defamatory, slanderous, libelous, frivolous and/or fraudulent claims or statements concerning [the School Board], its faculty, staff and employees, as defined by R.S. 14:47-48, 13:3381(B), directly or by her enlisting the assistance of any other person(s) on her behalf ….

The School Board argues that false statements, like Ms. Kellett’s accusations against the School Board and its employees, which purportedly include allegations of criminal conduct, are not constitutionally protected free speech. Worse, it asserts, the words uttered by Ms. Kellett are defamatory per se. In Kennedy v. Sheriff of East Baton Rouge (La. 2006), the Louisiana Supreme Court recognized that words that expressly or implicitly accuse another of criminal conduct, or which by their very nature tend to injure one’s personal or professional reputation, without considering extrinsic facts or circumstances, are considered defamatory per se. “When a plaintiff proves publication of words that are defamatory per se, falsity and malice (or fault) are presumed, but may be rebutted by the defendant.” Thus, before liability can be imposed for the publication of words that are defamatory per se, the defendant must be given an opportunity to rebut the presumption.




Curious (false claims) reporting on legacy k-12 schools, charter/voucher models and special education



Wisconsin coalition for education freedom:

Wisconsin Watch has released its third article in a series attempting to discredit the great work choice programs do in Wisconsin. Their latest article misrepresents admission policies of choice schools while ignoring the fact that public schools often engage in admission practices that would be illegal for schools participating in the state’s choice programs.
Wisconsin Watch is again making false claims.

  • In their most recent article, Wisconsin Watch again misrepresents school choice admission practices and now adds a false narrative that schools “expel” students with disabilities at will. Their claims don’t match reality, nor is a single example provided.
  • Fact: Schools in Wisconsin’s choice programs may not discriminate against any eligible family based on a student’s disability.i
  • As with many individual public schools, individual private schools are not required to provide a full range of disability services. Parents who choose to enroll their student do so only after being fully informed of available services.
    Some Wisconsin public schools have admissions processes that would be illegal for private choice schools.
  • Public school districts often have specialty public schools, in addition to their residentially assigned schools. Public schools are permitted to create admission requirements for these schools.
  • Public schools having admission requirements is not a new phenomenon, with the practice being documented in Wisconsin for decades.ii (Link)
  • Today, specialty schools like those in Milwaukeeiii (Link) use a points system to admit students based on their report card scores, attendance, standardized test scores, and an essay. In Green Bay,iv (Link) students must complete a test for admission to a school for the gifted.

  • Choice schools must admit students on a random basis if there is excess demand with few exceptions, primarily related to being in the same family as an existing student.v (Link)
    Public schools reject students in the public school full-time open enrollment program.

As an advocacy specialist at Disability Rights Wisconsin, Joanne Juhnke regularly finds herself on the phone with parents concerned about their children’s treatment at school.

Most complaints concern public schools, which enroll the majority of students. State funding for special education has shrunk, forcing districts to struggle to provide services, and disparate treatment of students with disabilities at public schools persists. But in public school, families have a state body to appeal to: the Department of Public Instruction.

DPI is far less helpful in disputes with private schools, which under state law can legally discriminate against students who need certain disability accommodations — or even kick them out. This applies even to private schools that receive taxpayer-funded tuition vouchers to educate students.

The calls Juhnke receives from voucher families often contain the same story. A family has enrolled a child with disabilities in a private school. Administrators have begun pressuring the student to leave or have kicked them out, something public schools cannot do. The parents are shocked. They’re sure the schools can’t do that.

Many times, Juhnke has to tell them: Yes, they can.

“You went into this school choice program thinking that you were the one, as the parents, who have the choice,” she said. “Really, on the other end, the school holds more choice cards than you do, and you’re coming out on the wrong side of that.”

I find the timing of Wisconsin Watch’s articles curious, amidst budget season. Ideally, the writer might dive deep and wide into the effectiveness of our well funded k-12 system. Reading would be a terrific place to start.

Wisconsin students missed nearly a month of school last year

Since the pandemic, fewer Wisconsin students have reliably made it to school. The state’s attendance rate reached a new low of 91 percent last year and chronic absenteeism continues to be an issue, with more than 22 percent of students missing at least a month of school. 

The picture is even more grim for high school students. The latest state data shows more than a quarter — 26 percent — of Wisconsin high school students missed a month of the 2021-2022 school year.  

A student is considered chronically absent when they attend less than 90 percent of school days. The overall attendance rate for Wisconsin high school students was 89.7. Milwaukee Public Schools high school students attended only 70 percent of the time.

Attendance is an important measure of student engagement and a predictor of future achievement, dropout or late graduation. And attendance rates have been dropping since the COVID-19 pandemic began.

School avoidant behavior, also called school refusal, is when a school-age child refuses to attend school or has difficulty being in school for the entire day. Several mental health experts told USA TODAY it has become a crisis that has gotten worse since the COVID-19 pandemic.

Notes on Madison’s taxpayer supported K-12 school district $pending priorities; $597.9 million budget…

This year, the two sides are about $11.7 million apart, with MMSD offering a 3.5% increase in its draft budget and MTI, the teachers union, asking for the maximum 8%. MTI, as it did last year, has rallied and spoken out publicly about its concerns should the district remains at 3.5%, including intensifying the district’s ongoing staff shortage.

District officials have said the 3.5% is the best they can do right now amid uncertainty surrounding the state budget and long-term fiscal challenges like decreasing enrollment and the coming end of federal COVID-19 aid.

Trust the Science? The Use of Outdated Reading Curricula in Wisconsin Schools

Forward Exam scores show that Wisconsin students are struggling in reading. Currently statewide, only about 36.8% of students scored proficient or higher on the Forward Exam, meaning the majority of students are falling behind. Reading problems cut across all socioeconomic and racial lines. Much attention has been focused on the “Science of Reading,” and the persistence of reading curricula around the state that are not focused on these metrics. The Science of Reading is a ‘back to the basics’ approach that is focused on learning phonics, increasing vocabulary, and sounding out words rather than the context-clue based “guessing” techniques that have become popular in recent decades. Until now, it has not been possible to take a statewide look at what curricula districts are using for reading, and whether this choice has a relationship to student outcomes.

This paper takes advantage of a new dataset available from the Department of Public Instruction that details the curricula used in each district around the state. We correlate reading outcomes on the Forward Exam with some two of the most widely criticized curricula that rely on “Whole Language” techniques—Lucy Calkins and Fountas and Pinnell.

Key takeaways include:

Whole Language techniques are still in wide use. About 44% of schools around Wisconsin under the high school level are still using Lucy Calkins and/or Fountas and Pinnell.

Use of Lucy Calkins is correlated with lower proficiency. Controlling for a number of other factors that are known to affect reading scores, the use of Lucy Calkins is correlated with about a 2.1% decline in ELA proficiency. No relationship was found with Fountas and Pinnell, possibly due to lower usage rates.

Combined, use of either curriculum is correlated with lower proficiency. Controlling for a number of other factors known to affect reading scores, the use of Lucy Calkins or Fountas and Pinnell is correlated with 2.7% lower reading scores.
Policymakers should consider adopting best practices from the Science of Reading. States like Mississippi have seen significant jumps in reading proficiency by moving away from Whole Language methods to science-based methods. The evidence here suggests Wisconsin could benefit from doing the same.

Recently Wisconsin Watch released articles criticizing the Wisconsin parental choice programs and incorrectly claiming that private schools may “discriminate.” This memo provides resources and information about the false claims made in the article and talking points to refute them. 

The claims that private schools may “discriminate” are false. 

These claims are false. Wisconsin Watch claims that federal law “allows religious entities to discriminate against LGBTQ+ students” and that schools in the parental choice program may discriminate against LGBTQ+ students or those with disabilities “once that student is enrolled.” 

Private schools are governed by different laws than public schools.  There are specific prohibitions of discrimination that apply to private schools participating in the parental choice program. For example, Wisconsin law requires private schools in the choice programs to do a blind admission process. Schools are not permitted to create barriers for enrollment for student based on anything other than the DPI application and income verification forms. Private schools are allowed to give existing students and their siblings eligibility preferences.  

Private schools are not permitted to “discriminate” against students with disabilities. 

The Obama Administration began a misguided investigation into private schools in the Milwaukee Parental Choice Program in 2011. DPI, at that time, correctly stated that private schools in the program have a different legal standard to serve students with disabilities. Despite a three-year investigation, there were no instances of discrimination found

Private schools have a different legal standard than public schools for students with disabilities. 

Public schools are subject to several state and federal laws regarding the education of students with disabilities including the requirement that public school districts may not deny any student access to a “Free and Appropriate Public Education” and receive specific funds to educate children with disabilities. Even within public school districts, not all individual schools are required to provide a full range of special education services.

Private schools must meet a different legal standard. Section 504 of the Rehabilitation Act and the Title III of the Americans with Disability Act (ADA) set forth requirements for private schools. 

Title III of the ADA requires private schools to make “reasonable modifications” for individuals with disabilities to access the facility and prohibits private schools from discriminating against individuals based on their disability. Changes to accommodate may not fundamentally alter the nature of the goods and services provided by the private school or impose an undue financial or administrative burden on the private school. Similarly, Section 504 requires private schools to make “minor adjustments” for individuals with disabilities to access the facility. Private schools may consider  the nature of the program provided and the expense of accommodations sought when serving individuals with disabilities under Section 504. 

Furthermore, private schools participating in the Wisconsin Special Needs Scholarship Program, to specifically serve students with disabilities, must meet with families to complete an agreement to discuss the educational needs of each student and to explain special education resources available at the school. Participating private schools are also required to provide reports to parents about student progress.

The Wisconsin Watch articles do not specifically claim a private school violated the federal laws regarding students with disabilities. 

Private schools in Wisconsin serve hundreds of students with disabilities.

Academic research found that private schools in Wisconsin parental choice programs serve many students with disabilities. Reported disability rates are often lower because choice schools lack the financial incentive public schools have for identification.

This is further supported by the growing participation in the Special Needs Scholarship Program, a state-funded program to give students with disabilities funding to attend a private school of their choice. Since the program’s creation in 2015, participation has grown by 815%, from 215 to 1,986 students. 

Private schools in the choice program welcome all students. 

Private schools in the choice program choose to participate in the program, with full knowledge that they are opening their doors to students and families from all different backgrounds and beliefs. Many of these schools participate because they want to serve as many students as possible. 

Private schools in the choice program may not require participation in religious classes. 

Once enrolled, all students are subject to the policies of the school, religious policies included. If families disagree with the religious beliefs of the school, state law permits families to opt their children out of religious instruction. 

Additionally, the choice program is a voluntary program that empowers families to choose the school that best fits their child’s needs. Families are always free to choose to send their children to a school that matches their values.

Religious schools have a constitutional protection to serve students based on their beliefs. 

The U.S. Constitution protects the free exercise of religion. This allows religious schools to teach and make decisions based on their religious beliefs. For private, religious schools, this includes decisions relating to policies and procedures at the school. 

Both the Wisconsin Supreme Court and U.S. Supreme Court have determined that parental choice programs are legal. 

The claims that taxpayer dollars should not go to schools that enforce their religious beliefs has been litigated both in Wisconsin and most recently in the U.S. Supreme Court. The U.S. Supreme Court has made clear that if states choose to create and provide a parental choice program the state may not discriminate against faith-based schools and may not bar students from using public funds to attend religious schools. 

With private schools, the choice ultimately lies with the student, parent, and family. 

All families deserve to access high-quality schools that meet their child’s needs. Far too many families are stuck in their assigned public schools, but school choice provides families with the option to attend the school that is the best fit for their child.

Ultimately, parents and students have every right to go to a school that matches their moral convictions.  The whole idea behind school choice is if a parent or student is upset with how a school is run, then they can in fact go somewhere else and take their money with them.

New UW–Madison study finds remote learning caused lower high school completion rates for lower-income students

Remote learning during the height of the COVID-19 pandemic was more likely to negatively affect the high school graduation rates of students from lower-income households than their higher-income peers, according to a new UW–Madison study. 

The study, published in Educational Researcher, found a longer time in virtual or hybrid learning environments during the 2020–21 school year decreased overall high school completion rates and increased the gap in completion rates between economically disadvantaged and non-disadvantaged students.

“About one out of every seven Madison School District middle and high school students is considered at risk of not graduating from high school”

Higher rates of chronic absenteeism are largely driving the increase, as about 98% of the district’s 2,231 at-risk students have been deemed “habitually truant,” defined as missing more than 10% of days in an academic year. The number of students considered habitually truant during the 2021-22 school year more than tripled from the year before, according to data presented to the Madison School Board Monday night.

Students in grades five through 12 are considered at risk by the state when they either have dropped out or can be classified in two or more categories considered detrimental to their education, including being:

  • One or more years behind their peers in the number of high school credits earned.
  • Two or more years behind in basic skill levels.
  • Pregnant or a parent.
  • An eighth-grader who scored below “basic” on state exams.
  • Habitually truant.

The number of students in each category increased in 2021-22, with the exception of students who are pregnant or parenting, a number that’s fallen from 40 five years ago to just a handful now. About 1,714 students, or more than 10%, had fallen behind by two school years, an increase from 946 students in 2018-19, the last year before the pandemic. The number of eighth graders scoring low on state exams has doubled since then.

The number of at-risk students each year is based on data collected the year prior. In 2021-22, there were 14,980 students in grades five through 12 in the district.

In her letter, Underly stated, “Whether you realize it or not, you are, under the guise of protection, causing undue harm to students and staff. However, this damage is reversible. It is paramount that you change course now.”

Underly requested that the administration reverse the policy to “foster inclusive environments,” saying the controversial issues policy is “eliminating conversation on topics that you have in the past deemed controversial.”

Reversing the policy “will send a clear message to the residents of Waukesha and all of Wisconsin about the high priority you place on ensuring a well-rounded education for your students that reflect the pluralistic nature of our society,” Underly wrote.

Last week, the administration placed first-grade dual-language teacher Melissa Tempel on administrative leave after she spoke out about the district’s decision to ban “Rainbowland.”

Underly addressed Tempel’s leave in her letter by citing the text from the controversial issue policy. She said the district needs to re-evaluate its decision to place Tempel on leave and should recognize that “‘acknowledging the rights of (the district’s) professional staff members as citizens in a democratic society’ is, in fact, in the best interests of the School District of Waukesha.”

Commentary on the taxpayer funded Madison school district’s non open records practices

Although you might never know it by last week’s meeting of the Madison School Board, school districts are very much included in the law that requires government — which belongs to and is paid for by the public after all — needs to be transparent in all that it does. There is no room for secrets unless specifically exempted under the law.

To me, the meeting to discuss the embarrassing failure of the Madison Metropolitan School District’s response to open records requests was an embarrassment itself. Administrators tried to explain why the district has become a laggard in fulfilling openness requests, often simply denying access or stonewalling for months to release records that “shall be honored as soon as practicable and without delay.”

They revealed that the job that long ago was designated as the records custodian, the person responsible for releasing requested public records, no longer exists. Instead, the district’s legal department has been taxed with the job and apparently is overwhelmed by other tasks.

That’s patently unacceptable, and I’m surprised School Board members didn’t demand an accounting. No governmental body can just ignore the law because it refuses to assign adequate staff to comply with it.

But one of the lawsuits was actually filed by the district’s own spokesman, Tim LeMonds. After the district determined it had to release a complaint against LeMonds by his staff, the tight-lipped LeMonds — whose job is supposed to be communicating with the public — sued his employer to stop disclosure.

Madison School District Superintendent Jenkins a finalist for Tennessee district superintendent job

Two months after announcing his retirement, outgoing Madison Superintendent Carlton Jenkins has been named a finalist for the top job in a Tennessee school district.

Chalkbeat Tennessee, an education news website, reported Saturday that Jenkins is among three finalists to be the next Memphis-Shelby County Schools superintendent. The School Board there, however, was not happy with the list of three finalists selected by a search firm, including Jenkins.

“After a public meeting that at times turned tense, the board announced it would pause plans to interview finalists for the position until it receives the names of all 34 applicants,” Chalkbeat reported, adding that board members questioned the process rather than the credentials of any specific candidates during their Saturday meeting.

Elmbrook school board election recount



Quinn Clark:

After he lost the Elmbrook School Board election by 0.3%, Gregg Eberhardt on Wednesday sought a recount, citing “potential irregularities or illegalities,” in his recount petition.

The Board of Canvassers of the School District of Elmbrook, the same people who counted the first time, will recount the votes Friday, April 14 at 9 a.m. at the district office at 3555 North Calhoun Road, Brookfield. The recount is open to the public, but can also be streamed live at www.elmbrookschools.org/live.

Eberhardt ran against Dr. Preetha Kurudiyara for the Area 3 seat. In the end, Kurudiyara garnered 9,847 votes (50.1%) to Eberhardt’s 9,799 (49.8%).

The public records request came from NBC15 reporter Elizabeth Wadas, who requested all emails from Dec. 19, 2021, through Dec. 19, 2022, that contained her name or references to an NBC15 reporter. The district released hundreds of records related to the request, but per open records law notified LeMonds that the complaint would be part of the release and allowed him time to challenge that.

He did so, with his attorney arguing that the October 2022 complaint and related documents are “technically” responsive to the request, but were “not, themselves, the subject of the request.” The filing further argued that releasing the documents “would almost certainly cause irreparable harm to him, his reputation, the public’s perception of him, his standing in the community, and within MMSD itself.”

The briefing also states that an investigation of the complaint by the district’s legal and human resources department found that the accusations were “without merit.”

A meeting in which the Madison School Board was to discuss its open records policy was effectively held behind closed doors Monday after a problem with its livestream kept the public from being able to see it.

The meeting was scheduled for 5 p.m. Monday and was legally noticed as a virtual meeting, with only school board members attending in person. But when officials couldn’t get the public’s livestream for the meeting to start, they decided to proceed with the meeting anyway and post a recording of it later.

After years of declining literacy scores, Madison schools move forward with new reading curriculum

The hope is that the new curriculum will improve dismal reading scores across the district.

According to the 2021-2022 State Report Card, prepared by the Department of Instruction, only 39.5% of K-12 students in Madison schools were proficient or advanced in reading that school year. The district’s Black students fare worse. In 2021-2022 only 8.8% of Black students were proficient or advanced in reading.

Jackson says it will take three to five years to see results as far as state tests go.

In the meantime, the district will focus on making sure students are excited about their lessons and growing teachers’ confidence in the curriculum.

Briggs says building a district of successful readers is going to take the support of families and the community.

A new, private high school planned for Madison



Olivia Herken:

Moore said there is a growing desire among parents and students for private high schools, but not enough options in the area, specifically for Impact’s younger students on the West Side of the Madison metropolitan area. In addition to Impact Christian’s high school options, other private high schools in the area include Edgewood and St. Ambrose Academy.

“Depending on your child, you might be interested in public or a charter option, but there are a lot of parents who have been asking about a private option,” he said.

“There just aren’t a lot of high school options,” Moore said. “Now, there are a lot of great high schools in Madison, but not every school is for every parent, and we offer distinctives at our Christian schools that aren’t possible in a public school, just in the same way that the facilities that most of the wonderful schools in Madison are far above what we can offer.”

The Verona Athletic Center already houses a number of businesses, including an Anytime Fitness, Burn Boot Camp, Aspire Therapy clinic and a ballet school. Sporting tournaments frequently are held in the building’s athletic facility.

Moore doesn’t expect the school to displace anyone in the building.

Merit and the 2023 Madison School Board election

Badri Lankella wants to serve his community.

Right now, the computer engineer working with the state Department of Natural Resources believes the best way he can do that is running for Seat 6 on the Madison School Board.

“Every issue, I look at the details,” Lankella said. “I’m going to talk to everyone. I’m the collaborator, I’m going to talk to teachers, I’m going to talk to the union, I’m going to talk to the administration.”

Lankella faces challenger Blair Feltham in the April 4 election to succeed Christina Gomez Schmidt, who decided not to run for reelectionafter her first term on the board. Nicki Vander Meulen is running unopposed for a third term in Seat 7.

The election comes at a key time for the Madison Metropolitan School District. Whoever wins will be part of choosing the next superintendent and making difficult budgetary decisions amid the ongoing staffing shortage.

Madison School District looks to end staff COVID-19 vaccine mandate

“A lot has changed since September of 2021,” Stampfli told the Madison School Board at a work group meeting Monday.

The original mandate requires staff to have the primary series of the COVID-19 vaccine, which is either the first two doses of Pfizer or Moderna vaccines, or the single dose of the Johnson & Johnson vaccine, but it has not been updated with any of the boosters that have been introduced and administered in the nearly two years since.

There is also an increased immunity against the virus throughout the community, Stampfli said, as well as changes in the vaccine process, including a plan unveiled by the Food and Drug Administration that COVID-19 boosters should be provided annually, like the flu shot.

Option A would use a curriculum developed by Savvas for both English language arts and Spanish and dual literacy programs at a cost of $1.17 million. Option B would use Open Up for English and Savvas for Spanish and dual literacy programs for $2.1 million.

Whichever is selected, the district will use one-time federal COVID-19 relief funds for the purchase. Implementation will begin ahead of the 2023-24 school year.

Option B would be more similar to what the board chose a year ago, with Open Up as the vendor for English language arts at elementary schools and a different vendor as the choice for multi-language programs. The consistency with Open Up from elementary to middle school was one favorable point for administrators in Option B, as it would make the fifth to sixth grade transition easier for students.

Jackson explained that in Option A, Savvas’ curriculum prioritizes consistency within school buildings, while Option B’s Open Up choice would move toward coherence across the district.

Either way, she stressed the differences between English programs and dual-language programs and that even if they choose to use a single vendor for both, the way those programs function will be unique to each other.

Taxpayer Supported Madison School District PR Employee Sues to Stop Open Records Disclosure

The Madison Metropolitan School District is being sued by one of its own. MMSD Head of Communications Tim LeMonds does not want two documents from an NBC15 Investigates’ open records request released – and he is taking his bosses to court to stop it.

On Friday, LeMonds filed a preliminary injunction motion against MMSD, urging a Dane County judge to conduct an expedited review of the documents in question, two emails he does not want the public to see.

LeMonds’ lawyers argue that what is in those emails would likely be bad for his repution. Their release would lead to “unwarranted, unfair and irreversible public ridicule and gossip, negative public perception, and jeopardize his ability to credibly perform his duties (with MMSD).”

Following losses in the last school board election, Milwaukee’s teachers union has paid big this season to support its favored candidates, reporting spending over $88,000 since January.



Rory Linnane:

The political action committee of the Milwaukee Teachers Education Association, the union for MPS staff, first gave about $11,000 directly to candidates’ campaigns in January: $5,000 to Zombor, and nearly $1,500 each to Hart, Herndon, O’Halloran and Siemsen.

In March, the group spent another $41,422 on postcards and digital ads for Zombor, $22,000 for Herndon, $12,000 for Hart, $1,100 for Siemsen and $1,100 for O’Halloran.

The MTEA’s PAC is funded by MPS staff who choose to pay into it on top of their membership dues. That includes over 5,000 teachers and other staff members.

Ben Ward, MTEA executive director, said he thought the school board has been moving the district in a positive direction since the 2019 elections, when union-backed candidates swept their races. MTEA has advocated for board decisions since then to pursue a referendum for arts and music funding, increase minimum wages in the district and implement experience-based raises, Ward said.

A troubling post-pandemic pattern is emerging across the nation’s schools: test scores and attendance are down, yet more students are earning high school diplomas. A new report from Washington, D.C., suggests bleak futures for many of these high school graduates, given the declining rate of college attendance and completion.

The numbers are stark in a March 2023 report by the D.C. Policy Center, a nonpartisan research organization. Almost half the students in the district – 48 percent – were absent for 10 percent or more of the 2021-22 school year. Seven years of academic progress were erased in math:  only 19 percent of third through eighth graders met grade-level expectations in the subject in 2021-22, down from 31 percent before the pandemic. 

At the same time, the high school graduation rate rose to a record 75 percent, up from 68 percent in 2018-19. Although the city is producing more high school graduates, fewer of them are heading off to college. Within six months of high school graduation, only 51 percent of the class of 2022 enrolled in post-secondary education, down from 56 percent from the class of 2019.

New York City education officials plan to take a stronger hand in what curriculums educators can use in their classrooms, a move that could represent a major shift in how the nation’s largest school system approaches teaching and learning, Chalkbeat has learned.

The education department recently began laying the groundwork for superintendents to choose from three reading programs to use across their districts. It is also launching a standardized algebra program in many high schools. The plans have not been announced publicly, but were confirmed by four education department employees familiar with the city’s literacy efforts and multiple school leaders.

Principals historically have enjoyed enormous leeway to select curriculums. Proponents argue this allows schools to stay nimble and select materials appropriate to their specific student populations. But some experts, and even the city’s own schools chancellors, have argued that the approach can lead to a tangle of instructional practices that can vary widely in quality from classroom to classroom.

It was mentioned 450 times in the survey responses. Students attribute these problems to an environment with “no consequences.”

Some female students reported that they won’t use the bathrooms at school because “they are not safe, drugs are done in there, and destruction, and even sex.” Teachers were well aware of these problems.

“This month I’ve seen a lot of students pushing, shoving, and verbally harassing each other during passing time,” one anonymous respondent wrote.

“I am concerned about the amount of alcohol and drug use happening inside the school building,” another wrote.

Releasing the complaint that staff filed would harm LeMonds and the school district because he is the district’s spokesperson, LeMonds’ complaint says, arguing that the potential harm outweighs the public benefit of the document’s release.

“Releasing the subject documents would almost certainly subject Mr. LeMonds to unwarranted, unfair and irreversible public ridicule and gossip, negative public perception, and jeopardize his ability to credibly perform his duties as (the district’s) chief public spokesperson — especially since all of the accusations in the complaint were found to be without merit by (the district),” the court complaint states.

A candidate for the Madison School Board on Tuesday said schools are the product of “white supremacy” and accused her opponent of favoring competition in the classroom — a characterization her opponent embraced.

“Our schools are products of white supremacy,” said Blair Mosner Feltham, an equitable multi-level system of supports site coordinator at Sun Prairie East High School and former Madison teacher.

“They reinforce white supremacy and if we want to talk about how we make sure all students are thriving in our schools, we need to fundamentally change both the structure of our schools and the purposes of them,” she said.

Badri Lankella, though, said “we need to have competitive students.”

“Yes, I am for competitive schools, because that’s where everything is moving towards,” he said.

The young woman is currently employed as — take this pill with a glass of water: an “equitable multi-level system of supports site coordinator” at Sun Prairie East high school. What, might you wonder, is that? (!!!) We looked it up and we’re still at a loss.

Ah, memories. Years ago (15?) I participated in a few school district strategy sessions. I sensed that the teachers in that forum were divided between: 1. Hold hands for 12 years and give the students a piece of paper, and 2. Learn, rigor and high expectations. My sense was that the former were winning the battle.

This month, the Madison School Board offered four opportunities for the community to share what’s going well — and what’s not — in the district.

Events at each of the four large high schools showed what is on the minds of parents, staff and students, including how concerns differ from building to building. After the third session, School Board President Ali Muldrow expressed emphatic appreciation for what they heard from the two dozen speakers that night.

“I have to say that tonight’s listening session allowed for me to really re-fall in love with the work we do as board members and with this community,” Muldrow said.

Madison mayor election and the taxpayer supported k-12 schools

The debate also featured discussions about how high-density developments affect Madison Metropolitan School District’s student population and whether it is time to bring police back into schools.

Reyes said there is concern among some residents that large housing developments taking place all over the city are pricing some families out of areas and diminishing school enrollments. She said that as mayor she wants the school district to be represented on Madison’s Plan Commission so that schools have a voice in development proposals.

Rhodes-Conway pointed out that there already is a slot reserved for the MMSD superintendent on the Plan Commission but that no one from that office has ever decided to serve in the position.

“We have asked repeatedly to have the school district appoint someone to the Plan Commission,” Rhodes-Conway said. “They have declined so far, which I think is really disappointing. In the meantime, we need to listen to what the district has told us, which is that we need more housing.”

Reyes, who was Madison School Board president during much of the pandemic, said she did not see collaboration between the school district and the mayor’s office during her tenure.

“This is the first time I’ve heard that there was a relationship between the school district and the mayor’s office,” Reyes said about Rhodes-Conway meeting with the superintendent. “During the pandemic we were on our own and did not have the support of the mayor.”

“It’s possible the superintendent didn’t keep my opponent informed of his calendar, but we met every week during the pandemic about how we could keep schools safe, keep kids fed and do virtual learning for kids who could not learn at home,” Rhodes-Conway replied.

On the topic of school safety, Rhodes-Conway pointed to the city’s Community Alternative Responsive Emerging Services, or CARES – a unit dedicated to deescalating tensions during a mental health crisis – as a program that could help school safety. CARES started in September 2021 during Rhodes-Conway’s first term as mayor.

Reyes said she believes it is time to consider whether to return school resource officers to school beats. Reyes, a former law enforcement officer, voted against removing police from schools prior to the pandemic during her tenure on the School Board, but then reversed course in the wake of George Floyd’s murder and voted to remove the resources officers from Madison schools.

An effort that began in summer 2021 to gauge the Madison Metropolitan School District’s equity work found that students, parents and staff are aware of some district efforts toward diversity, equity and inclusion but want more involvement and more communication with district administration.

The district partnered with Jerlando Jackson, now the dean of the College of Education at Michigan State University, for the work, which included interviews of 380 people. Jackson was the director of the Wisconsin Equity & Inclusion Laboratory at the University of Wisconsin-Madison until last summer when he left for MSU.

On Monday, Jackson presented the findings to the Madison School Board along with seven recommendations:

• Develop and disseminate a DEI strategic plan

• Create systems of rewards and accountability for MMSD DEI efforts

• Generate a strategy for hiring and retaining teachers of color

• Engage families in DEI efforts

• Review and standardize DEI curriculum and implementation efforts across the MMSD

• Emphasize and advance diversity in all its forms

• Provide transparent, accessible, and safe opportunities for feedback to MMSD leaders

District officials and School Board members suggested changes in response to the audit must work in conjunction with changes resulting from the recent human resources report and the ongoing strategic framework recalibration process. Superintendent Carlton Jenkins said moving toward equity will require a “collaborative effort” with the board, administration and community involved.

“This has got to be all in,” Jenkins said.

[00:00:00] Senator Duey Stroebel: Actually looking at, uh, US census data, all funds, all sources. Um, Wisconsin’s at about $13,000 and Mississippi is about $9,200. So there’s significant that’s per the US census data, all funds, all sources. So pretty clear there. I think it’s, uh, we’re 23rd. They’re 47th. So, which I think bears out with her, uh, slide up there that showed that we spend, uh, about 37% more in education.

[00:00:29] Uh, than than they do. But, um, one thing I want to talk about, you know, we’re here to talk about, okay, how are we gonna improve reading and what’s the best technique to do that? And you talk about reading coaches and the resources and the things we’re doing to improve reading. It kind of seems like we’re beating the head against beating, we’re beating our head against the wall when we’re really not using the right techniques.

[00:00:53] I mean, we can throw all the money in the world and if we’re not doing it the right. , we’re not gonna see results. I mean, do you agree? Am I off the, [00:01:00] am I crazy about that? Or what?

Which is why that, why we are advocating not only for a recommended instructional materials list, but also resources to address the how, how our educators use those materials in order to provide the instruction to implement the evidence-based early reading, uh, instructional practices, and.

[00:01:23] The same thing at at higher ed, not only looking at the state statute to ensure that what we’re requiring of our higher ed programs includes all of the components of early evidence-based early reading practices, but that we also are in the position of providing them with some of the how.

Duey Stroebel: Well, it’s kind of too bad that we’ve got the smartest people at our universities, and yet we have to create a law to tell them how to teach.

[00:01:52] I mean, I don’t. You know, that’s weird. Um, you’d think they should be the ones who would know the innovative ways to teach. Not that us [00:02:00] legislators have to create legislation to tell them how to teach the way, uh, scientific data shows should be taught. So I guess my point is that, you know, yes. Blaming on universities.

[00:02:12] Sure. Um, but we’re, um, spending money on all these things and we’re really not doing it right. So I, I guess the focus. I mean, the 15 million they do a year. I mean, that’s a drop in the bucket. But you know, when you look at the overall spending and when you look at what we’re spending now today to teach, uh, a curriculum that’s ineffective, I think maybe we really wanna focus on, okay, how do we, sad to say, have to retrain our teachers from what they learned at the university system.

[00:02:43] And, um, I, I think that that should be our focus. And after that, I feel very confident that once our teachers have been trained, That they’re gonna be able to deliver this content and our kids are gonna be able to excel. So, um, I’m not sure, you know, if it’s that much, uh, [00:03:00] money that we’re really even talking about here, considering when you look at the overall big picture on spending and kind of the fundamental flaw that we’re really trying to tackle at this point in time.

But the 187 pages still feature plenty of suggestions for MMSD to improve how it works with students with disabilities, with some staff reporting pressure to pass students no matter what, criticism of the usefulness of district guidance and data highlighting the longstanding disparities for students by race and special education status. • Students with disabilities, especially students of color with disabilities, are not achieving or graduating at levels the district can celebrate.

• The district’s instructional and administrative infrastructure is not conducive to improved outcomes for students with disabilities.

• The district has many strengths upon which to build, which are outlined throughout the report.

• While much progress has been made on the (2016 special education) plan, and many of the goals have been met, doubling down on it, in collaboration with general education partners, is necessary, especially in light of recent leadership turnover and the pandemic.

Statewide, Wisconsin funds more than 20,000 “ghost students,” children outside of the school system who are still counted as being enrolled.



WILL:

Since the beginning of the COVID-19 pandemic, enrollment in Wisconsin schools has dropped by more than 3%, with some districts suffering even greater declines. But an antiquated school funding system means that Wisconsin taxpayers are still paying for students that are no longer in the system. Wisconsin uses what is known as the “Three-Year Rolling Average” to count students for the purposes of calculating school district revenue limits. Under this system, three years of enrollment data are used in calculating how much money the district is able to collect from state and local taxpayers. In an era of rapid enrollment declines across Wisconsin, this system means that substantial amounts of funding are misallocated to districts for students who no longer attend school in the district. This paper attempts to quantify just how costly this is for Wisconsin taxpayers, and offers some alternatives.

The “Three-Year Rolling Average” is an antiquated system of school attendance, costing taxpayers millions. These days, we know where each student is every day in Wisconsin. Our school funding system should reflect that rather than being years behind.

Statewide, Wisconsin funds more than 20,000 “ghost students,” children outside of the school system who are still counted as being enrolled. Statewide, a net of about 20,703 students who are no longer in the system are funded by state taxpayers.

More than $359 million dollars is misallocated to “ghost students” in Wisconsin.
Due to the three-year rolling average, Wisconsin taxpayers are on the hook for hundreds of millions for students that no longer exist in the school system.

Our report outlines a pathway for a better system. Wisconsin should move to a more dynamic funding system that funds students where they are rather than where they used to be. Student counts should be updated more regularly and funding should be based on those amounts.

WILL:

WILL has learned that DPI goes beyond these requirements in evaluating new school applications. Even if schools submit accurate and sufficient information according to our state law, if they do not comply in precisely the manner that DPI requires, their applications are often denied. WILL sees no justification for the practice of DPI exceeding its lawful authority in such a way that keeps schools, and in turn families, out of the parental choice programs.

More on the Letter: WILL and School Choice Wisconsin’s letter indicates we are filing an open records request for information regarding any new private school applications to the Wisconsin Parental School Choice program for the 2023-24 school year; and how DPI ruled on each application. We are also requesting all records related to appeals for denied applications. As for future litigation, the letter asks DPI to either discuss a possible solution, or let us know if such a conversation would not be productive so that a lawsuit challenging the requirements can be filed.

Renaming Madison’s Jefferson Middle school after Ezekiel Gillespie



Lucas Robinson:

The Madison School Board unanimously voted Monday night to rename Jefferson Middle School after 19th-century Black voting rights activist Ezekiel Gillespie.

A survey of about half of the school’s students showed a preference to replace President Thomas Jefferson’s name with writer Maya Angelou, the other finalist whittled down by an ad hoc committee in recent months. But the board ultimately decided to go with Gillespie, largely because of his role in securing voting rights for Black people in Wisconsin.

Board President Ali Muldrow acknowledged the vote of students at the school at Monday night’s School Board meeting, saying that “in middle school the desire to be self-determined is pretty profound.”

“To have two people who had a significant impact on Black history, to choose between them is deeply challenging,” Muldrow said.

Board member Savion Castro, like his colleagues, suggested he greatly appreciated the student voice in the survey, but acknowledged that Gillespie’s contribution is not well-known. He added that he was glad Jefferson, the third president of the United States and slaveholder, would no longer be recognized in this way.

Report: 23 Baltimore Schools Had Zero Students Proficient in Math

recently wrote about how public schools and boards are making the case for school choice advocates with failing scores and rising controversies. The latest shocking statistic was released this week that 23 schools in Baltimore City had zero students who tested proficient in math. Those schools include 10 high schools, eight elementary schools, three Middle/High schools and two Elementary/Middle schools. The state found that 2,000 students who took the state test could not do math at grade level.

We previously discussed the Baltimore public educational system as an example of where billions of dollars have been spent on a system that continues to have appalling scores and standards. Recent data now offers another chilling statistic: 41 percent of students in the Baltimore system have a 1.0 (D) GPA or less.

We also discussed how a high school student almost graduated near the top half of his class after failing every class but three in four years. He had a 0.13 GPA. His mother objected and went public.

The top spending public school districts are also some of the worst performing school districts.  New York topped the per capita spending at $24,040 per kid. Washington, D.C. is close at $22,759.  Baltimore is often ranked in the top three per capita spending districts. The total budget for Baltimore public schools is roughly $1.2 billion. That is for a city with a total population of roughly 600,000 (The greater Baltimore metropolitan area is 2.8 million). In 2015, the school population was 84,000 kids.

Faced with school boards and teacher unions resisting parental objections to school policies over curriculum and social issues, states are on the brink of a transformative change. For years, boards and teacher unions have treated parents as unwelcome interlopers in their children’s education.

Congress gave $1.49 billion in taxpayer and borrowed funds to Wisconsin schools. Are they investing wisely?

The coronavirus pandemic was a 2-year catastrophe for children. Students suffered through virtual schooling, quarantined teachers, and emotional misery. Academic results, the lowest this century, still have not recovered.

After sending $860 million to help Wisconsin public schools manage through spring 2021, Congress sent a final $1.49 billion to get students back on track.

The goal? Do whatever it takes to catch kids up by September 2024.

Why Did Schools Stop Teaching Kids How To Read?

Public schools have failed to teach kids to read and write because they use approaches that aren’t based on proven techniques based on phonics. Many schools have been influenced by the work of Columbia University’s Lucy Calkins, who is the subject of a new podcast series from American Public Media, Sold a Story, “an exposé of how educators came to believe in something that isn’t true and are now reckoning with the consequences—children harmed, money wasted, an education system upended.”

“The South Bronx elementary school where I taught 5th grade for several years was a proponent of Calkins’ approach,” Pondiscio wrote in a 2022 New York Post op-ed. “We adopted her teaching methods and employed her literacy coaches for years, to very little effect. Her greatest sin against literacy comes after kids learn to ‘decode’ the written word, whether or not they are taught with phonics, which is just the starting line for reading.”

How did this happen? Is the solution school choice—a system in which parents can opt out of traditional public schools and their flawed approaches to teaching reading? As Pondiscio argues, is withdrawing “concern for traditional public schools” equivalent to withdrawing “concern for our republic”?

The district doesn’t need to approve any new funds to provide this raise, and instead, the enrollment for summer school this year will be capped at 4,000 students to be able to hike pay within the already approved budget.

The pay raise increases staffing costs from $2.8 million last year to $3.5 million.

Green said every year the district invites about 7,000 students to apply for summer school, and hears back from about 4,000 to 5,000. On average, about 5,500 students are served. Last year, there were about 3,520 students who were enrolled at the start of summer.

Although no new funding needs to be approved, the School Board will vote on the item next week largely to update the district’s handbook to give more flexibility for summer school pay in the future and start the base pay at $28 going forward.

“Summer school is an important tool to maintain and advance academic and social outcomes for our students and our ability to staff this program is important,” Madison School Board Member Savion Castro said at a work group meeting Monday. “I am impressed that we have found a way to include some level of pay increase for staff in this program so that we can fully staff it while keeping in the same funding footprint as prior years.”

Madison Schools’ Safety Survey

Surveys to help guide the Madison public schools’ Safety and Student Wellness Ad Hoc Committee have a long list of suggestions for the district.

The responses illustrate the difficult and involved task in front of both the committee, which is nearing its completion after forming last March, and the Madison Metropolitan School District as it works toward making schools as safe as possible while meeting the needs of every student.

Within the themes, it’s clear that some respondents see different priorities on the path to achieving safety and wellness. Some responses focused on the importance of identifying and helping students in need or who are on the receiving end of bullying, for example, while others pointed to a perceived lack of consequences for students who disrupt the learning environment and mention too much fighting.

Madison Teachers Inc. president Michael Jones, who is a member of the ad hoc committee, suggested it will be important to come up with a way to make sure the district’s response to the survey is “meaningful.”

“It aligns with a lot of previous discussions around culture and climate and also around things that as a union we’ve tried to put forward,” Jones said. “It was heartening to see all the major stakeholders, there’s a lot of overlap, there’s a lot of Venn diagramming in terms of vision.”

“In the survey, respondents highlighted that there were too many fights and and too much bullying, and unsafe environments throughout schools, all without much accountability”

This week the school district contended with more violent incidents. On Tuesday, a 14-year-old was stabbed in the chest in a park after an incident at a middle school parking lot earlier in the day, and on Wednesday, police were called to East High for a fight between students.

Some survey respondents called for the removal of students who were disruptive in classes. Others want to bring back school resource officers, who were removed from schools in 2020. Additional cameras, security and metal detectors in buildings also were recommended.

One large theme from the survey results was a stronger emphasis on mental health for both students and staff. Specifically, respondents said there needs to be more support staff, training, dialogue and resources for those who are struggling.

In terms of nutrition, those who responded said there needed to be higher quality meals and lower prices, as well as provisions on hand for students who face food hardships when they aren’t at school.

Enrollment in Wisconsin’s traditional public schools has continued to decline since the start of the pandemic.

There isn’t a single answer as to where students are going and why. A nationwide declining birth rate and changing trends in where families live are big contributors.

But there’s clearly a growing appetite in Wisconsin for more alternative schooling, including charter schools and home-schooling.

Ten new independent charter schools have opened across the state since 2019, with 35 options now available. Other options that break the traditional mold have also sprouted, from a new forest school in La Fargeto an expanding campus at Madison’s private Hickory Hill Academy.

Why is One City Charter School Facing Legacy Madison Media Blowback?

Thank you CapTimes for printing my OpEd. Interestingly, in a conversation with the Wisconsin Department of Public Instruction yesterday, state officials told us that we are legally obligated to count our students who are enrolled and present on the day of the pupil count (tomorrow, Friday). This is state law. They also told us we “should keep the money”.

As a side note, see a second article that I posted in the comment below about this. Our counting or not counting our Scholars will not have an impact on MMSD. What will impact them and other districts more is if our Scholars enroll with them or not. So, why did One City Schools get singled out and why do people expect us to do what NONE of the 423 traditional public school districts or 60 independent public charter school districts in Wisconsin do? One word answer: Politics.

It’s funny how in my home town (Madison), I am personally and constantly expected to go above and beyond everyone else and work magic with a too little funding. MMSD will receive and spend $23,000 per student, on average from the state, federal government and local property taxes. One City will only receive approximately $13,000 per student from the state and federal government, and not one dime of local property tax money, even though we operate “public schools” that educate the public’s children. Tell me if that’s fair. I have to raise $9,000 per student (multiplied by 400+ students) from private philanthropy, foundations, corporations and people like you in order to operate our schools.

This is totally not fair.

Public school districts like MMSD, Middleton, etc also get to count our charter school students in their annual property tax levy if our Scholars reside within their districts, and keep that money.

They do not “transfer” this money to us…but this wasn’t mentioned in any of the press releases or articles other organizations wrote about us. Why not?

Why not point out that traditional public school districts get to keep thousands of dollars per child for students they don’t educate and are not enrolled in their schools? It’s very disingenuous and unfair, and is only meant to draw negative public attention to public charter schools and One City. It’s sad, very sad.

Independent public charter schools like One City are also expected to produce dramatic test score improvements annually when each year we enroll many new students who are two or more years behind academically. We also had to alter our entire school model just 18 months after opening our first charter (elementary) school after the pandemic arrived in March 2020. Thankfully, this school year, we have been able to shift back to our original school design and are enjoying doing our work with our Scholars the way we always intended.

This is how innovators in education who go against the status quo in Dane County and Madison are treated. We get questioned, ridiculed and smacked for trying to do something new, despite 90 percent of Black and 80 percent of Brown students failing miserably in our public schools – EVERY YEAR.

BUT YOU DON’T SEE MANY ANY HEADLINES about that, or about the BUT YOU DON’T SEE MANY ANY HEADLINES about that, or about the fact that just 35 PERCENT OF ALL third graders in Wisconsin, including students from all racial backgrounds, can read to learn by the end of 3rd grade. That’s all – 35%…..and just 8% of all Black third graders and 18% of all Latino third graders in Wisconin.

The $250,000 One City Schools might receive for our Scholars is more important than addressing the massive failure of thousands of our children in Madison, Dane County and our state?

Our priorities continue to be jacked up and off-base, people. Our chickens will come home to roost, and in many ways, they already are.

No, schools are not solely at fault for the failure of our children BUT One City focuses holistically on the family, community, students and their habits of character), and our educators and school at the same time. We have expectations and supports for everyone. We go at these challenges head on and are transparent about our challenges and results so we and others can learn from them.

One City Schools is an asset to Madison, Dane County and Wisconsin, and should be treated and supported this way. Who else is trying to tackle the challenges the way we are? Onward.

Commentary on Taxpayer Funded K-12 Education: Madison’s $597.9M budget $23k/student! vs Tiny One City Charter School

For the full 2022-23 school year, an independent charter school like One City receives $9,264 per student from the state that the student’s resident school district would otherwise receive.

The state counts students twice each school year: the third Friday of September and the second Friday of January.

If a student is enrolled at such a charter school for only one of those days, the school would effectively receive $4,632 in aid that the school district would otherwise receive this year, according to an email from state Department of Public Instruction communication specialist Chris Bucher.

For the 51 students from MMSD who have attended One City this year, then, the charter was set to receive a total of $472,464 for the school year.

(No mention of property taxes and other funds that Madison’s well funded K-12 system receives, roughly $23k/student!).

Today, the local media reached out to our organization to inquire about another organization’s concerns regarding whether One City Schools will repay the Wisconsin Department of Public Instruction (DPI) the per pupil funds it allocates to our public charter schools.

One City Schools is a careful steward of public dollars. We are 100 percent in compliance with state and federal requirements for spending public dollars. Any claims to the contrary are false.

The Wisconsin Department of Public Instruction has a state-approved formula for allocating funds to all public schools – both charter and district schools. We receive per pupil payments annually, from DPI, divided into four payments during the school year.

Additionally, all federal funds we receive are reimbursable grants, meaning, we must spend the money before we can receive payment from DPI. Therefore, we don’t have anything to repay for our federal grants.

After receiving a wave of conservative backlash, a student-organized drag show at Madison East High School has been postponed because of safety concerns.

In addition to an “abundance” of supportive messages regarding the event, the Madison School District also has received “several messages that have raised a number of safety concerns for this student-led event,” according to district spokesperson Tim LeMonds.

“Without question, the safety of all our students, staff and families must be our top priority,” LeMonds said. “Therefore, due to these recent safety concerns, we have decided to postpone this event to a later date.”

“We know how disappointing this news will be for many of our students. However, we feel this decision was necessary to provide time to refine our safety plan around this very important celebration,” he said.

One City Schools shutting down ninth and 10th grades

Citing an exodus of core-class teachers, Madison charter school One City Schools told parents of about 60 students Thursday that it would shut down its first ninth- and 10th-grade classes after only one semester.

The school’s vice president of external relations, Gail Wiseman, said the school lost five teachers since the beginning of the school year and had to make the “really difficult decision” to close the grades effective Jan. 20, or the last day of the semester.

Madison School District Superintendent Carlton Jenkins was at the Thursday meeting and pledged the district’s assistance in transitioning students to Madison schools, Wiseman said, but One City has also been in touch with officials from the Sun Prairie, Middleton and Verona school districts to serve students who live in those districts.

“At present, there is a clear divide of philosophical beliefs on the Prince George’s County Board of Education about how we should move forward as a school district,”

The 13-member board that oversees the county school system has been embroiled in controversy in recent years, with Chair Juanita Miller and various board members trading accusations related to contracts and violations of board policies. An independent audit last year found problems on both sides, while separately the State Board of Education requested Miller’s removal from officeover allegations of misconduct. (Following that request, County Executive Angela Alsobrooks asked that Miller step aside.) Miller opted instead for a state disciplinary hearing, which concluded late last year.

A person who picked up the phone at the school board’s office said the body would have no comment on Goldson’s retirement announcement.

Goldson led Prince George’s County Public Schools during the COVID-19 pandemic, and requiring masking by staff and students longer than any other jurisdiction in Maryland. (The county was among the state’s hardest-hit by the virus.) Early in the pandemic’s shift to virtual learning, she published an op-ed in The Washington Post urging federal action to help students get online more easily. (More than half of the students in Prince George’s County Public Schools qualify as low-income.)

“Removing systematic barriers to education is a national emergency every day, but now the urgency is as great as ever before. In these trying times, we are already seeing what happens when we don’t answer the call when an alarm is sounded — or wait too long to act,” she wrote.

Goldson also urged Maryland lawmakers and officials to fully fund a sweeping bill to expand free pre-Kindergarten programs, increase pay for teachers, and speed the modernization of schools across the state.

Virginia Attorney General Jason Miyares is launching an investigation into one of the state’s most prestigious high schools, acting on complaints that students there weren’t properly recognized for their achievements on a standardized test.

Miyares said at a news conference Wednesday that his Office of Civil Rights is investigating the Thomas Jefferson High School for Science and Technology not only for its failure to timely notify students of a commendation they received in a scholarship competition, but also the school’s recently overhauled admissions policies.

The public high school commonly known as TJ is located in the Washington, D.C., suburb of Fairfax County and regularly ranks as one of the best in the country. Admission to the school is highly competitive, and parents map out strategies to gain entry for their children years in advance.

A majority of students are Asian American and for many years African American and Hispanic students have been woefully underrepresented. In 2020, the Fairfax County School Board dramatically overhauled the admissions process, scrapping a high-stakes standardized test and setting aside a certain number of seats on a geographic basis.

The changes prompted claims of discrimination against Asian Americans who had fared well under the old system, and a federal lawsuit challenging the new procedures is going through the appeals process.

The program focuses on expanding vocabulary and giving teenagers reading strategies — such as decoding words — that build upon fundamentals taught in elementary school. The curriculum is embedded not just in English, but also in math, science and social studies.

With his new tools, Roderick studied “I Have a Dream,” the speech by the Rev. Dr. Martin Luther King Jr. — no longer skipping unfamiliar words, but instead circling them to discern their meaning. And when scanning sports news on ESPN in his free time, he knew to break down bigger words, like the “re/negotia/tion” of a player’s contract.

The instruction “helped me understand,” said Roderick, 17, who is on the honor roll at Oakhaven High School and is preparing to take the ACT. (He and other students, interviewed with parental permission, are being identified by their first names to protect their privacy.)

The program in Memphis is an extension of a growing national movement to change the way younger children are taught to read, based on what has become known as “the science of reading.” And it is a sign of how sharply the pendulum has swung in the decades-long, contentious debate over reading instruction, moving away from a flexible “balanced literacy” approach that has put less emphasis on sounding out words, and toward more explicit, systematic teaching of phonics.

Choice and competition have a positive effect on public-school performance.



Wall Street Journal:

Several red states appear poised to adopt expansive school-choice policies this year, prompting the teachers unions and their allies to claim that the sky is falling, especially in rural areas. Corey DeAngelis is right to call out the Chicken Littles for their scaremongering (“The Little Red Schoolhouse Could Do With a Little Competition,” op-ed, Dec. 17), pointing to copious evidence that choice and competition have a positive effect on public-school performance.

Arizona, a longtime leader in school choice, is the perfect example. It was the first state to enact tax-credit scholarships in 1997 and K-12 education savings accounts in 2011. More students in Arizona exercise school choice than in any other state. If school choice destroys rural public schools, as opponents claim, then Arizona should be ground zero.

The opposite is true. Arizona’s rural students have improved much more than rural students nationwide have over the past decade. From 2007 to 2019, Arizona rural students’ fourth and eighth grade reading and math scores on the National Assessment for Educational Progress increased by a combined 21 points, while scores in rural schools nationally decreased by two points. Postpandemic, Arizona’s rural students were still up a combined nine points while rural students nationally dropped 17 points from 2007.

2023 Madison School Board election, Christine Gomez-Schmidt bows out

In her message to constituents, Gomez Schmidt listed a series of district accomplishments in her three years on the board, including navigating the pandemic, adopting new K-5 reading curriculums, investing in the “science of reading” and seeing the community approve a record referendum.

“I am grateful that this experience has challenged me in how I think about achievement, disparities, privilege, and opportunity,” she wrote, coming one day after a vote on standalone honors classes. “My sincere hope is that we can collectively find ways to continue to have necessary and challenging discussions with respect for one another. Our children deserve to see us model how to collaborate and build consensus to solve complex problems.”

Thanking her supporters for the opportunity to serve in the role, Gomez Schmidt also looked forward, writing that the district “must decide what we expect from, and for, our public schools,” which face “significant” challenges.

Declining enrollment, disparities in achievement, staff recruitment and retention, needed investment in our aging facilities, and a clear, multi-year strategic plan are a few of these,” she wrote. “Yet we have a Governor dedicated to education, incredibly strong support for public schools in Madison and Fitchburg, and a developing vision for the future.

“We need impactful change in our handbook before May 15 or the mass exodus of staff will continue,” she said. “It’ll become impossible to staff our schools with qualified teachers and the staff that our students deserve.”

MMSD spokesperson Tim LeMonds wrote in a statement Tuesday that the district “has hired more teacher staff this year than ever before, and now employs its largest teacher workforce in many years.”

“We value the voices of all MMSD staff. Our teachers who participated in public comment at last night’s Board meeting spoke from the heart, and their words were powerful,” LeMonds wrote. “The district’s recruitment strategy continues to make progress in addressing the nationwide teacher shortage impacting our school district.”

He said the 100 vacancies “only represent approximately 3.8% of our roughly 2,600 teaching positions and 1.7% of our overall staff.”

LeMonds also alluded to the ongoing financial challenges school districts face, calling the challenges ahead “serious” after a state budget that did not raise revenue limits for school districts each of the past two years.

Madison School Board: “voted 4-3 to keep stand-alone honors classes for the time being”

Board members Gomez Schmidt, Ali Muldrow, Laura Simkin and Nicki Vander Meulen voted against eliminating stand-alone honors classes. Board members Nichelle Nichols, Maia Pearson and Savion Castro voted in favor of eliminating them.

Stand-alone honors classes are meant to be more academically challenging. Students can also earn honors credit in some general classes by excelling in them.

“Rigor should not be synonymous with honors,” Pearson said. “Rigor and high expectations should exist in all of our classes and should be accessible to all of our children.”

Parents told the board they felt there was little transparency in the district’s proposal. One parent said it felt like the decision had already been made.

Madison Schools Safety Survey

A survey that will help guide safety and student wellness work in the Madison Metropolitan School District is open for staff, parents and students until 11:59 p.m. Monday.

The Madison School Board’s Safety and Student Wellness Ad Hoc Committee met Thursday for the 16th time to discuss progress on the subject. The group was formed in the spring in response to a series of safety concerns last school year.

So far, the three-question survey has received about 6,500 responses, committee co-chair and Memorial High School senior Lavenia Vulpal said. District spokesperson Tim LeMonds called it a “very, very good response” level.

“Please encourage people you know to get online and fill it out,” Vulpal told committee members. “We are still looking for ways to reach students, staff and parents.”

Madison school proposal to end standalone honors classes set for a vote



Dylan Brogan:

The “time is now” to eliminate standalone honors classes in Madison high schools, according to Superintendent Carlton Jenkins. At a Dec. 5 school board meeting, Jenkins said a “racist attitude” underlies support for keeping separate classes that offer more rigorous coursework to students. 

“We are no longer going to uphold what is considered to be a segregated mentality,” Jenkins said. “We should work together to get it done.”

To replace traditional honors classes, Jenkins wants to expand the district’s current Earned Honors program to all core classes — English, math, science and social studies — offered to Madison freshmen and sophomores. Earned Honors started in 2017 and is at different stages of implementation at each high school. The program allows students to receive an honors credit on their transcript by doing extra work while enrolled in a non-honors class. 

District officials first informed the board in April 2021 that they were planning to phase out traditional honors classes for 9th and 10th graders. But administrators in February “hit pause” on that plan “to allow for more time to review this strategy, obtain student and community input, and board involvement.” This fall, however, staff began moving forward with plans to expand Earned Honors while sunsetting standalone honors classes for freshmen in 2023 and sophomores in 2024.

The policy shift didn’t need board approval but, according to The Capital Times, members Christina Gomez Schmidt and Nicki Vander Muelen requested a vote. Board president Ali Muldrow now says it’s “likely” the board will vote on two issues at its meeting on Dec. 19: whether to expand the Earned Honors program and whether to eliminate standalone honors classes.

Here’s what you should know about honors classes in the Madison School District

His stand-alone classes didn’t give him that much deeper of an understanding of a subject than earning honors did, Hernandez said.

In his general Western civilization class, for example, he had to read an additional book to earn his honors credits, which allowed him to gain more knowledge than he normally would have.

“(Stand-alone) honors does feel slightly more rigorous, but usually still manageable,” West High senior Holly Wright said.

Wright said she liked the earned honors format, though, because it allowed her to dive deeper into classes and subjects she enjoyed without it feeling like too much additional work.

Honors classes are often seen as precursors for Advanced Placement, or AP, classes that students take later on, but the two are separate.

AP classes are designed by the College Board to give students the chance to earn college credit when they perform well on the exam given at the end of the course. Students have the option to take the test or not, and AP courses are most often offered to juniors and seniors.

Report: K-12 school property tax payments will rise statewide



Scott Girard:

Those totals don’t include the Madison Metropolitan School District or Milwaukee Public Schools, both of which passed operational referendums in 2020 that continue to allow them to surpass the revenue limit. Both districts are among those that are increasing their total tax levies and contributing to the statewide rise, WPF notes.

“Property tax levies increased 3.7% on December tax bills in those districts that have adopted referenda since 2020 while they fell 1.3% in districts that have not,” the report states.

State leaders are expected to begin discussing the next biennial budget early next year. Regardless of what they do with the revenue limit, there are two factors to watch for their impact on property taxes toward K-12 schools.

The first is the soon-to-sunset federal COVID-19 relief funding that has boosted school budgets over the past two years. Most funds must be spent by September 2024, which could leave holes in some district budgets if they’ve used the influx of one-time money on operational costs.

Why is the taxpayer supported Madison School District losing students?

There has been lots of news out of the Madison School District lately. I’d like to focus on three stories that are interrelated. 

The first is the reinstatement of Sennett Middle School Principal Jeffrey Copeland. I’ve writtenabout that extensively, so I won’t go over the details here, but his return is a good thing. Copeland had been credited with restoring order to his school before he was fired over a minor infraction (if it was any infraction at all) and the School Board had the good sense to reverse an ill-considered decision by the central administration. 

The next story is about the decline in MMSD enrollment. The District is rightly concerned about that and it also understands that it needs to get a better feel for exactly what’s going on. While it’s true that there is something of a baby bust at work here, it’s also true that Madison is growing. The Board needs to get more demographic data to better understand how those two things — a smaller school age cohort nationally but a growing population locally — are interacting. 

And the third story is an ongoing debate about stand alone honors classes. The administration and most of the Board want to eliminate them in favor of honors work that can be done as part of regular classes. The Board had a spirited debate about that last night. 

These things are all related because they go to the health and quality of the Madison public schools. MMSD is losing enrollment in part because more parents are transferring their kids out of the system than into it. The Board wants more data on that. They suggest doing exit and entry interviews to get a better handle on why parents are opting out or in. 

That’s fine, but the net out migration is a key problem. It could be related to lack of discipline and good order in the schools. That’s why putting Copeland back to work was so important. It sends the message that the Board cares about this issue. Now let’s see what Copeland can do in a full semester next year. Maybe he has approaches and answers that can be replicated throughout the District.

Deja Vu: Advocating the Elimination of Honors Classes in the Taxpayer Supported Madison School District

West math teacher Sigrid Murphy said that even more recently, in the 2020-21 school year, “30% of the students in geometry at West identified as white while 72% of the students in geometry honors identified as white.” The school’s overall enrollment that year was about 52% white students.

“Within the (West) math department, all of us are completely, 100% behind the district’s plan,” Murphy said.

Those opposed suggest eliminating the classes isn’t the solution — instead, preparing students earlier on in their school careers so they feel ready to take on a challenge is key. Lately, some have also pointed to low reading scores on standardized tests to show that the district may not be doing that.

Laurie Frost, who is part of a group of Madison residents that has pushed the district on literacy in recent years, wrote in an email to the School Board and district administration on honors last month that she is “as concerned about the race-based disparities in enrollment in our honors classes as you are,” but that she has “a different way of understanding why the disparities exist.

“Put simply, the race-based disparity in honors class enrollment is due to the fact that we are not preparing our students of color for honors classes in their pre-high school years,” Frost wrote.

Board president Ali Muldrow suggested the district needs to focus on what outcome it wants, “striving for greater inclusion for all at the most rigorous levels of opportunity for our district.” She, like Frost, pointed out that preparing students for success in advanced high school coursework needs to begin early.

“One of my problems with how we’ve had this conversation over and over again is that we create the achievement gap in elementary school and then we pretend to resolve it in high school,” Muldrow said. “I’m really curious how what we’re doing in elementary school and middle school is going to align with this approach in high school, or if we’re just going to kind of create classrooms where some kids are more successful in a variety of ways than others.”

Associate superintendent of teaching and learning Cindy Green said the district is working on early literacy, full-day 4K and access to the arts, among other initiatives, to do just that.

Another concern from some opponents to the plan has been whether or not classes will be rigorous enough. La Follette High School senior and student representative to the School Board Yoanna Hoskins said she completed earned honors for a history course, and it only required one additional piece of work from the rest of the class.

“It wasn’t hard or anything like that,” Hoskins said.

The plan’s timeline includes updating course catalogs and course selection cards in November 2022, a step Green said they have already taken.

Madison school board reinstates Sennet Principal

Copeland told the Wisconsin State Journal this week that his comments were not about the applicant’s country of origin or race. Instead, he said, they were focused on ensuring students had a teacher they could understand in front of them.

He also suggested the comment about “just giving people damn jobs” was in reference to the national teacher shortage and lowering standards of who is hired, generally. When he was put on leave, he said, district leadership walked him out of the building in front of staff and students.

Multiple staff members and parents had told the School Board that Copeland had changed the school for the better in his short time there.

Science teacher Carmen Ames, who has worked at Sennett for 30 years, said in September the year had been one of “hope” because of the attitude Copeland brought early on, despite the short amount of time he was there.

“To see a culture change in eight days is phenomenal,” Ames said. “We need to continue that culture, and yes it is us (teachers and staff), we are part of that culture, but we need someone that backs us up and believes in the culture and believes in Sennett the way we do.

“That was Dr. Copeland.”

About a dozen Sennett staff members spent their Friday evening sitting in the hallway outside the closed session, listening to music and chatting as they waited to hear a final verdict. They at one point sang along to Queen’s “We Are the Champions,” subbing out “we” for “Sennett.”

After the board made its decision, the staff erupted in cheers and thanked the board members, asking for Copeland to start as soon as Monday. The district didn’t have his return date settled yet.

Afterward, the group of teachers called Copeland to tell him the news, with one teacher saying, “We’ll see you soon, boss.” Another said, “Our kids deserve the best, and you are the best.”

“To me, it shows that the power of people coming together can make things happen,” said Erin Proctor, a sixth-grade math teacher at Sennett.

She noted that many of the teachers who supported Copeland’s reinstatement were union members, who are typically fighting against administrators, not for them.

“To have us be part of the conversation and our support of him speaks volumes to the character he has,” Proctor said. She hopes this will spark change in other schools and districtwide.

When one of his staff members suggested they celebrate him, Copeland said no. “We will celebrate the teachers and the students. Not me. We will celebrate the teachers who stood by me and the students that were waiting,” he said.

Challenges to union control of local school governance were often successful.



Wall Street Journal:

The parental revolt even spread to Minnesota despite opposition from teachers union. Denise Specht, the president of the teacher’s union Education Minnesota, claimed in September that its “political program has been successful between 80 and 90 percent of the time when our locals make endorsements in school board races and carry out an aggressive voter contact plan.” 

Yet 49 of 119 school board candidates endorsed by the Minnesota Parents Alliance won on Nov. 8. The alliance was formed in response to parental concern about learning loss and a desire to be more involved in children’s education. “The fact that our candidates did as well as they did” shows that “the parent movement really transcends politics,” says executive director Cristine Trooien.

November’s parental-rights outlier was Michigan. The state “had abortion on the ballot, and that turned out Democrats,” said Ryan Girdusky, the founder of the 1776 Project PAC, which opposes critical race theory in school curricula. Nationwide only 20 of the 53 school board and state superintendent candidates endorsed by the 1776 Project PAC won on Nov. 8, with the majority of their losses in Michigan. Yet in total this year 72 school-board candidates and one state superintendent candidate won among the 125 candidates the group endorsed. 

Ballotpedia has identified 1,800 school board races where the Covid response or teachings on race, sex and gender were campaign issues. By Nov. 28 it had identified 1,556 winners. Some 31% of the identified victors opposed woke curricula or the Covid response, with some 37% expressing mixed or unclear opinions.

Dane County Judge dismisses lawsuit challenging taxpayer supported Madison Schools gender identity policy; appeal planned

Remington’s Nov. 23 decision does not directly address the merits of the policy but spends a great number of its 33 pages discussing what is considered legal standing, as expressed in recent state and federal court decisions.

Ignoring Doe’s lack of standing, Remington wrote, would be ignoring his own “limited and modest role in constitutional governance” and telling people he knows what’s best for them.

Remington wrote that while he doesn’t doubt her “genuine motive and keen interest in this case,” she is someone who was brought into the case to “invoke a court ruling upon” the matter. Many parents could believe, he wrote, that they or their children will be harmed by the policy, but they’re not part of the case.

“That is not to say that Jane Doe’s claims are not important — they just are equally important to every other member of the public who also disapproves of their local school board,” Remington wrote. “That our Constitution does not allow this court to take a side may leave the parties unsatisfied.”

Scott Girard:

The Wisconsin Institute for Law and Liberty has appealed the dismissal of its 2020 lawsuit over Madison Metropolitan School District gender identity guidance.

On Nov. 23, Dane County Circuit Court Judge Frank Remington dismissed the lawsuit, citing a lack of standing for the sole remaining petitioner, Jane Doe 4. The anonymous complainant is one of 14 original parties on the lawsuit — the rest have left amid two years of appeals and arguments over the process for the lawsuit.

“(Jane Doe 4) does not predict or anticipate she will be harmed, but she nevertheless seeks a declaratory judgment that a transgender student policy of the Madison Metropolitan School District violates her constitutional right to parent,” Remington wrote. “Because she presents no evidence that she predicts, anticipates, or will actually suffer any individual harm, Jane Doe has no standing and her Complaint must be dismissed.”

In May, Wisconsin Transparency Project president and founder Tom Kamenick wrote in an email to the Cap Times that he has “received more complaints about MMSD than any other government agency.”

“I’m frequently seeing lengthy delays, exorbitant fees, and downright illegal denials from the district,” Kamenick wrote. “The district seems to make transparency and accountability a very low priority, and I’m not surprised to see them sued twice in quick succession.”

State statutes outline the requirements for public entities regarding open records. In a 2019 compliance guide, the state’s Office of Open Government called part of the statute on open records “one of the strongest declarations of policy found in the Wisconsin statutes.”

“[I]t is declared to be the public policy of this state that all persons are entitled to the greatest possible information regarding the affairs of government and the official acts of those officers and employees who represent them,” the statute states.

Teacher union$ and $chool Board Governance: Californian edition

The California Teachers Association spent heavily on school board races in the state, distributing $1.8 million to 125 local affiliates, which were required by union policy to add almost $1 million more to the total.

That investment seems to have mostly paid off. California election results take weeks to finalize, but union-backed candidates are leading in 35 of the 52 races in which the state union spent the most money.

The biggest winner was Rocio Rivas, running for a seat on the Los Angeles Unified School District board. The union contributed more than $330,000 on her behalf.

The union supported Shana Hazan and Cody Petterson with $145,000, and they won seats on the San Diego Unified board.

2023 Madison Mayoral election: School governance makes a rare appearance?



Scott Girard:

As mayor, she would not have unilateral authority to put officers in schools. The school resource officer program, originally begun in the 1990s, operated on a contract between the city of Madison and the Madison Metropolitan School District.

Both sides voted to terminate it in summer 2020 amid nationwide and local protests over police brutality of Black people, specifically in response to the murder of George Floyd by officer Derek Chauvin in Minneapolis. Reyes said as police officers became “a focal point” of the protests, it “moved us away from officers” in schools.

“It wouldn’t have helped them to stay,” Reyes said. “They couldn’t do their job effectively if they were continuing to be criticized for their actions while in schools.”

Incumbent Mayor Satya Rhodes-Conway, who announced her reelection bid Sunday, supported ending the program in 2020.

Data on the SRO program repeatedly showed racial disparities in who received citations or was arrested by officers in schools.

Reyes, a former police officer, supported the program in 2019, siding with the majority in a 4 to 3 vote to renew the contract at that time. A few weeks before the 2020 vote, she announced her position had changed.

Madison’s mayors have long avoided substantive k-12 activity, despite our long term, disastrous reading results…. I’m told that years ago, Wisconsin City councils were required to pass school district budgets, in addition to the local boards.

Notes on Wisconsin DPI school ratings



Scott Girard:

MMSD had its strongest ratings in the growth and on-track to graduation priority areas, though both were down slightly from last year’s scores. In growth, the district received a 73.6 out of 100, while it scored 77 out of 100 for on-track to graduation.

In the other two priority areas, MMSD scored a 57 on achievement and 58 on target group outcomes. Both, again, were a slight drop from the previous report card.

MMSD spokesperson Tim LeMonds wrote in an email that the district did not plan to make a statement on the report cards.

Overall scores for schools and districts can fall into five rating categories: significantly exceeds expectations (83-100), exceeds expectations (70-82.9), meets expectations (58-69.9), meets few expectations (48-57.9) and fails to meet expectations (0-47.9).

Earlier this year, Republicans passed a bill to require DPI to return its report card scoring formula to the one used in 2018-19 and force the department to use the public rules process to adjust the formula rather than make any changes itself. It would have restricted DPI from giving greater weight to measures of growth in student achievement than measures of actual achievement in determining a district’s or school’s overall score on the report cards.

Gov. Tony Evers vetoed the bill.

On a call with reporters Tuesday, DPI accountability office staff explained that the changes to the formula that went into effect last year helped soften sometimes large fluctuations in small student groups that “weren’t true school or district changes.”

Office of Educational Accountability assistant director Sam Bohrod said the work began prior to the pandemic and they believe it’s a “more useful tool” for districts and schools to identify where they are in helping their lowest performing students.

Rory Linane:

They reiterated their plan for recovery, including more funding for special education, mental health and general school costs.

“We know that obviously the stressors of the past few years have exacerbated a lot of problems but we also know that mental health for children in Wisconsin, and far beyond Wisconsin, has really been at a significant problem level for far too long,” said Abigail Swetz, communications director for DPI.

DPI provided report card scores for 1,920 public schools and 163 private schools — a minority fraction of the state’s private schools. Private schools are given report cards only if they receive tax-funded vouchers and have a large enough student population.

Vander Meulen has faced an opponent in each of her two previous campaigns. In 2017, Ed Hughes was on the ballot but dropped out of the race following a health issue in his family and in 2020, the late Wayne Strong ran against her, but suspended his campaign amid his own health issues before returning to the campaign later in the spring. Vander Meulen said she expects to have an opponent again.

“If there isn’t, I will be pleasantly surprised,” she said.

The last three years have been an especially busy time on the board. In 2019, then-superintendent Jen Cheatham announced she would leave, and the board hired Jane Belmore as interim for the 2019-20 school year.

During that year, the board hired Matthew Gutierrez from Texas to take over as permanent superintendent, but he withdrew amid the onset of the pandemic to help his district through the challenging time. The board reopened the superintendent search over the first summer of the pandemic, eventually hiring Carlton Jenkins, who started his tenure a month before the 2020-21 school year.

Madison East’s April van Buren shares passion for high school journalism

A St. Louis-area native, van Buren spent five years teaching there and five more in New Mexico before she arrived in Madison and began working at La Follette. Her jobs have included a mix of teaching English, being a school librarian and now teaching a mix of design and technology classes.

At all of her stops, though, journalism was a key component.

“I don’t want to grade essays, I really just have always wanted to be a full time journalism teacher,” van Buren said, “but that’s not very common. They just don’t have schools where there’s enough classes to be full time journalism.

“So being a librarian and a journalism teacher, I absolutely loved.”

The new budget totals $597.9 million in spending, up from the $515.7 million spent in 2021-22 and the $482.9 million the year prior. It’s also up from the June preliminary budget, which called for $561.3 million in spending.

The tax rate, however, is down to $9.97 per $100,000 of property value from the $11.40 rate in 2021-22 amid an increase in the tax base and a boost in state aid. That means a reduction of $62.16 on an “average home” in the district.

A significant piece of the spending increase from previous years comes from $42.9 million in federal COVID-19 relief funding plus additional one-time funding from the state and for specific initiatives like mental health.

“We made some really intelligent and thoughtful investments in our buildings, in the safety of our students and our staff using those one-time resources,” board president Ali Muldrow said. “However, in the long-term, I think we have a lot of work ahead of us in that one-time resources have really set us up to be incredibly agile in terms of our next budgets.”

A major initiative in the months since the June preliminary budget vote gave a $5 an hour raise to hundreds of hourly staff members in the district. Board members also expressed an interest in extending that raise to custodial staff, who have asked for such a move since it was given to other hourly staff, but they weren’t able to include it in this version of the budget given its complexity.

Taxpayers are spending $23,449 per student (25,497 enrolled via the DPI website).

Baltimore County school board race heats up with endorsements, warnings

There are four contested races on the fall ballot, while three candidates are running unopposed. Meanwhile, the terms of four appointed members on the 11-member board are expiring later this year; their replacements will be appointed by the next governor, likely in January. Early voting has started and Election Day is Nov. 8.

Among the conservative contenders, none has drawn as much attention as Maggie Litz Domanowski, a mother of three children now enrolled in county schools whose past social media comments have come under scrutiny. She is running in council District 3 against retired educator Diane Jean Young.

Former state Sen. Jim Brochin recently endorsed Young, citing her experience as an educator and her volunteer work as a court appointed special advocate in Baltimore County. He also accused Domanowski of backing Republican gubernatorial nominee Dan Cox, who claimed falsely that the 2020 election was stolen from former President Donald Trump. Anyone who aligns with Cox “is a nonstarter and should not be part of any part of leadership,” Brochin said.

Domanowski did not answer a question from The Banner about whether she supports Cox, but did say she will work with and support whoever becomes the next governor.

As a senator, Brochin passed a bill that allowed board members to be elected instead of exclusively appointed. He described himself as a “very conservative Democrat” who voted with Republicans 40% of the time in the state Senate. He said Young’s more than two decades working in the Baltimore City and county school systems make her particularly qualified to serve on the board.

Domanowski has been endorsed by two Republican County Council members seeking reelection, Wade Kach and David Marks; state Del. Kathy Szeliga, who represents Baltimore and Harford counties; and U.S. Rep. Andy Harris, a social conservative who represents Maryland’s 1st District and is running for a seventh term.




Notes on out of school Madison k-12 suspensions



Scott Girard:

In 2021-22, there were 1,714 out-of-school suspensions (OSS) given to 766 students in grades 6-8. That was up from the 986 given to 529 students in the COVID-shortened 2019-20 school year, and most significantly from the 1,459 given to 714 students in the last fully in-person school year, 2018-19.

OSS dropped at both the high school and elementary school level, the latter aided by an October 2021 change to the BEP that forbade suspensions as a punishment for students in grades 4K-5.

Among high schools, there were just 12 more OSS in 2021-22 than 2019-20, despite an extra three months of in-person instruction. The 909 suspensions last year was well below the 1,303 given out in the 2018-19 school year.

In-school suspensions (ISS), meanwhile, were down at all levels of schools with fewer students involved. The largest drop from 2018-19 came at the high school level, which went from 1,286 ISS then to 320 last year.

Madison West high school fight: 25 students and a strong-arm robbery in which police recovered marijuana, fake IDs, fake currency and a spent shell casing.

Officers searching the vehicle the suspects arrived in found the marijuana and other items, the blog said. Lisko said that while no charges have been filed, a detective has been assigned to the matter.

Principal Dan Kigeya said in an email home to parents Thursday afternoon that “staff responded to the incident quickly, and due to the large number of students involved, requested support from the City of Madison Police Department.”

He also said some students reported that a weapon might have been involved in the incident, but a search of the area with a police dog didn’t turn up one. Lisko confirmed no weapons were found.

District spokesperson Tim LeMonds said later Thursday that seven students had been involved in the fight. He had not responded to a request to clarify whether the district was aware of other details in the incident and whether all of the people involved are district students.

“Historically, the concept of advanced learning and honors has served to segregate students based on race, socioeconomic status and special education status,” School Board member Savion Castro said. And when these students do access the advanced classes, they often report feeling “isolated, feeling tokenized and experiencing a white-washed curriculum.”

“I think we all agree that disparities at this level are unacceptable, and change is needed,” board member Chris Gomez Schmidt said. “In my opinion, our focus should be on addressing the barriers to access and preparation for these courses instead of dismantling the courses themselves.”

“Stand-alone and earned honors can coexist to create more opportunity for more students,” she said.

Multiple parents contacted by the State Journal weren’t willing to be quoted for this article, saying the contentious issue had become toxic.

Green said honors courses are just a “singular point” in advanced coursework, which includes expanding advanced classes and more experiential learning and internships.

Regardless of whether the stand-alone honors courses are still around next year, the district plans to implement a universal approach to the earned-honors credits. All ninth-graders will be required to take an advanced course, which could include a course that offered earned-honors credits.

“This means a lot to me because I don’t want students who are younger than me to lack various resources and opportunities that will be offered,” La Follette’s Yoanna Hoskins said. “I want my teachers to be well compensated and respected for all the hard work they put in every single day.”

Adding that she’s not yet old enough to vote herself, she urged everyone else to do so.

“And leaders, the adults that I’m supposed to look up to, let’s work together so we can get caught up (on funding),” Hoskins said.

Among the stakes in the Nov. 8 election are school choice. GOP candidate Tim Michels has offered support for universal school choice, and while he hasn’t provided detailed plans, it’s likely that includes a voucher system without income limits, given his past statements.

Incumbent Democratic Gov. Tony Evers, running for reelection, won’t likely get many of his policy priorities regardless of the outcome of the race, given the overwhelming Republican majority in the Legislature. But he used his veto pen regularly in his first term, including on education items, like halting a “parental bill of rights” and stopping a proposed breakup of the Milwaukee Public Schools district.

Evers, along with State Superintendent Jill Underly, have proposed adding almost $2 billion for public schools across the state in the 2023-25 biennial budget.

Kabby Hong, who teaches English in Verona and was a 2022 Wisconsin Teacher of the Year, said that the “public education system is on the ballot.”

“One election can radically change the landscape for all of us,” Hong said. “That is why I’m asking all of you to go out and vote and to not give in to cynicism, apathy and indifference.”

Commentary on school cell phone policies



Scott Girard:

Students get one warning each class period if they have their phone out, and if they take it out again in that class, it goes into a bucket or is given to the teacher for the rest of the period. If a student refuses, school administrators take the phone to the office for the day. After a few times of that happening, administrators will meet with the student and their family to discuss a cell phone plan.

“The goal is we approach this whole process with a restorative spirit,” Dugas said. “We really want to make sure that we put the power in students’ hands with this process and our students have done a great job.”

Two La Follette students and one from West also shared their experiences, which differed slightly based on how their schools have treated phones.

Miriam Rodriguez Jimenez, a La Follette senior, explained that previously she used her phone to check her school email, gain easy access to Google Classroom and the calculator. With the school’s “Away For the Day” policy, however, she said “now I can’t use it for any academic purposes.”

“It has kept me from being able to check my missing assignments in a class, it has kept me from being able to text my sister to see if she needs a ride after school,” she said, adding that students can’t even listen to music during individual work time.

At West, junior Sandy Flores said she used her phone to help teach herself materials. This year, her school’s classrooms have their own rules, and in most you cannot use your phone during instructional time, but can during individual work time in some classes.

Minnesota, as in other states, concerned parents have banded together to try to wrest control of the public schools away from teachers’ unions, in order to improve the quality of education and to stop left-wing indoctrination. Earlier this year, we started a 501(c)(4) organization called the Minnesota Parents Alliance to lead those efforts in our state.

In Minnesota last year, the Center of the American Experiment — a prominent think tank and member of the State Policy Network, which promotes conservative positions like an opposition to public-sector unions and support for voucher laws that help parents redirect tax dollars toward private school tuition — toured the state to fight against an “alarming” rewrite of the K-12 social studies standards for Minnesota schools.

“We filled rooms all across the state,” said the Center’s spokesman, Bill Walsh.

Effects of Maturing Private School Choice Programs on Public School Students

Using a rich dataset that merges student-level school records with birth records, and leveraging a student fixed effects design, we explore how a Florida private school choice program affected public school students’ outcomes as the program matured and scaled up. We observe growing benefits (higher standardized test scores and lower absenteeism and suspension rates) to students attending public schools with more pre-program private school options as the program matured. Effects are particularly pronounced for lower-income students, but results are positive for more affluent students as well. Local and district-wide private school competition are both independently related to student outcomes.

We began by asking our 18- to 20-year-old respondents (82.4 percent of whom reported attending public schools) whether they had ever been taught in class or heard about from an adult at school each of six concepts—four of which are central to critical race theory. The chart below, which displays the distribution of responses for each concept, shows that “been taught” is the modal response for all but one of the six concepts. For the CRT-related concepts, 62 percent reported either being taught in class or hearing from an adult in school that “America is a systemically racist country,” 69 percent reported being taught or hearing that “white people have white privilege,” 57 percent reported being taught or hearing that “white people have unconscious biases that negatively affect non-white people,” and 67 percent reported being taught or hearing that “America is built on stolen land.” The shares giving either response with respect to gender-related concepts are slightly lower, but still a majority. Fifty-three percent report they were either taught in class or heard from an adult at school that “America is a patriarchal society,” and 51 percent report being taught or hearing that “gender is an identity choice” regardless of biological sex.

“The Madison school district’s 2022-23 budget has increased from the preliminary $561 million budget adopted in June”

We have extended ourselves beyond a balanced budget with this calculated use of fund balance to make this historical investment in our hourly staff,” board member Christina Gomez Schmidt said, “which we have heard is very important.

“I do want to recognize that our obligation in the next year’s planning and budget is to make the structural changes that we indicated would be needed to balance this investment and not create a structural deficit for future budgets,” she said. Some of those proposed structural changes include repurposing or eliminating 100 positions in the district.

“I know this discussion tonight is about the 2022-23 budget, but beyond this year I’m concerned about future budgets and the future of funding for public education in Wisconsin,” she said.

Board member Savion Castro said, “I think we’re going to have to look at another referendum in the coming year or two, given our fiscal situation.” (Taxpayer supported political activity)

Madison taxpayers have long spent more than most k-12 school districts, now more than $22,000 per student.

Scott Girard: It continued the ongoing drop since the onset of the pandemic, which has seen the district go from 26,977 students in fall 2019 to 25,244 in this year’s “third Friday count,” which is completed on the third Friday each September. This year’s drop, however, was smaller than the past two years, which saw drops of 1,032 and 470 students.

Madison public charter school mostly mum on gun found in employee’s backpack

A state-authorized public charter school in Madison initially refused to work with police after a student found a gun in a school employee’s backpack, according to a recently released police report, and the employee refused to answer questions about the incident.

Police ultimately closed their investigation of the June 1 incident involving Milestone Democratic School teacher Art Richardson, saying they did not have enough evidence that Richardson knew he had the gun in his backpack and after Richardson put off speaking to them and then cut off communication entirely.

Knowingly bringing a firearm into a school is a Class I felony under state law, punishable by up to three and a half years in prison, a fine of up to $10,000 or both.

Schoolchildren Are Not ‘Mere Creatures of the State’

In 1925, the U.S. Supreme Court overturned an Oregon law requiring that parents or guardians send their children to public school in the districts where they lived. The Society of Sisters, which ran private academies, claimed that the law interfered with the right of parents to choose religious instruction for their children. The Court agreed, unanimously. States are permitted to run and regulate schools, even to require that all children receive an adequate education. But the Justices held that the state may not “unreasonably interfere with the liberty of parents and guardians to direct the upbringing and education of children under their control.”

The decision in Pierce v. the Society of Sisters featured one of the more memorable turns of phrase in Supreme Court history. “The child is not the mere creature of the State,” wrote Justice James C. McReynolds. “The fundamental theory of liberty upon which all governments in this Union repose excludes any general power of the State to standardize its children by forcing them to accept instruction from public teachers only.”

The notion that the state must not interfere with parents and their right to direct their children’s upbringing and education has cast a long shadow over U.S. education. But now, nearly a century after Pierce, the state seems increasingly inclined to relitigate the matter—if not in court, then in practice and policy in America’s public schools. There is a rising and unmistakable tendency on the part of teachers and school districts to assume that government is better positioned than a child’s parents to judge what’s best for children and to act on that assumption, often aggressively, making critical decisions about children’s upbringing and well-being without their parents’ consent or even their knowledge.

There have been myriad recent examples of schools imposing their staffs’ ideological preferences, and in so doing being disingenuous or openly dishonest about critical race theory, trangenderism, “social and emotional learning” programs, and other controversial aspects of school curriculum and culture. The picture that has begun to emerge is of an education establishment straying beyond its remit, emboldened to ignore parents, and determined to subvert local control of schools to advance a social-justice agenda. “It’s infuriating, it’s harmful to children, and it’s unacceptable,” says Vernadette Broyles, an attorney and the founder of the Child and Parental Rights Campaign. “And it’s contrary to law.”

School Is for Wasting Time and Money

I have deep doubts about the intellectual and social value of schooling. My argument in a nutshell: First, everyone leaves school eventually. Second, most of what you learn in school doesn’t matter after graduation. Third, human beings soon forget knowledge they rarely use.

Strangely, these very doubts imply that the educational costs of the coronavirus pandemic are already behind us. Forced optimism notwithstanding, the remote schooling that millions of students endured during the pandemic looks like a pedagogical disaster. Some researchers found that being in Zoom school was about equivalent to not being in school at all. Others simply found that test scores rose much less than they normally would.

But given my doubts about the value of school, I figure that most of the learning students lost in Zoom school is learning they would have lost by early adulthood even if schools had remained open. My claim is not that in the long run remote learning is almost as good as in-person learning. My claim is that in the long run in-person learning is almost as bad as remote learning.

How do we know all this? My work focuses on tests of adult knowledge — what adults retain after graduation. The general pattern is that grown-ups have shockingly little academic knowledge. College graduates know about what you’d expect high school graduates to know; high school graduates know about what you’d expect dropouts to know; dropouts know next to nothing. This doesn’t mean that these students never knew more; it just means that only a tiny fraction of what they learn durably stays in their heads.

This is especially clear for subjects beyond the three R’s — reading, writing and arithmetic. Fewer than 1 percent of American adults even claim to have learned to speak a foreign language very well in school, even when two years of coursework is standard. Adults’ knowledge of history and civics is negligible. If you test the most elementary facts, like naming the three branches of government, they get about half right. The same goes for questions of basic science, like “Are electrons smaller than atoms?” and “Do antibiotics kill viruses as well as bacteria?”

Madison School Board approves $2-per-hour wage increase for education assistants

Legislative Republicans have defended their decision to keep revenue limits flat by noting Wisconsin schools will be getting $2.3 billion in federal COVID relief aid, known as Elementary and Secondary School Emergency Relief, or ESSER funds. Madison is anticipating its share will be roughly $66.7 million.

School officials have not laid out how they plan to spend that money but say using it for ongoing expenses, such as hiring more staff or increasing wages, could create a fiscal cliff once the one-time dollars run out.

Monday’s vote came one month after the board approved a 3% base wage increase for all staff for the coming school year, two-thirds of what was sought by MTI for teachers at the start of negotiations. Teachers also get automatic raises for seniority and degree-attainment on top of that.

Mandates, School Closures and Student Academic Outcomes: Virginia Edition

While students saw across-the-board gains in the 2021-2022 school year compared to the previous academic year, state education officials said the progress was not enough, and pinned some of the good news on lowered standards — not on better student performance.

“Despite the scores being up from last year, they are down from pre-pandemic levels,” said Jillian Balow, state superintendent of public education, in a news conference Thursday.

The standards of learning data also showed that schools that returned to in-person instruction sooner fared considerably better than schools that remained virtual or hybrid longer.

“Students whose schools were closed suffered the most,” Balow said.

Republican Gov. Glenn Youngkin tied the results to school closures, and pledged to address disparities.

“The SOL results released today demonstrate that prolonged school shutdowns undeniably exacerbated the learning loss experienced by Virginia’s students, and the very best [antidote] is in-person education,” Youngkin said.

The differences were particularly stark in mathematics. Two-thirds of students passed math exams last school year, compared to 82 percent before the pandemic. Racial and economic disparities also widened, with White and Asian students making more progress toward their pre-pandemic levels than Black and Hispanic students.

Passage rates remained more than 20 points behind pre-pandemic levels in math for Black, Hispanic and economically disadvantaged students, and among students learning English.

All groups fared better in reading than they did in math, but state officials said that was due to the fact that standards were lowered in 2021, and cautioned against optimism.

Milwaukee Public Schools, the only Wisconsin district larger than MMSD, saw all student groups have lower rates of opting out of AP exams than the state average.

“This is especially important as MPS serves large numbers of students of color and is the district with the highest AP enrollment for English Learners and students who identify as American Indian or Alaska Native, Black, and Hispanic, and is a very close second for students identifying as Asian,” WPF writes in its report.
